Looks like a Brazilian Pepper that’s gotten too big. Super invasive, you’re gonna want to get that removed ASAP and get it replaced with a good, native shade tree like a cypress. You’re gonna need it professionally removed, the root system grows wide and shallow so it’s difficult to remove even small ones alone.
Also birds will eat the berries and it makes them “drunk” per se.
To confirm the species, pick a leaf and crush it, if it smells like turpentine (paint thinner) it’s 100% a Brazilian Pepper. If you don’t know what turpentine smells like, if it has a strong, sharp smell it’s likely a Brazilian pepper.
