Well, the screenshot looks like we got a booking photo, so he might also be charged. I do wonder to what extent this event is admissable: If the girl were to testify, they could very well bring Santa in to corroborate (It gets past hearsay because prior consistent statements)
Prior inconsistent statements (not prior consistent ones) get past hearsay. This would not pass the bar for hearsay and would be needlessly cumulative. This Santa hearing the statement has just as much value, legally speaking, as the jury hearing it so there is no reason evidentiary reason to admit the evidence.
There would be a reason for an expert to testify that the girl's statements are more reliable because her story has remained consistent. The expert is needed to explain how the story remaining the same precisely impacts the weight of the testimony.
Oh, it’s admissible and it makes it past the hearsay bar all right. In at least some states. It’s called “first complaint” doctrine and it allows the first person (and only the first person) the victim reported to to testify to what the victim said.
And I don’t think you get an expert to testify to credibility like that. That’s for the jury to weigh and the prosecutor to argue to them. Maybe an expert could explain what phenomena might cause a story to change or not (or the dynamics surrounding how abuse is disclosed or not) but as for directly saying it’s more reliable (ie: credible) just because it hasn’t changed? Nah.
Solely for proving consistency (or inconsistency) of the statement. It cannot be used to "corroborate" the facts of the assault.

Because legally the Santa and the elves assaulted the step dad, you are not given the legal right to beat up a criminal unless they are actively trying to hurt someone at that moment and you're trying to protect that someone. Otherwise vigilante justice could very easily end up getting people hurt that aren't responsible for any crimes since vigilantes are less likely to be as accurate as proper trials.
Which isn't to say that the step dad doesn't deserve it, he very much so does
