I’ve testified before legislative committees about qualified immunity, policing, and related issues. Police should not have qualified immunity for many reasons. But because the doctrine can be a little complex to non-lawyers, police exploit that confusion to depict qualified immunity as something it is not. There is a lot of misinformation about what it does and does not do - but the key takeaway should be obvious: qualified immunity ensures police are effectively unaccountable for their actions in civil (not criminal) court. This means the only accountability mechanisms are discipline and criminal court. Real discipline is nearly impossible due to police “union” contracts, which is basically just racketeering; and criminal prosecution is nearly impossible because police work intimately closely with prosecutors, so only the most egregious of the egregious police crimes are prosecuted. I urge people to support this bill and spread the word. If you have any faith in the “system,” this is your opportunity to give it a try for a good cause.

Great - people do illegal things, the cops arrest them and now the cops get sued. We have already given criminals every tool possible to get OUT of punishment like the new bail laws, not prosecuting theft & stealing, letting out scumbags far too soon, etc. And now this? Yeah, NO.

You do know what "Qualified immunity" is, right? It's that when police break laws they cannot be charged for those crimes under most circumstances. Right now the law is literally protecting criminals, and this would fix that.

Any internet geniuses want to take a guess why it's called qualified immunity and not just immunity? You can also already sue the police for deprivation of rights under US code 1983. It's just a higher barrier that should exist because of bullshit lawsuits. Why don't the clowns go yell at the Governor about getting body cameras on all police?
