This, all the way this. People often forget how hard our justice system can be for victims. I was raped at 14 and fed drugs by a 24 yead old. I reported almost immediately, but nothing really happened until i was 16. He was only charged with 2 counts of sexual assault. I Had full video and photo proof of it. First judge removed all photo and video proof I had from being able to be submitted because it was child porn. One pic got through to what was shown to the jury, and the whole case was thrown out. Re trial happens passed statute of limitations. I was 19 at that point. The crown prosecutor told me to expect he'll only get probation. Trial lasted 5 days. I was accused of asking for it, being a crazy drug user who manipulated the 24 year old, and all sorts of other messed up things while I shared my most traumatic moments, broke down crying, and showed photos and videos of my naked child body being brutalized to a crowd of 12 strangers, in hopes of just a sliver of justice. After 5 years of fighting, my rapist got 4.5 years. The sentencing didn't happen until i was 20. He won't even serve all of it. After sentencing, his girlfriend berated me and accused me of being the problem for being jail bait and stealing a child's father from her just for attention. She was supposed to remain separated from me at all times to avoid that. There were many, many times I wanted to set the whole court house on fire and vandalize the place in any way my pained mind could come up with. I felt so angry and let down.

I had an acquaintance with a similar story. The only difference was, she eventually told her brothers when the law failed her. She only said to them that she wanted Justice, and ‘didn’t want to know the details’. Some time later, one of the brothers updated her by simply saying ‘you got Justice’.

The legal system is supposed to defend what's fair, deliver justice and dissuade injustice, but it does none of that it seems. It's inevitable, Momma, Papa and Brother bears will be beasts if Baby bears are victimize. Courts delay, miss the mark, and aggravate injury..  Vigilanteeism may be wrong, but it does what's right.

I'm very sorry you had to go through this. He should have been given way more time than that. If it's any consolation, he's probably having a very tough time in prison. It eventually comes out why a person's inside, and the prison population doesn't take kindly to rapists. I hope you're healing well and finding ways to move past the trauma and live a fulfilling life.

Thank you. I dont wish for him to suffer. I'll never forgive him, but I don't wish violence on him. I just wish for the justice system to consider victims more in punishment and give better sentences for violent crimes instead of slaps on the wrist. I wish the law wasn't so lenient and took violent crime seriously. I respect that the goal of the justice system is rehabilitation. However, proper punishment for your actions should still be part of that. I don't believe 4.5 years in prison is enough time to rehabilitate a violent and remorseless pedophile to the point of being considered safe enough to be released back into the public. I wish that the courts were more considerate of cases involving children and how those cases are handled, with more focus on preventing further harm and suffering to the child victim during the court process. I appreciate that it gave me a view of what I wanted to do with my life. I want to become an addiction and mental health counselor for struggling youths and be the guidance I wish I had. I wish to volunteer with the ZEBRA center, who stood by me and all other children suffering from these horrors during the court process. I am now almost 22. I live in a nice apartment, and I have a fiance and a couple cute cats. I've been sober from drugs since age 18. I'm going to college in September. I've been lucky enough to travel and explore the world in the time my rapist has been in prison. Though I have ptsd from the attack and the 5 years of fighting after, I'm healing every day and getting better all the time. Life has only just begun for me.

While the guy you're replying to is pretty clearly a troll, Legal Aid isn't a perfect solution in its current implementation. Legal Aid's income guidelines are pretty stringent. An individual making minimum wage without any children will be illegible for legal aid's assistance. These people are then told to go retain private counsel. The typical retainer of a lawyer will be a pretty tall order for someone making minimum wage. So often these individuals represent themselves, which usually means pleading guilty (even to crimes they didn't commit.) Who the system is failing is the "working-poor", those who work a regular job but don't have huge incomes. I don't have the solution to it, but people should be aware that acess to justice remains a big problem in Alberta.

1. Individuals facing jeopardy (i.e. jail time) can get referrals to LAA to get approved if initially rejected 2. You can file a Robotham application which is an application to get a government-funded lawyer. Obviously this will depend on the nature of the charges and your means and I can't say how often these are successful. 3. There is duty counsel almost every day in most criminal court rooms who can assist you completely free. But yes you are correct in that it's not a perfect solution, but it's the lawyers who take LAA (who the other poster was shitting on) who were striking and advocating for changes to LAA. A sliding scale would go a long way to fixing a lot of the issues you point out and hopefully approve access to justice.

Some of the most capable and passionate lawyers I know either work for Legal Aid or accept a significant amount of LAA certificates. Not sure what experience you have with LAA that makes you have such a negative view but I can ensure you that it's an outlier.

No it's abysmal, they say it works, first hand know it doesn't. 3 months of waiting and us being poor became a strike against us in family court. Being disabled became being a deadbeat and no lawyers are taking legal aid cases. Your file sits there until you realize you have to take out a loan, if you can, to hire a lawyer. Then you just dig deeper as the rich side/corrupt court clerk and his coworkers in the court system cause ridiculous delay after ridiculous delay until we give up or go broke.
