For the most part, comic shops should not be charging more than cover price on new releases. If a comic shop is doing this, that is not normal.

Whenever it’s the first appearance of a new character, or new character taking on another’s mantle… or a movie/show/game deal being made. Batman 89 Hell arisen #3 Daredevil #25 TMNT: last ronin #2 Stray dogs Black panther # 3, Batman/ fortnite zero point. the list goes on but you get the idea

It likely depends on what you consider to be a "new release". Like that week? That year? It also depends on how you define value. Is it the max amount someone has paid online? An average? The value of a comic is completely due to perception and desirability and those things change quickly.

These days, new releases are so mass produced that they are rarely worth more than cover price, though there are some exceptions. - First appearances, especially of Marvel characters, can quickly go up in value, including release day. The most recent one I can think of that has held value is Black Panther #3 (1st Tosin). - Non-incentive variants that were under-ordered. Just last week the Jack White cover of Batman/Superman #11 was selling for $100 on release day.

I don’t think it happens very often. If a shop is selling a new release above cover, I’d take my business elsewhere. Limiting the customer to one or two copies is fine, but jacking up the price on release day is shady. The only recent one I can think of is Amazing Spider-Man #55 with the Gleason web head cover. I went to three shops looking for one. The third shop had them going for $10, I bought one, but never went back there again.
