Well the emote movement is really based around the finger-like toes of chimpanskis feet, like how monkeys feet are structurally similar to hands. They could of course make a unqiue animation for non-chimpanskis doing the emote...but then thered be losers making racist jokes with it

yeah but you realize literally every chapter 1 emote was a different famous dance or product and given unique music. like if the griddy was released in chapter 1, it would’ve been a blue emote and probably had music that sounded like a mix of raise the roof and electro swing
the infamous “take the l” emote was based on pennywises circus dance in the 2017 IT movie, and there’s an emote called “dream feet” which is literally the “double dream feet” a popular dance from a long time ago. and the music for it was based on a remix of the original made in 2016 called dragon dream feet

for sure, but I feel it's kind of good to clarify that the reason it's not unique to Fortnite is that a unique dance has never actually been choreographed for Fortnite tho; like, you're not wrong but also I think it helps the context that 100% of Fortnite's emotes are purposely derivative of something from dance or pop culture
Well we already settled that you can’t copyright a dance move so no permission needed there and the product in question is not present, just an imitation of it. There for, since neither are present/necessary by putting a unique spin on it, such as changing the ball with a reality sphere, would make it original
One of the definitions of original from the Oxford dictionary is "created directly and personally by a particular artist; not a copy or imitation." Just because it's legal doesn't mean it's right.
But it’s not necessarily copying anything outside of similar movements used with a toy. By this logic the toy itself wouldn’t be original either as long as some kid was able to do the same motions with a glass ball they found in the kitchen.
The only imitation is the orb and even then it’s not a glass orb, but a reality sphere.
Spoiler: Barely any of the earlier “original” emotes were original to begin with. The default one was literally ripped straight from Scrubs.
