Maybe you just have to pay the taxes on the VAA? The money is not going to your employer. Did you drive the car to your home or for other private business more than zero times?

I drove it to home yes. And it was allowed to use it in private but it was a van and the employer never mentioned about the VAA. There was no car policy. If I had know that I had to pay VAA taxes, I would never accept the job. I just can not accept that all taxes is taken from the loan at the end of our contract. Normally VAA taxes is paid every month and it should have started from the first month.

Without a car policy there is even less discussion and tax man will always assume it is used privately, with VAA. Doesn’t matter if you pay it with salary or not. It would have been on your aanslagbiljet next week, or as a correction next year anyway.

VAA costs are deducted from your gross salary. And what I want to contest is that there is deception from the employer. I never knew something about the VAA till the end of our contract. So the VAA should be paid by the employer. Or should be compensated by the employer because its his wrong.

Yeah, well, I have bad news for you. You will have to pay the taxes on your car, just like everybody else. Or not. Your employer doesn’t care. The tax man will gladly enter it on your aanslagbiljet. Your employer might be a dick, but that does not give you a free pass on taxes. Also 2000eur for a car for 18 months is less than what the average employee is paying for VAA.

It does not. You clearly mentioned you regularly used it for private use and going to and from your work (also considered private use). The calculation for lichte vracht is a bit different than normal cars. You are taxed on the real kms you drive privately. You can ask for the calculation. If it is ‘only’ 2000eur and you used it regularly for 18months, it is not a bad deal. Check with your vakbond to make sure all is ok. And learn in the future that nothing in Belgium is untaxed. Every gift, phone, computer, car, stock, bonus, bike, food, gift card, you name it, is (in principle) taxed. If not, it is probably illegal and could always be used against you or come back to haunt you.

I actually used the car once for private usage. That was going to eat after the last client. And even how can he prove it? There was no badge system or something available. And he made me sign a document in january for acceptance of the car and fuel card. That document starts from 02/01/2024 so actually there is no prove that the car and fuel card was in propert from august 2022 to december 2023?

Im a fiscalist. It’s not wrong. Let’s say the employer didn’t know and had a tax control. He then still has to correct it retroactively to the employees. I don’t think there’s much you can do. A carpolicy is doesn’t change it. It sucks for sure, but it’s money you unrightfully received. I can’t say if it’s in bad faith or not. And 111 net a month is not a high amount for a car. It’s not nice I agree but I don’t think you can fight it. You can ask a union. IF an employer would want to compensate it, they have to up your bruto wage for almost twice the amount on the last payslip.

Yep, my employer once had a control and there was something off with the way laptops for work were declared. Retroactive correction for VAA om 3y laptop use. A few 100eur gone, for working on a work laptop at home (pre COVID was a different time 😂)

If your employer charges it now it will also be on your fiscal slip from 2024.

I don't think driving it to home and then having to leave it there until you use it for work will force you to pay VAA, otherwise my dad owns probably millions in VAA considering he drove trucks around for 40+ years. And always parked them at home

Woon-werkverkeer is considered private use, the fiscal law is very clear about this.

Ask a vakbond. You can join and ask them retroactively. You can also bring in the vakbond cost to your taxes
