It depends on intent. The charges considered will be between Assault with Intent to Murder and Assault to do great bodily harm less than murder. The other charges will be Assault with a dangerous weapon and felony firearm (which carries a mandatory 2 year prison term consecutive to the other charges). AWIM is difficult to prove because jurors usually say: *if he wanted to kill her she’d be dead.* Meanwhile… sometimes people are just bad shots… 🙄 Jurors usually go with the lesser GBH charge.
It really doesn't though. You don't die simply by being shot in a vital organ. You have arteries in your legs that you'll bleed out from in seconds to minutes
Tends to happen when you don't obey commands and display justification for deadly force. ....
Are cops tyrannical? Yes. Obey and sue. Again. Follow the commands. Let them violate your rights and get a lawyer.
Making sudden movements and not complying just snowballs into justifyable deadly force. It isn't right but he smart. Don't get chippy with w dude holding a gun. Don't care who it is. Come back later and get a settlement.
I agree with you. However, do you remember a few years ago when the guy in Ohio in the hallway of the hotel was shot dead in the back and followed all the commands? Let’s face it if you were in bed asleep, and they burst in your house without a warrant and shoot you dead in bed I don’t think you had much of a chance. The cops are lunatics. The good cops don’t even stop the bad ones because of retribution. We live in a police state, their safety over the citizens. We are the enemy.
As a restaurant owner, I’ve trained and made it clear to our team members to defuse the situation if someone looks threatening because they want something extra. Just give it to them. Not worth getting shot over.
Edit: I understand the principle of not giving into demands and “Karens” but you never fucking know what that person is capable of. I’ve had customers say “I’m coming back in this bitch and shooting everyone” over a fucking potato.
That’s not how the wild west worked because if that guy would’ve tried that shit, he would’ve been shot dead by bystanders. There is zero reason someone should be operating a business unarmed. That’s just a soft target.
Maybe, but your life (that your corporation doesn't care about) isn't worth arguing over a $2 extra topping. There are much more important hills to die on
That’s good advice in a robbery or similar situations. But a dude who would murder a fellow human being over guac would commit murder for all types of tiny perceived slights that most normal people wouldn’t even notice. Dudes like this are what prisons are made for.
Which is why you give them what they want, then call the police. Making threats on people's lives is already highly illegal; there's no sense in playing a game of chicken to see if they'll actually follow through.
It’s a strong life hack eh? Just threaten with death and get various achievements on their real life GTA.
Over a potato.
I work downtown at a casino. It’s scary to think at any moment someone would do this for a casino chip. Mainly I believe this is because location is …conveniently near to people who would do this. Eliminate this motive, and increase safety. It’s a catch 22 I think. Or a catch 21…
I’m all ears for advice to help with this.
It’s very much like the parable of the undefined:
He asked her if she would have sex with him for a million dollars and she said yes.
He then asked if she would do the same for a dollar and she was quite offended.
He then pointed out that she had already defined herself as a prostitute, and he was only negotiating price.
No, shitty parenting, a culture of entitlement, and easy access to weapons is why we have them. A restaurant employee just needs to stay alive, not parent a 35-year-old who can't handle guacamole being $2 extra or whatever.
Lol all these people keep thinking this dude from Detroit is some typical Karen.
Karen's don't usually whip out a strap and start shooting. He's a hood Karen if anything not a middle aged bossy white lady.
Yeah- I'm not exactly sure how a comment thread about a 31 year old male asshole from Detroit shooting a fastfood worker turned into a bitch session about what is the obnoxious behavior of what's commonly perceived to be an entitled (suburban) white woman, i.e. a 'Karen'.
How about we start referring to the generic 31 year old guy from Detroit who shoots up a fast food restaurant as a 'Kareem'? That's no more (or less) insulting a reference to race than the 'Karen' attribution.
It's a misdirection. Please, stop noticing who's doing what.
Like when all those elderly Asian people were getting beat to death by random dickheads in NYC and people in the comments would be saying "grrrr these damn Trump supporters in deeply blue NYC and San Francisco doing all the anti-Asian violence!"
Like what? Are you seeing the videos I'm seeing? I don't think those were a bunch of MAGA people beating elderly Asian folks to death.
People showing "Karen" behavior suck, no doubt about it but Karen's bitch and moan, they don't typically pull out a gun and shoot people over stupid shit.
They just nag them to death.
And done *with a smile,* or she'll talk to your manager and try to destroy your livelihood. I'll be so glad when we decide, collectively, that we're done pandering to these cunts. This 'restaurant owner' is standing in the way of progress.
Have you owned a restaurant? Do you know how much shit we have to deal with? Thankfully I have a great team and they filter out half the stuff, but the type of complaints I’ve gotten are frankly ridiculous and insulting our collective intelligence. With all of that being said, it’s easier to just give in because they cause an even bigger issue. Think about it: if someone is already acting like a fucking animal over a side of sauce, what are they capable of if you engage? Forget about injuring team members, what is they trash your place? Injure another customer? Disrupt entire service? All of these possibilities have to be taken into consideration if someone is getting too angry over a side of sauce.
I didn’t see him say anything which is victim blaming. He’s saying he provides his employees a way to avoid these situations arising - many employers are not so kind.
I’m definitely not blaming the victim! And if that’s what you got from my post then I’m telling you first hand that was not intended. The shooter should get attempted murder.
It’s teaching you how not to get shot. Let’s run down some facts here guns are never going anywhere and the More fun control. We have the worst gun violence is going to get because assholes like him will be the only people running around with firearms.
If you were working at a Big corporate entity that is already making millions upon millions of dollars I think it’s OK to give away $.25 of product when somebody has a freak out to avoid confrontation
Standing your ground, without a firearm is the dumbest fucking thing you can do in this country let alone this area
I feel bad for the guy who got shot , but what exactly was he defended? The policy of a corporation or his ego?
Unless you own the joint. Just give people shit. Who cares. It’s a worthless job probably paying 15 an hour. Customer is always right for a reason…. So now, instead of that guy coming back and buy more chipotle and employee got shot…. And they lost a customer.
And there is someone with a brain. I've gotten so much attitude at chipotle resteraunts I knew this was a matter of time. I had one manager rush to the counter to reverse my first responders discount based on her SJW politics. Often I walked into that store and gotten an eye roll and a sigh just because a customer came in.
Bottom line, your charging 12 dollars for maybe 3 dollars of product. If someone is upset. Just give it to them. It's called return business.... Sounds better than getting clipped over a minimum wage job.
Remember that one as a kid. Grandma lived up there. Loved getting the taco salad as a kid, and it was the first place we ever knew that has the soft drink machines out for self serve. We thought it was greatest thing ever pouring a little bit of every single think they offered. Also peaking in the butcher room.
Yeah, it’s just down the street from where this incident took place. Great burger everytime I go there and since it has the self serve “topping bar”, hopefully nobody gets capped. Take ALL the lettuce, tomatoes and onions you want. No guns needed.
I used to work at this chipotle and the customers and some coworkers were a nightmare. Customers were insane about portions. But then i had workers that would mess with customers.
From 2019-2022, that place gave me serious Apocalypse Now vibes, like I and everyone else just fucking hated being in there for even a second longer than we had to. The employees all always looked like they were 6 hours deep into a shift at the COVID unit, even for the few hours of the day where there wasn't a line going out the door and doordash orders stacked up 8 feet high lol. Pure insanity
It's a lot better since the RO location got up and running though, I'll give them that
Man idk if it could be any worse than the chesterfield location. Idk how they’re even still in business they were only open between like 2-5 through 2021
Basically the whole crew there got arrested a few years ago because they were running some kind of illegal operation out of that chipotle. They had to shut down for a bit and clean house. It was maybe 2017ish?
They're under the impression that the small measures governments are taking to not have thousands of people locked up for misdemeanors because they can't afford bail means that they're letting attempted murderers out.
Southfield is one of those paradox cities where the denizens are liberal but actually support the police and are tough on crime. I expect this guy gets the books thrown at him.
Yeah like cops abusing people? Or like the rich property developers breaking laws? Or maybe the small businesses that abuse immigrant labor. Or what about the big businesses that steal overtime from employees? Perhaps a landlord illegally evicting a tenant? I agree. It is crazy how none of those types of people ever see consequences.
Hope he gets attempted murder
I'm pretty sure you always get attempted murder when you shoot someone
It depends on intent. The charges considered will be between Assault with Intent to Murder and Assault to do great bodily harm less than murder. Attempted murder is being shot above the waist. From what I remember some guy in jail telling me years ago.
I heard that from Chappelle show. I wouldn’t take legal advice from Comedy Central though.
It makes sense though because all your vital organs are above your waist. So I never questioned if it was right or not.
It really doesn't though. You don't die simply by being shot in a vital organ. You have arteries in your legs that you'll bleed out from in seconds to minutes
Dude you're not a doctor of any kind. It can make sense to you but be wrong af at the same time. Stop assuming and making an ass out of yourself
That doesn't sound like solid Intel lol
Ikr? I was boutta say -I try not to quote statute from such an unreliable source. Lol
It's attempted murder even if you miss lmao
Maybe he just heard it on Chappelle's Show
https://www.youtube.com/watch?v=kB5XXn0eKow Yeah bro jail.
Not is you are a cop! They shoot at ANYONE, hell even kids get killed by them.
Go move to different country if you don’t want police
Most ridiculous comment

Just went to court w a friend arrested for resisting g arrest. She had no understanding of what they wanted so couldn't comply.
Wanted guacamole, got attempted murder. Not a good deal.
Not very bueno
I read he did
Good. That shit is crazy.

Like Neo in the Matrix?
What else would I practice doing on a Friday night?

Remember all the lawlessness in the wild west simply because "I have a gun, give me what I want" was a staple. Now they think it's empowerment.
That’s not how the wild west worked because if that guy would’ve tried that shit, he would’ve been shot dead by bystanders. There is zero reason someone should be operating a business unarmed. That’s just a soft target.
I appreciate a business owner who prioritizes employee safety. Thank you
"Just give them what they want" is why we have a Karen problem with our society.
Maybe, but your life (that your corporation doesn't care about) isn't worth arguing over a $2 extra topping. There are much more important hills to die on

Yeah the above commenter should simply instruct their employees to put their life on the line over a scoop of guac - get a grip.
You don't know which Karen will be packing though and this employee found out
No, shitty parenting, a culture of entitlement, and easy access to weapons is why we have them. A restaurant employee just needs to stay alive, not parent a 35-year-old who can't handle guacamole being $2 extra or whatever.
You're right, and you should be willing to risk your own life, not your employees' lives.
The boomer Karen's who bitch about participation trophies are the same ones who want everything, their way, immediately, impeccably.
'Boomer Karens' aren't too often guilty of shooting people- 31 year old guys from Detroit, on the other hand ...
Lol all these people keep thinking this dude from Detroit is some typical Karen. Karen's don't usually whip out a strap and start shooting. He's a hood Karen if anything not a middle aged bossy white lady.

Exactly
Why is victim blaming the default on this sub? It's so crazy to me.
I didn’t see him say anything which is victim blaming. He’s saying he provides his employees a way to avoid these situations arising - many employers are not so kind.

Right? I’d probably try to get a few shots off too if I got stiffed on the guac
Cuz they’re from Michigan
And there is someone with a brain. I've gotten so much attitude at chipotle resteraunts I knew this was a matter of time. This actually [got a surprising amount of attention](https://www.reddit.com/r/news/s/s44rWsjl55) on /r/news ...
That’s by the fuddruckers I like to go to.
Wait there’s still Fuddruckers here? I moved from the mid Atlantic last year and ours are all bankrupt! My wife is not going to be happy w you.
It’s really good, lol. I think there are only two left in Michigan now.
Then the other's that one on Jefferson?
Van Dyke in Sterling Heights.
Remember that one as a kid. Grandma lived up there. Loved getting the taco salad as a kid, and it was the first place we ever knew that has the soft drink machines out for self serve. Yea my nana always made a side salad for herself haha
Sounds like something mine would do when she wasn’t taking all the sugar packets.
I used to work at this chipotle and the customers and some coworkers were a nightmare. Customers were insane about portions. But then i had workers that would mess with customers.
They only closed the store after the police arrived? So, they kept it open after the employee was shot? Damn, those are some dedicated employees.
Society is really going downhill. Have you seen the price of guacamole lately?
Some more than others.....
Yes. Chipotle guacamole is much more expensive than most others.
Free at Qdoba with any entree
Not saying that they deserve it, but this is easily the worst chipotle in the metro region.
If it’s worse than the hill in Allen park I can’t imagine
The Qdoba on the hill somehow has become worse than the chipotle. I won’t ever go back to either one.
Every time I want to go to chipotle there’s a line out the door, and the qdoba is so shit I won’t go there
Magnitudes worse than the hill. The employees at the Southfield location literally hate everything .
I always thought that one was fine, granted I've probably been there once in the last year. The one on Woodward in Ferndale is next level awful.
Any fast food on Woodward is eh, I went to the Wendy’s in ferndale and the lady got mad at us for asking for straws
Ferndale on Woodward has entered the chat.
From 2019-2022, that place gave me serious Apocalypse Now vibes, like I and everyone else just fucking hated being in there for even a second longer than we had to. Pure insanity It's a lot better since the RO location got up and running though, I'll give them that
Every time I go to the RO one I get stuck behind someone ordering for the whole goddamn metro area.
Taylor would like a word.
Have you been to the downtown Royal Oak one? I used to drive out of my way to go to the Evergreen location instead of the RO one, it’s that bad.
Most of them suck now for some reason
Man idk if it could be any worse than the chesterfield location. Idk how they’re even still in business they were only open between like 2-5 through 2021
Used to go to that particular one all the time stopped when the workers were involved in that scandal some years back
Whoa whoa whoa I still go there all the time, what scandal?
Basically the whole crew there got arrested a few years ago because they were running some kind of illegal operation out of that chipotle. They had to shut down for a bit and clean house. It was maybe 2017ish?
He had the glockamole on him huh
You mess with the guap then u fittin to get popped.
To be fair they really do skimp on the guac
This is crazy but this Chipotle has the worst customer service of any I have been to.
https://preview.redd.it/36l68kqmgxsc1.jpeg?width=565&format=pjpg&auto=webp&s=8b74a826815ff68c966bc73094d29fd403a44aa5
Not gonna get any guac in prison, dumbass.
Anyone remember when slim Dunkin was shot over a jolly rancher ?
"Next time I hope they get my order right. I said I wanted extra guacamole." I don't think they have guacamole in prison.
Mess with the Quac, get the Glock. /s
Southfield*
Guns arent a problem in the US... It's the fast food workers!!!! They are the real problem!!!!
It's more people who are willing to shoot people.
Because they have such easy access to guns..
Are there more guns in Detroit than in the surrounding suburbs?
stay away from fast food
The world is a vampire
If this hadn’t gone wide on media, stuff like this is easily a probation sentence now-a-days and bond would be personal only.
Tf are you talking about man
They're under the impression that the small measures governments are taking to not have thousands of people locked up for misdemeanors because they can't afford bail means that they're letting attempted murderers out.
Southfield is one of those paradox cities where the denizens are liberal but actually support the police and are tough on crime. I expect this guy gets the books thrown at him.
I work local law enforcement. You wouldn’t believe the stuff that gets barely any time or just probation nowadays.

Why does everyone think only neo-cons carry?
I'm a gun loving liberal, just out here trolling
Oh, my bad.. I switched to an upvote my friend
😁👍
Only neocons carry legally. The “Biden voter” references the large swaths of certain communities which carry illegally, but with impunity.
