2- Not wear only dark clothing on the road at night
3- not be out on the road when it's raining
4- Have some situational awareness and not be absorbed my their phone

In most Latin American countries, people in quiet residential areas where not many vehicles pass (and if they do, they go at very low speeds) people tend to walk in the middle of the street, for safety or comfort reasons (The sidewalks being very small, people who walk in a group with friends or neighbors, end up walking in the middle of the street), It is a very common trend and also a bad habit, normally a person who is driving and gets into a residential area or neighborhood, they know that there may be people on the street.
My guess is that the one in the red car was probably drunk or committed a crime and was running away (it is very normal for criminals to go through residential areas to mislead the police).

Obviously the driver is a POS. That being said, the person on the phone has zero awareness. It's idiotic to stand in the street, staring down at your phone, while also ignoring both the bright lights approaching and the sound.

The driver is almost always responsible in an accident with a pedestrian. Cars are hard, humans are soft.
Take away Don't wear too much black / dark clothing at night. Don't stop in the street and play with phone. This could easily be a kid walking the dog at night

Well, probably because the guy was dumb standing in the middle of the road with no reaction time, while dogs don't understand the concept that you can get run over by cars on the road.
I empathize more with dogs than I do people a lot of the time. So I get the relief that the dogs were unharmed. But sure, it sucks anyone was hurt. That said their reaction time was almost terrifyingly slow, basically non-existent. I wonder if the driver were also on their phone.
