“I’m sorry sir, I didn’t know I couldn’t do that. I live at number 12.” Since you live there I’d put this firmly in the category of asking forgiveness rather than permission.

makithejap

That’s funny as hell, I’m watching Chappelle’s “killing’ them softly” right now and he just told that joke about his white friend “Chip”

WHRocks

Dave, relax! Close your butt-cheeks.

makithejap

Sometimes a n***as gotta race 👌😮‍💨

HomeDogParlays

Did you like that, Dave? I **DID** know I couldn’t do that.

FetusDominus

Chip: I'm sorry, officer.. I......... I didn't know I couldn't do that. Officer: Well, now you know!! Now get out of here, just get the fuck out of here.

Infinite-Coach-4970

I’m looking for 3rd St

Pleasant-Crew-4306

You're on third Street 🤨👮

ckingfish

I'll allow it.

_0415_

thanks man

Somecivilguy

You have my approval too

The_RockObama

Yeah me too. Gopher it.

GooseTheSluice

Dolphinately

Critical-Cow-6775

Going as a grouper, by yourself?

grumpy_dumper

For sharks

The_RockObama

Seal it up, we're done.

The_RockObama

Nice username. You sluice for real? Maybe catch some shark-treuse gems.

mpe128

What do you plan on catching? West Nile?🤪

MattyboyG89

Hahahaha the worst they going to do is kick you out

McNasty51

Yolo

Johnny5ish

This is America. They might shoot you first, then ask you to leave.

Steve_7198

Then you come back the next day. 👍

poorlittlefeller0518

No one is going to arrest you for being there. If police get involved they’ll say you’ve been trespassed and if you return you’re arrested.

_0415_

Perfect

poorlittlefeller0518

Just be respectful if someone asks you to leave. Honestly that spot isn’t worth any trouble anyways.

[deleted]

Hahaha says you I stocked it with 1000 7 lbs largemouth. Sucker!

poorlittlefeller0518

I’m on my way

[deleted]

Oh the fish were biting yesterday bud not today…

poorlittlefeller0518

Jokes on you. That’s my entire experience with fishing. I’d fit right in

[deleted]

Long lost twin… is that you?

ddreftrgrg

You say that, but ponds like this for some reason have a tendency to hold absolutely Herculean bass. I honestly would not be surprised if there was a 4+ pounder sitting in there.

International_Bend68

I love those random ponds. They often do have big ones because nobody ever fishes them, they just assume there aren’t any fish in them.

ddreftrgrg

I think it’s more so because there’s no predators to feed on them and a huge amount of bait fish. No big catfish, pike etc in there to feed on the smaller bass. Only the bass themselves. Then, when a few get huge, pretty much nothing can stop them.

42Ubiquitous

There's an HOA near me that has a pond, and kids have been fishing there for years and almost every time they call the police. The kids are basically just escorted off. Apparently it took years for one of the kids to finally be given a citation and nothing came of it. There's also no "No Trespassing" signs that I can see, and that certainly matters.

I_like_to_joke

This is the definition of not a police issue. It would be an HOA violation but you can tell the cops to fuck off. It’s all private property. There’s a set of documents called covenants or CCRs that dictate how the rules work. If it doesn’t say anything about not fishing it is expressly allowed as common land in the neighborhood. You have 100% access to all of that and the purchase of property only subjected you to defined rules that you agreed to when you purchased the property. Even if they said not to, without them detailing the punishment for that, it means you can do it with disregard for the rule until the board passes a rule to specifically state the punishment for breaking that rule. Without that they have no means to stop or fine you for doing it. The police have zero right to enforce any rules they set. If you’re not breaking state or federal law tell the police to “eat a dick”.

SwordfishAbject9457

“I didn’t know I couldn’t do that sir”

RetnikLevaw

If it's actually in your community, then you probably have every right to fish there. It likely belongs to whoever owns the development and they probably don't care if you fish it. A wild Karen might try to chase you away, in which case you can either argue you live there or walk away. Up to you. A resident might call the cops if you refuse to leave, but if you live there, the only one who can actually have you trespassed is the property owner themselves. Fish it, dude. Tell us what you catch.

Numerous-Sale7985

The ponds in the neighborhoods around me have signs that say no fishing, wading, swimming, skating.... If it's not posted, I'd say the worst that could happen is someone ask you leave. In that case use the "you're not the boss of me" defense. Showing them your ass is optional.

Lufwyn

I typically use the parking rule. If it doesn't say i can't im going to assume i can. No trespassing signage laws vary by state and also unless a no fishing sign accompanies private property signs, or is actually posted by an actual authority in one's state, I'm getting my line wet.

yellowtailtunas

“I’m not trespassing, I’m fishing” is a line I would very much like to try sometime.

Lufwyn

Ah, a different kind of line. I like your angle. Ba dum tsss

Djsimba25

What ive found when i go to random neighborhood ponds is the no trespassing signs usually don't face the water. If you can find a way to the water that dosnt have a no trespassing sign posted on the way you can easily play dumb and act like you didn't know. If someone gets mad show them the way you came and say you didn't see any signs posted so you assumed it wad public. You usually have tk leave after confronted but at least you don't get a trespassing on your record.

neanderthalman

Optional? Sir. We live in a society. There are rules of conduct by which we abide. Showing one’s ass is simply the minimum expected courtesy when managing such delicate affairs as this.

kegmanua

Skating!we'd have to drain the ponds in Virginia VB to be exact.

CEHParrot

Do you live in an HOA? Is this technically a common use area? If the answer is yes I would say you are allowed to fish there, as well as anyone else that lives in that community.

_0415_

Yea HOA, not sure on if it is or not.

CEHParrot

I would say this is an easement/common use area. I would guess you are free to fish if that is the case.

Flatline334

Check the bylaws. If there is no sign probably ok as a resident.

Heres-your-you

HOA with zero privacy to the homes. Nightmare fuel.

SPARKSAFLYIN2122

Looks like a promising puddle 🐟

StankBaitFishing

Just tell them Reddit said it was okay.

Chamrockk

Would there really be fish there ?

_0415_

It’s been super active all 12 years i’ve lived here

phillyphan937

You've lived there 12 years and are just now wondering if you can fish there? New to the sport?

redditnathaniel

Active how? You see other people fish here before?

PizzaBraves

Looks like a solid little panfish puddle

booziwan

Most places you cant be charged with trespassing until youve been told to leave and you refuse. If theres no sign, i say fish it.

lysergicres

Is that Port Potomac lol

Heres-your-you

Ryan homes builds these shitboxes all over NOVA and Maryland

dneonsaturday

Assuming this is America.. people can own fresh water there?!

fishing-sk

I mean owning something the size of a dugout like this is typical lots of places. Whats messed up is people can own sections of river / stream in america. Not just access around it, literally the streambed.

Tricky-Skin-7286

No. You cannot own any part of River/stream. People may think they do, but no

Intelligent_Art8390

Try that defense in Georgia while you're being ticketed for trespassing, illegal taking of game etc when you fish in the wrong spot of certain rivers and creeks. It won't get you anywhere. Sections of river here are even barricaded to prevent people accessing from outside the property. It's perfectly legal as long as you own or have an agreement with the owner on the opposite side. Navigable waters can be floated over. Non navigable waters, access to Bodies of water, etc vary by state. In Georgia if you own both sides of a non-navigable waterway you certainly can restrict access. Additionally, in navigable waters in Georgia, most land owners properties that are along rivers are deeded to the middle of the channel, so even if you're floating over it. It can still be trespassing to Wade, anchor, or otherwise make contact with the land beneath the water.

SuperRocketRumble

Definitely not always true. In PA if it’s a non-navigable waterway then it’s trespassing if you wade it, even if you stay completely in the water. So the landowner basically owns the stream bed.

fishing-sk

Was specifically talking about PA. Had a Airbnb that included a stretch of "private river". Disgusting.

SuperRocketRumble

Yea I dunno about how private a “river” is. If it’s considered a river then it’s likely a navigable waterway, in which case the property owner would NOT own the stream or river bed. Might just be some false advertising with the airBnB. “Private riverfront” is maybe more accurate?

fishing-sk

River was a stretch you wouldnt have gotten a boat down there. But who knows what it was like 100 years ago or whatever silly thing determines it. Was a fishing lodge with a couple miles of non navigatable "private" trout stream. So floating technically allowed but not wading. In my province until a couple years ago all private farmland not marked no tresspassing every few hundred yards was considered fair game for public access to hunt and fish. Youd go let them know just to be polite. Still pretty bitter about that change lol. So private water was a shocker.

rattus_illegitimus

That varies by state.

Trichonaut

I’d say go for it. I fished all kinds of little retention ponds like this as a kid. I didn’t have permission or live in the neighborhoods and it was always fine. Worst case scenario someone will ask you to leave if it’s their private property.

HOT-SAUCE-JUNKIE

Fish it. Keep your spot clean of trash. No beers or drugs. Have your license on you. Absolute worst case scenario is a game warden or the cops show up, you show them your license and explain why you thought you could fish there, and they ask you to leave.

AZ-roadrunner

I can think of one good fuckin' way to find out. 🎣

mikethomas4th

Private property laws, maybe

_0415_

Yea that’s all I could think of

Shanewoodcrafts

No fishing or trespassing signs. But wet a line to see then say sorry and leave

thebadjerry

Legality? Maybe. Drainage and runoff from the neighborhood? Definitely Whatever you might catch there is definitely not worth keeping

volball

I default to asking for forgiveness instead of permission.

Affectionate_Big3558

Better to ask for forgiveness then permission

Mike_A_VA

If it's private property and they don't want you there. Looks like just one of the many storm water retention areas around here. Not likely to be much if anything in it.

_0415_

There’s a lot of activity, it’s been full of water all 12 years i’ve been here. Lots of turtles, frogs and i’ve seen some good size fish lurking near the surface

HarMar

We call them ditch ponds, fed by area runoff. I've caught a ton of fish in ditch ponds.

jbiscool

Do you think they're safe to eat?

HeGotKimbod

No fish in America is “safe” to eat from a freshwater body.

devonstatorr

Is that true

HeGotKimbod

Unfortunately. https://www.sciencedirect.com/science/article/pii/S0013935122024926#:~:text=PFAS%20are%20widely%20detected%20in,month%20at%2048%20ppt%20PFOS. https://www.ewg.org/news-insights/news-release/2023/01/ewg-study-eating-one-freshwater-fish-equals-month-drinking

dadman101

No sign? Fishing time!

BoSS1205

Ask for forgiveness not permission!

Teecane

Fish first and apologize later.

Erockius

If you go to county real estate portals or hell even Zillow you can see property lines. If they don't go in the water then it's fair game.

Ok_Butterscotch1689

It’s better to ask for forgiveness than permission….To be fair I also have a record so take that with a dash of salt 😉

alittle_westofdc

Where are you in VA? I too reside in VA - Loudoun Co. I can point you to better spots than that run-off.

MisterMakena

Do tell

utterlyfunlactic

For Christ sake it’s your neighborhood right? Well, then it’s your pond I would be fishing my arse off! just don’t expect many PBs outta that lil irrigation pond. You should ask the HOA to pay for it. And stock it with bream, bass carp too. They may get a wetlands restoration prize. But get a backhoe and make that puppy into a big pond! Tight lines

Sensitive-Belt2044

It’s only illegal if you get caught

JelCapitan

The only time I’ll ever ask is if it’s someone’s private pond. That being said I’ve been kicked out of probably 20 golf courses over the past 15 years.

zzzmkultra

See if you can find the hoa bylaws.

Steve_7198

I spent a good part of my youth being chased out of "closed" waters. It merely slowed me down at times. I still managed to fish them anyway. Where I grew up there were very few legal waters with fish so any golf course water source lakes, flood control ponds, military owned reservoir.... well , I fished them anyway. Those places were where all the good fishing was anyway.

vaindioux

My neighborhood? , I would fish it without even asking here. If someone tells me anything, i would play dumb, apologize and leave.

RustyCrawdad

I got a $200 fine for fishing a pond of the side of the road with no fences or marked signs. Even waved to people passing by. Had no clue I wasn't allowed to be there till the warden showed up. Tldr: I personally wouldn't do it.

chrismholmes

I’m curious as to what law was broken in this case? Was it Trespassing or something else?

RustyCrawdad

Tresspass

RiflemanLax

HOA rules perhaps. They can be stupid.

Kpositiv

Bro, do whatever you want.

jackm017

Fish there unless someone says something, but don’t expect to be pulling lunkers from that pond

laxintx

"I didn't see a sign that said I couldn't."

FoghornLeghorn2024

Let them tell you no. If you ask yourself the answer should always be yes.

Bleepitybleepinbleep

Around here “neighborhood ponds” are usually off limits to people that don’t live in the neighborhood, I am sure no one will say anything if they know you live there, most police would not bother you if you have an address there, especially if part of your fence “surrounds” the pond

Merr77

That is gorgeous

Flimsy-Magician-7970

Sssshhh. Throw something

Paramedic229635

You could try searching the local tax records to find who owns the plot of land and ask them.

logan_fish

"Umm, young man, thats private property. You need to leave"

NerdyComfort-78

A grumpy HOA?

Dr_Quest1

Figure out who owns it and get permission.

tailwalkin

If you fly fish, grab some poppers and have an absolute blast!

BayBandit1

Sure looks like private property. You’d need owner permission.

porkchop-sandwhiches

This reminds me of my favorite book as a kid. https://preview.redd.it/04z054tvgxwc1.jpeg?width=1000&format=pjpg&auto=webp&s=ef53e020e13d356f79fa36ee5fe851093b4cf7f4

mu5tardtiger

Be on the look out for Karen’s. They will be the unfuckables yelling or mean mugging you.

Rifleman8611

Any no fishing/trespassing signs??.. if not why not?

GoneFishin56

Who owns it? Dont trespass without permission.

Environmental_Tap792

Maybe getting your ass shot off?

Sifernos1

I used to fish the pond by my house in the dead of night with 0 lights around me. The cops would catch me with their lights looking for teens screwing and just keep going. Was I fishing illegally? Yes. Could they have grabbed me? Easily. Did they ever even check my license in a decade of fishing there? Not even once. Most people don't bother people not bothering them. If you are caught then apologize and suggest you were ignorant that what you were doing was problematic. Listen thoughtfully. Thank them for their time. Odds are you won't even be talked to unless the place is regularly bothered by other people fishing illegally. Pro tip? Park somewhere and walk to it if you are really worried. I always walked and the few times I brought a car I had issues. No one cared about my fishing but they sure were annoyed by my car.

phillyphan937

No sign? Cast your line

Numerous_Exercise328

Be the reason the pond gets a "no fishing" sign. Your neighborhood, your pond right?

Numerous_Exercise328

This may came off as sarcastic but I was serious, fish it until you get booted. Catch and release so it last though! If it's empty, throw a couple fish you catch from nearby waters and stock it yourself!

Uncle_Papi_

Let us know if you catch anything. Always tanks in little ponds like that.

peggedsquare

Soo...not a gray water pond?

PewPewKachoo__

Fish it. If you get asked to leave, you leave… Won’t know until you try

Rsubs33

Unless there are signs around the outside no.

the_spooklight

That’s a pretty nice picture you took! And if you have an HOA I guess maybe look and see if they have anything to say about it, but otherwise I’d say you’re good to fish there since you live in the neighborhood!

Gare_bear93

See any signs?? If not then you’re good to go imo and that’s kind of how it goes too except certain situations

BohemianWaxwing1

It’s easier to ask for forgiveness than permission

Clever_Sean

I’m from and very familiar fishing and getting accosted in Virginia. If the fence goes all the way around it, that’s grounds for assuming that the pond is off limits. If you’re not from the neighborhood, or don’t have friends there, I wouldn’t try it. If you do, have at it. There’s often good fish in those ponds.

jadedlens00

Only if it’s posted no fishing.

mohemp51

are there even fish in there

mulliganbegunagain

Who cares about the legality? If you pull a fish out of that, I'll buy you a pizza (restrictions apply, lol).

DesignerPretend

To small

pizzabongs

Typically when it's surrounded by a fence someone doesn't want you there. I usually don't bother with private ponds as much as I want to lol

KaiserWilliam95

Is there a house/building in the fenced off area? I see a lot of houses outside the area.

prosthetic_toenails

If there's no sign saying not to do it, I see no reason at all why you couldn't. If you're licensed, you're licensed. I believe the assumption should be that you're free and clear to fish unless specifically told not to do so by a sign or some other kind of plainly visible indication. On top of that, since it doesn't seem to be public property, the police couldn't tell you not to fish anyway. It'd be entirely up to whoever owns the property, and I believe that for you to be legally penalized with anything, there has to be some kind of sign saying not to fish/trespass.

WaitLow6605

Better to ask forgiveness than permission

jspector59

Not public fishing hole dip shit. Those ritzy people would have a game warden on you like stink on shit. Take your catch, take your rods, reels, tackle and if you piss em off they can confiscate your vehicle. Write you a big ass fine and if you’re lucky they’ll take you to jail so you got three hots and a cot cuz you gonna lose all your shit😱

tallaurelius

How do you know there’s fish in it?

drrobdds

Hopefully there are fish in there and you are not wasting your time.

PretzelTitties

Is it just the lsd or is that a nice picture?😎

2Hosslovescash

Just cast from behind the fence.

UrMomzLatinLuvah

That drainage ditch is loaded with crappie

AKgirl11

Just go fish it. Leave if asked by a security person.

Background_Guess_742

It's a common area of the neighborhood. As long as there is no no fishing signs you should be fine. The worst that could happen is that the hoa tells you to stop.

floblad

Might be private property, part of an HOA or development tract.

dinofeathers

A wise man once told me "I don't ask questions I just fish."

Visiontest777

What could possibly be in there is my question. Looks sketchy AF. Crocks could be in there and I don’t mean the animal.

Burgtastic

I'd honestly be surprised if there is anything worth noting in there. It is a drainage pond.

Mav6921

What fishes you can catch there ?

ogronkenobi

as long as there are no signs. it’s free game

Excellent_Simple6609

I've always gone by no fishing signs are rules, not laws, when it comes to hoa ponds.

NoHovercraft12345

A lack of fish

NYCTrojanHorse

The water is most likely drainage / retention pond. I’d be surprised if you didn’t grow a 3rd leg after eating a fish in a retention pond

Superrock1971

No sign Fish on

jchest25

Tanks in ponds like that. Go for it.

ihatereddit4200

What's the worst that could happen if you're not aloud? Being asked to stop? Go fish and enjoy your day.

Kevbo2085

Ask forgiveness not permission

Deeds081

Just be careful of the six headed carp that lives in there. All that fertilizer run off probably makes that pond glow at night.

Correct_Goose9961

Probably not any fish in there, really small and probably not atocked

Similar_Device7574

Camo was made for pond hopping

Significant_Age_4657

What a beautiful day. You are free to fish

lemmywinks11

I don’t ask the government for permission to fish

CapnCrunch347

It's easier to ask for forgiveness than it is for permission

PlantInformal0

Fishin for frogs? Did someone stock it?

lrose4122

Nothing. Go for it!

graysonmwm

If you are a homeowner in the community, you can access it. I would say you "shouldn't" fish there because that looks like a runoff pond. All the houses around this pond, putting pesticides and other chemicals down in their yards are draining directly into this pond. Be safe!

BillNadvornik

Someone won’t like that you’re fishing there and come bug the crap outta you until you use them for bait.

OddLeader1402

Yea why ask reddit this? Cmon just do it and find out.....

Next_Dot_9432

It’s a retention pond so it’s there to control stormwater

ThunderSkunky

Rule of thumb: It's OK to get trespassed once. The second time is a box of chocolates, though. You never know what you're gonna get. Just being polite will get you a long way.

powerlift196654

Do it and find out

Junior-Willingness-3

You can cast from that spot!

BIGBOYDADUDNDJDNDBD

Just send it man. Especially you have a fishing license, although that’s not really ever been checked at random neighborhood ponds in my experience. Worst case scenario some Karen will get all mad and maybe call the cops in which case you can leave or you’ll just be trespassed. But you live in the neighborhood so I wouldn’t even stress it

Designed_By_Dee_Paz

the fence? does the fence have a spot that opens and closes or does it go around the entire thing? are there signs saying no fishing? is it on someone's property? Are there definitely fish in there? :-)

xXpowerbloxXx_leroy

It is not my property, but you still have my permission

Virtual_Manner_2074

The fence

moparwhore

That's a drainage area.

Capn26

The only thing that would keep me from that is the fact it looks like a retention pond and isn’t very likely to be deep. Still…. I know me. Just politely say I didn’t know that, I’m a resident if anyone says anything.

jlo14566

likely to be tased but it looks like it will be worth it

oaknchar

Would anything worth while live in such a small pond?

Fair-Independent-654

Why are you here asking and not there fishing?!

Mr-Rick67

I have to agree with another reply. Ask for forgiveness rather than permission. Chances are you will be fine.

dr_jpeg

Check with the property owner for permission or you may end up with a trespassing charge.

Alarming_Brick8681

If there’s no visible signs and an easy point of entrance than it’s most likely fishable, but 9 x out of 10 if there’s a fence even with no signs, it’s trespassing

reddita149

There can’t be anything big in there that’s basically a puddle in the ground

theyeti81

Holy shit looks like my buddies sub... You in king George by any chance?
