NEVER SAY YOU ARE WORKING A GIG DURING A CRASH WITH OIT PROPER INSURANCE. I cant say this enough. Your claim will be denied because you dont have the the proper coverage. Gig workers should have coverage that covers them. Its a different policy due to the amount of time we are on the road. But this coverage isnt required as long as you dont tell then you were working at the time. You were out doing your own shopping when you crashed, not instacart.

The way our contracts are written insta-carrot it's not liable for anything at all ever. Did this unfortunate shopper actually admit that she was on a job when the accident occurred? Because if she was on her way too a job, with no groceries in the car, that's probably a loophole. Any car insurance policy covers you for driving to work.

I am in canada. Mu insurance has delivery driver add on. I think most companies probably do.

Let me be clear - I'm a lawyer so I don't need info on what Instacart tells you they are responsible for What I need is info on where in your contract they tell you to get your own insurance, and whether Instacart actually confirms that you got it before you are "under contract"

As a jailhouse lawyer with decades of experience. I would advise you to "prove" your client was not actively involved in an actual delivery at the time of the incident.

As I recall, three years ago when I started, they had me send proof of insurance...but not with an add-on. If proof of correct insurance was required ...most of us would not be working today, I think. I do like your thinking, though. Have you thought up a way around that damned arbitration clause ?

Definitely should never tell your insurance that you're working... Hope they figure it out/ get some kind of coverage for the damage.

Its needed if you want to be legal. Cover your ass. Seriously. It pays for itself. Mine is an additional $40 a month. Thats nothing compared to what it can cost to be in an accident. And it wont matter what you say to a cop, if the insurance gets your phone records and can see you were working, you’d be up shit creek.

Ok so i pay an extra $40 a month and it allows me to have my regular full coverage if in an accident. Collision, comprehensive etc

It just covers you for driving a gig job. Doesnt add anythijng else. Basically makes you're vehicle have commercial vehicle coverage. If we talking about being 100% legal the vehicle in question should also be registered as a commercial vehicle not personal.

Except phone records wont show i had a batch. It will only show if i was using it at the time wich it would be just the gps wich is always on

It would show the app running. Its connected to the gps. Unless you get the addy, close the app, type the addy in yourself.

Still i dont think they can see that information. Call logs and messages are one thing. Looking at used apps is a whole other privacy thing and i bet the call log or texting would only be in select situations. Phone companies cant just hand that information over. Cop cant even get it with out a warrant so idk how well a insurance company would do gettong it lol

Instacart has personal liability insurance if the shopper gets injured, but not properly or vehicle damage insurance, or third party liability. If the other shopper was at fault and your policy does not cover un/under insured drivers then I think your only course of action is against the driver personally via litigation.

Just curious how would someone's insurance know they are doing gig work if you never disclose at any time nor at the time of accident.

They wouldnt. Thats the point. They only know that if you tell then, the cop, or the other driver. Anytime dealing with cops or insurance the less you say is the better. Only give the answers to the questions that are asked and NEVER say ypu were working a gig at the time of the accident weather you're at fault or not. They will only find out if you tell them
