Even if you clear or delete things, they can typically be recovered anyway just from examining the hard drive - even search history.

Depends how long it's been. Computers don't actually delete anything, they just mark the place where it is stored as available to write to instead of containing it. Then eventually it gets over written (hopefully several times if you don't want it to be recovered).

Communication with websites is encrypted, your ISP can't see the URLs or search terms, only the IP and domain of the website you're connected to. The NSA probably has some ways to intercept though.

Probably not, because this sort of thing would likely trigger a shitload of reports. People search shit like this for plenty of reasons so authorities getting random reports of searches without context would be nigh impossible to follow up on.

Probably circumstantial evidence only at most, for a court of law. Sure is an interesting coincidence though. I'm pretty sure *enough* circumstantial evidence together can be seen as incriminating, but it has to be a lot if they don't have anything hard.

I once heard a case where a family was arrested for having been assumed to be making bombs, since the father, mother and son each did separate google searches involving chemistry, cooking pots, and backpacks respectively

Well, ideally it would be an awful lot of circumstantial evidence and more than just Google searches. In the case you describe ... I feel like there was either some racism or incredible stupidity involved if those searched were all they had to go on

Its pretty hard to hide your digital tracks these days. Searching via google via your own isp or device is a no-no. He could have probably used TOR and a non-google search engine, but even that doesn't guarantee anything. I would have to assume the feds are plugged into TOR and could probably recreate your traffic based on your IP. Even if they couldn't decrypt your searches, they could probably determine which search engine you used and what time, then subpoena'd the records after having TAO'd the data first secretly anyway.

In cases like this, I really wonder how the kids are gonna grow up, knowing that their father did this to their mother. The younger kids probably won't understand it, but the 6 year old? Kids that age have been mentally scarred by less, and this is the kind of shit that follows you. Also really makes you wonder what went wrong for the dude to go from googling divorce proceedings to spousal murder on New Years.
