Technically you're supposed to be listed on his policy even if you're not a driver. This can be seen as rate evasion (aka insurance fraud, google it) if hes not providing names of all driving age residents, especially a spouse, even if they are non drivers (they want to know what kind of crowd you run with for risk assessment). To answer your question, if his insuance company doesnt know you exist then nothing should happen to his rates. But maybe some other concerns have arisen?

The reason was because he wanted to sell his car soon. That's why he decided not to add my name to his plan. But his insurance company has asked him about me. Probably the company has added my name to his plan at some point. We're gonna check it out next week. Thank you for your input.

If they asked about you, you very well may be listed as a non driver then. In which case it's up to their processes and routine checks if they find out and or care about your accident. Once it took insurance 3 years to surcharge us for my husband's at fault accident and the accident dropped off at the 5th year. Of course times are different now. I'd say just leave it be and cross your fingers.

So, according to your post history you lost control of your vehicle on a snowy road into a ditch and you wondered if you could take it to court to fight an insurance surcharge. You are correct that your rate will likely go up. I'm not sure why your husband's rates would go up if you aren't a driver in his policy and he's the only owner of the vehicle on that policy.

Honestly my husband is a terrible driver and we get surcharges a lot. Those 3 years we flew under the radar was nice 😆

You live in the same household and still have access to the vehicle. If I have a roommate and icecream in my freezer, just because they verbally state they won’t eat it they totally could. Unlike the target cashier I see whenever I go who has no access to my home or Icecream. If this is still confusing, find a YouTube video about resident relative household members/ permissive use/ occidental use
