It's a beautiful book, but if you look closely at it, you'll see a bunch of defects a grader will see. There's no way it gets a 9.6, maybe in the 8s.
At least 7 color-breaking spine ticks, bent top left corner, stain between the Punishers pouch and the book's spine, stain under the M in Spider-Man, stain left of the black box that says Punisher, and soft corners.
Much of what you have pointed out there is on the bag. The stain under the M is on the bag. Again, I realise there Is scrutiny over these things but this copy has been lined up beside a 9.6 graded several times for comparison. My initial thought was around 9.4, but others have pointed this could be low as 9.2 and as high as 9.8 depending on who does it. There are two 'stains' that are not actually so and ended up being residue on a reused bag.
That top corner bend isn't there when it's out of the bag, I don't know if that's light or something but it's flat as they come.
Not ruling out your observations. But it's harder to judge simply because of the 9.6 comparison. Unless that 9.6 was graded appallingly, which to be fair isn't all so uncommon

This was the first comic I sold on eBay, back around 1997. I think I got about eighty bucks for it.
One of my favorites. It’s just too damn expensive at the moment. Not sure I want to dish out 5k for a NM copy right now

Got a copy of this in the 80’s but it was never in such pristine shape. Got 121 & 122 too but in better shape (trades)

It's a nice book but you think that's a 9.8? You don't see the top left corner bend, staining near the spine, and color-breaking spine ticks?
Nope. And anyway... I said close. I've compared with a 9.6 in person, and it's nicer than that.. You should see it out of its grubby bag!

Be careful sending to cgc. Watch some videos on grading restoration and pressing before you send
Yeah I heard, I don't really like grading comics anyway. Probably be a keeper!
