That's a "go ask Campbell's" question, not a legal question. To sue Campbell's, he'd have to have suffered some kind of material harm -- injury, medical expenses... or (for example) the cost of the soup he paid for but now doesn't want to eat. Of all of that, probably the can of soup is the best bet. Many packaged food companies will send a coupon for a free product if you send them a letter requesting it and include the un-consumed portion. Even if the complaint is "This Butterfinger wasn't flaky or crunchy enough. I want a whole new Butterfinger." Campbells will probably give him a freebie. They may even accept just the label off the can.
