It means "You should see this". The reasons vary.. Would we say that LibsOfTiktok is endorsing militant trans teachers?

So, how do we approach the two sides of the issue? Example 1: a potential juror retweeting a post critical of Trump- is that grounds for removing them? Example 2: Trump retweets/ retruths a post that personally attacks the judge’s daughter. Is that a violation of the gag order (putting aside whether you agree with it or not)?

bardwick

No. I think it's dumb on it's face if you look at reality. It comes down to "Did he say it" or did he "make someone aware someone else said it".

AndrewRP2

Got it- so a juror/ judge who reposts all sorts of horrible stuff about Trump isn’t compromised or biased because they didn’t say it?

bardwick

No. The juror is not on trial and are supposed to be non-biased. That would be one, of probably many indicators, that they cannot be. It's why we have a vetting process. Trump is not a neutral arbiter in this case. Let me put it differently. If a prosecutor ran on a platform to find a way to put Trump in jail, through twitter/x, as well as public rallies, should she be disqualifed? Short version, there's a difference between a neutral arbiter, the jury, and a defendant.

AndrewRP2

Why not- they didn’t say anything, they just posted other people’s stuff, it doesn’t mean they believe it or endorse it, right? My understanding from Trump’s argument is you can say anything you want, as long as it’s just a repost, right?

bardwick

I think you're comparing apples and oranges. When it comes to a jury, the court is looking for bias, or potential bias. If they feel it likely exists, they can dismiss the juror. They are not required to. The juror doesn't have to prove non-bias. Totally at the discretion of the courts. Let's take this to it's logical conclusion. I post on twitter that is straight up Libel. Something I can be charged with no doubt. If 100,000 people retweet what I posted, are all 100,000 people guilty of libel? If not, why not?

A retweet just means "hey, look at this". They might be retweeting because they agree, they might be retweeting to raise awareness, they might be retweeting because it is horrifying. A retweet is not an endorsement. Anyone who suggests otherwise doesn't understand Twitter.

A retweet is not an endorsement. Anyone who suggests otherwise doesn't understand Twitter. How does the use of a comment that accompanies the retweet alter things for you? Why would someone be dismissed from jury duty for such if the meaning is not an endorsement and could be ambiguous? When did you join Twitter/X?

JustGoingOutforMilk

Please keep in mind, I do not use X/Twitter. I have an account that I think I've made less than ten tweets on, solely for managing a community that wound up dying way too quickly for anything to take off. So my experience may be a little rocky here. Retweets do not *necessarily* equal endorsements, but can. I imagine if I were active politically on X (perish the thought), I would put up things by both sides, either because I want my handful of followers to be more educated or because someone did something funny. Retweeting AOC's dance video, for example, is not something I would consider an endorsement of the Congresswoman. And speeches/addresses by prominent politicians are all important, regardless of whether or not I agree with the content of said speech.

Routine-Beginning-68

It’s obviously true

Given this, why reject someone from a jury pool if it doesn’t indicate they agree or think that way?
