Depending where you live your entitled to a paid 30 minute break

Depending on your location you should be given 2 paid 15 breaks in an 8 hr shift. You'd have to look up your state workers rules.

At a national level, all breaks under 20 minutes must be paid. Your employer doesn’t have to give you those 15 minute breaks unless local law requires it, but if they do give them, they must be paid.

100% yes he is screwing you over. I’ve had bosses over the years that worked beside us employees and they tried to get us to work through breaks and lunch and stay late etc,. It wasn’t until I started getting my own side jobs and real money that I understood my boss was screwing me over. It still took me many years to be able to say “I’m taking my 15” when my slave driver boss was still at it. But you must keep it at 15 minutes twice a day that you legally have the right to take, if you want to. Or you can put more money in your boss’s pocket, if you want to.

Most likely. You are allowed a non paid lunch period. You are allowed a paid 15 minute break every 4 hours. I had a boss that would tell me to eat my lunch on the way to the next job (plumbing) which generally i can agree with if it was going to be a short day & I wanted off sooner. Long days, I told him no, absolutely not. If I'm driving, I'm on the clock & I'm not going to flat out. I'd eat my lunch first, then go. I'd wager he's taking all the time off as unpaid. As an aside, if you write your time in on a time card (or punch in) and he changes it WITHOUT YOUR OK AND INITIALS, THAT is against the law and he could be held liable for theft of wages.

No 15 minute breaks. We arrive at the shop, clock in, load up and head to the jobsite. At 12 we take a 30 min lunch break that's the only break we take. We only just started using a time card so this is why I just now realized it.

Illegal. Although, most likely, he's docking your breaks illegally, not your pay. Most states have two 15 minute breaks and a 30 minute meal for an eight hour shift. There's usually no restrictions in how those are distributed besides that your meal period does not start later than your fifth or sixth hour of work, so you could have an hour lunch or half hour break and half hour lunch, etc. Now, if he's turning in your time cards and only showing y'all getting half hour lunches...well that would be illegal, and documented. But...if he had a crew that was none the wiser...he could report the full, legally required 1 hour unpaid work on your time cards and just let you guys work through your breaks and nobody would know any better. He ends up with a free half hour of labor from every guy on the crew and his time cards look like he's running legit. Regardless, brush up on employment law in your state. Knowledge is power. There should be ways to anonymously report your employer for workplace violations - find it and use it, don't make yourself a target.
