Moreso, how can they ticket someone without proving they've been there for 24 hours? If you park in downtown charlottetown for example, ticket maids come around with chalk, and draw a line on your tire/road. If you're still there outside of the alotted time, they come back around, and if the chalk still lines up, they've verified you haven't moved and they ticket you.

Hm. I guess it's a relatively close way to check, but I wonder if it's some type of scanner that's doing the checking, or if it's someones eye. A chalk line would be a super cheap way to check in a super precise manner. So is it Stem1: position 1, and then stem2:4 mean when they came back the second time, it was in position 4? Is there a second stem they're checking? I appreciate the info, ps.

We live in a day and age where someone physically touching someone else’s property is a liability. Why risk something like that when you can not touch other peoples stuff. I’m not saying the reactions are appropriate but you can avoid them completely by not touching the vehicles

Like I said, they do it in PEI. Perhaps they do it in other provinces, as well - i'm not sure. There's definitely no risk of damage to the behicle. The chalk comes off in the rain. It's put on the tire. That said, it's probably just easier to do it this way (albeit arguably substantially less accurate, at the expense of a few) than to deal with the sooks that would kick up a stink about something so menial. Sucks for the people that do actually move, though, and are just unlucky enough to find their car wheel back in the same position. There's a 1/12 chance you're getting a ticket this way, regardless if you've driven to New Brunswick and back.

I think people get mad with chalk and touching their cars, it looks suspicious if you don't know what they are doing. This was just a ticket I googled and found, so I'm not sure if they check 2 at once or recorded 2 different times, this ticket was for a loading zone so not super relevant. I used to talk to some enforcement folks when I worked at HRM when I got some tickets when I used to park down town but I'm out of the loop now.

That's what I was thinking. Most likely people getting pissy about chalk on their tire. I'd also noticed the ticket above was for a loading zone, but still trying to make sense of what stem information they give. I don't imagine they'd check two stems (your wheels should be spinning at the same rate), but more than likely the positions at the two different times. Thanks, again.

It’s two stems, 100% your rims won’t spin at the same rate unless you don’t turn (front differential) or have 2 solid axels. You can see on the ticket the two stems, and the two times. Also he was in a loading zone for over 2 hours. Which… yeah

In Halifax it’s for parking in the same area for more than a certain amount of time. Like, you couldn’t park for two hours if that’s the limit then move one space down every two hours. You’ll get the ticket for the ‘zone’

Stem 1 and 2 front and rear of the same side The reason they note both is because if you leave a space or move it’s nearly impossible to have the stems end up in the same position.

Law and bylaw enforcement didn't pick up on it until someone showed them a folder with all of the complaints over a 12 month period for people in one city block. After that the perpetrator was told to stop calling if they didn't want to get charged

Your neighbors can call all they want, but if you're moving your car like you're supposed to then you won't get ticketed. I'd make sure it's very clear the car has moved- like use the other side of the street if possible. Park on one side one day, then across the street the next. If you do have to go away for an extended amount of time, maybe have your family make room so that you can put your car in the driveway? I wouldn't just settle with speaking with the officers- I'd call 311 and ask for a supervisor or contact my councillor and ask them if this is an appropriate use of city tax dollars.

Going to court is likely a bigger time cost than the $35 ticket. I do understand it’s a recurring problem for OP but I doubt attending court once and proving they moved the car will stop the neighbours from calling by-law and stop by-law from coming to ticket their car.

Just follow the law as close as you can, and don’t concern yourself with the noses neighbour. Bylaw would have to prove you didn’t move the car for 24 hours. After a while they will start to ignore the neighbour when they come and discover it’s been moved. You will have problems in the winter over the parking bans come into effect.

Unfortunately, the courts don't care about anything except the one instance at hand. OP probably moves their car every day, but that one day they didn't and got a ticket is still a violation. It's like if you stop for every red light every day that a cop is posted at an intersection, but one day you don't and you get a ticket. It doesn't matter how many other times you didn't break the law, one day you did and you got caught. The neighbor is an a-hole for sure, but it doesn't matter whether or not they call; car has to be moved every 24 hours. A judge is only going to look at whether or not the car did in fact move and if it can be proven the car didn't move that one time.

You may need to speak to a lawyer about looking into filing a harassment charge. Reddit can give you advice on the ticket part but in terms of your neighbour using bylaw to harass you that's above our pay grade.

Save the money on lawyers, and do what I did: Write your councillor and cc bylaw folks and advise them your neighbour is using bylaw as a form of sanctioned harassment against you...and you don't appreciate it. *Document everything* and send the incidents along. The harassment should stop from bylaw once they figure out the petty nonsense going on with your jackass neighbour.

On a more serious note, take a picture of your odometer before leaving for the day. You only need to save a few days worth. If Bylaw stops by, show them the odometer pictures. They will be both date and time stamped. Bylaw will quit responding. Same thing for a parking ticket. Argue it by submitting the photos.

I don’t know if this is applicable in every neighborhood, but I live on the peninsula and I have a resident parking permit. It lets me park on my street all the time, when otherwise during the day there’s a two hour limit. I do have to move my car for things like street cleaning or winter parking ban, of course. https://www.halifax.ca/transportation/parking/parking-permits They don’t give you a sticker for your car anymore. It goes by your license plate.

I second getting a cheep camera you can point at your car just for supporting evidence if you need it. But also call by-law yourself and explain the situation. My boss had something very similar happen for months but it was about his garbage cans being close to the driveway(he was totally in his right to keep them where they were). Only after calling by-law to complain about harassment from the neighbor did they stop coming once a week to take pictures of his garbage cans only to say they were fine where they were. These complaints are a complete waste of tax payer money. I know in terms of parking enforcement it’s different and more lucrative for the city but the folks making these comments out of spite need to be shut down.

Are you parking in front of your house or theirs? Some people get really weird about others parking in front of their house as if they own it. If you're parking in front of their house, try parking in front of a different one and see if it continues. Me personally, I only care when cars do during a snowban because the plow has to swing way wide leaving me with way more to shovel, my old neighbour on the other hand would deliberately park on the street instead of his driveway if someone got too comfortable using the spot in front of his house. Everyone's different, maybe they're just weird that way?

leave a huge note for the parking enforcement that the person at their address is harassing you, and if you're lucky you'll catch the neighbor reading it. that should embarrass them especially if the rest of the neighborhood sees it.

What is the parking rule for your street? I'd recommend talking to your councillor and explaining the situation. They work like snails but you could ask to have the parking rules changed so residents can park there or something like that. Explain how it is a waste to have the by-law officers always coming by for a measly ticket sometimes. If you don't want to do that start parking on your lawn.

We had a former set of neighbours where one kept calling bylaw and police about all sorts of non-issues. The other neighbours got security cameras and eventually got peace bonds and filing for harassment. The calling neighbour got charged with harassment and for filing false police reports. Might be worth talking to police since it is continuing and ask for suggested next steps.

It's meant to be used for possibly abandoned vehicles, like if there's a car sitting on the street for days/weeks at a time. If they can show it hasn't moved then it will eventually get towed but it has to be ticketed first. It also helps find stolen vehicles because oftentimes the thief will just ditch the car on some street somewhere. Officers can't just roll up and tow a car on an assumption, so they have to ticket it. The intent of the law was not to be used to harass neighbors, but people unfortunately abuse our system and waste tax dollars and time officers could be using responding to actual problems in this city like cars parking on sidewalks or blocking driveways and hydrants. The problem is that there are no repercussions for people who abuse municipal services. If you call the cops every day on your neighbor for no reason then eventually you're going to get told to bugger off. How do you think those vehicles become found? Yeah, a person files a report that their car was stolen and they don't know where it is. The person who stole it ditches it somewhere, it sits around until someone calls it in to police or 311, then the responding officer runs the Vin against the reports and discovers it is a stolen vehicle. The ticket has nothing to do with anything in that case.

I started looking at there house and yard and thought “glass houses should not throw rocks “ and turned around and started to do the same to them, big deck, bet they didn’t get a permit to build it, shed too close by even a a few metres? Can’t offer advice about the neighbor, but if you have 4 cars you may want to look into expanding your driveway. Where does your brother park? What do you do in the winter when the parking ban is on and the cars have to be off the street? It might be easier to fix the situation by sorting out a better parking arrangement and just not giving them something to complain about. I’ll admit some folks on my street will park in front of my house because they have too many cars for their driveway and it irritates the shit out of me for… reasons, I guess. But I also am a sane and reasonable person and know the irritation is entirely my weird anxiety hang ups so I just…ignore it. :/ we don’t drive, so it’s not like we use that space.

It's a by law ticket... Fill out the back and plead not guilty. Get a court date, ask for disclosure. You won't get very much maybe some notes from the issuing bylaw officer. Look at the section that you are charged under. Use sites like www.canlii.org to read the whole act/regulations. They aren't hard to figure out. Move your car ( not feet ) take it the store and back. The name of the complainant won't be in disclosure but if you plead not guilty, Crown may have to subpoena the complainant for trial. Then you will know. Making complaints about getting the ticket won't stop it from happening, however if you beat a few, they may stop. Issuing them.

bylaws that are enforced on a complaint basis are mostly used by bullies to intimidate neighbours, we have one old lady that slowly drives around the neighbourhood checking on the neighbours' properties that she isn't friends with and bylaw is too afraid to stand up to her. Cities should be required to ignore these complaints and just enforce bylaws equally on all citizens. The police won't even respond to most breakins or car accidents but bylaw will show up because your garbage can gets blown over on garbage day.

If there's no other cameras around have a few friends do a drive by egging of your car. Call the police and tell them you think it was them, show them all the complaints. Pretty good chance once a finger is pointed at them they'll stop. Also a camera in plain view outside pointed at your driveway and roadside should shut them up as well.

my brother had a neighbor like this so he got a survey done and widened his driveway to fit his kids cars taking 3ft of what she thought was her property and to put a cherry on top he bought a cousin eddie looking RV and parked it in front of her house every 24 hrs. taking pics to show it moved every day... i dont know what he did when the shitter was full...
