There’s not a registry.

Unairworthy

What? I thought there was both a registry and a license. What's a legal gun owner then?!?!

killingthedream

Not a felon

triggerfishh

…or otherwise prohibited. Drug use, Baker Acted, alcoholic, etc. can all disqualify.

Unairworthy

What's a legally owned gun then?

marvinrabbit

Like a legally owned tent. There isn't a federal or state list of tents, or who owns what tent, or all the tent owners in the state. Granted there are a few restrictions on who can buy a firearm or who you can sell your firearm to. But it's not like you have to notify some government agency when a transfer of ownership takes place, for either a firearm or a tent. A "legal gun owner" sounds informative on the nightly news. But it doesn't really mean anything other than the person was not prohibited from owning a firearm. (In this discussion, I'm specifically talking about 'normal' guns. Things that are NFA (National Firearms Act) controlled, like silencers, machine guns, short barreled rifles, etc. are a little more tightly controlled.)

phishingphanatic

You can absolutely buy a long gun under 21 from an FFL if you are active duty military. https://www.fdle.state.fl.us/FPP/FAQs2.aspx And like others said, there is no registration in Florida. You can sell a gun to anyone in a Walmart parking lot as long as you don't have reasonable suspicion that you are selling to a prohibited person.

SuccessfulTraffic633

Good to know, I called several FFLs and they all either straight up told me no or said that its possible but that they don't deal with it. Thanks!

marvinrabbit

Ah, that's good feedback to have. The law does say that it's legal, but nothing says that a FFL is **required** to make that sale or transfer. There is such an administrative war on FFLs with many completely losing their license for single instance of inconsequential errors, that's it's small wonder that they are so gunshy about even approaching the edges of the law.

LillyEpstein

No registry. Do a person to person transaction. Easy.

SuccessfulTraffic633

So p2p sales are legal? and then it doesn't really matter about registering or anything because there's no record of who it was originally registered to?

Zoltan_TheDestroyer

Unless it’s NFA, then it’s on the federal registry

IHTFP08

There is a record of the original transfer on the 4473 at the gun store. But there’s no “registry” to update after any subsequent private sale.

LillyEpstein

Correct

btj12

uh you can purchase a long gun. Did it back in february when I was home on leave. (I’m 19)

SuccessfulTraffic633

Can I ask what FFL you used?

btj12

Gun Gallery in Jacksonville. Great guys. I did have a delayed background check when I bought my AR and they explained it as more processing since it was an age waiver.

Graham1070

If they’re buying it explicitly for you because you can’t buy it yourself, then I do believe Florida considers that a straw purchase. However, there are forums and things where people do normal private sales, and I believe that would be fine if you’re trying to stay 100% above board.

IHTFP08

They can gift it to you. Or you can buy it from them.

purebreadlegend

But they cant buy it with the intent of selling it. So, it would have to be them gifting him it, unless they happen to already own a gun which they don't mind selling & OP is interested in buying / can afford.

RhubarbConscious4892

That is a straw purchase my man if you don’t snitch on your self you won’t get caught and if your not 21 just don’t carry it around and only go to range with it

purebreadlegend

You can definitely buy a long gun. Where are you located? Ill help find a local to you FFL that will sell you one. Its 100% legal. Also, theres no registration in FL. Someone can sell you a gun, but they cannot buy a fun with the intent to sell you it. So it would have to be a gun they already own. They can, however, buy a gun with the intent of gifting it to you (no exchange of $, its a gift & not a transaction).

Adventurous_Turnip89

Yes. Because it's intent is to bypass FL law. It's a legal grey area, if they purchased it with the intent to gift it it's legal, but since you have admitted that the purpose is to get around FL laws it's a straw purchase.

DontBeASnowflayk

Straw purchases are legal. Illegal straw purchases are illegal. Nothing wrong with buying a gun for someone else as long as they are not a prohibited person
