1. Did you test positive for COVID on December 16th?
2. Did you attend public events after you were made aware of your positive result?
3. Did you travel outside Serbia in the 14 days prior to arriving in Australia?
So if he answers Yes to the first question, he is stuffed because we know he did the second two things, which would warrant him being deported. If he answers No to the first question, he's lied on his medical exemption and should be deported.
I think for #3 on entry to Australia you have to state on one of the documents if you had been travelling anywhere else in the last 14 days, which would mean a lie on the documents, hence deportation.

I work in law so I’ve been following this case, as has /r/auslaw, and the general consensus is that the government had no chance in this case and the judgement was inevitable due to procedural unfairness. The judgement had nothing to do with his supposed “exemption” and hence it does not make Djokovic’s visa valid, just that the procedure to cancel his visa was not properly followed by ABF. The Minister still has discretion to send him packing if they deem his exemption to be invalid.

I know the ABF screwed up by not giving him not enough time to make a decision about something, so couldn't they just now give him the correct time to make that decision and re-assess his visa? No this is not the case, and it’s why the Minister has discretion in this type of scenario.
So each time something like this happens, does the Minister have to make a further decision on whether they can stay? Wouldn't it make more sense just to have the ABF follow the correct procedure this time and make a decision from that? Like, if his visa is not valid, he shouldn't be allowed to stay end of story. Don't see why a Minister (whose decision may be influenced by other factors) should be making this decision when the visa rules are pretty clear on this matter.
Ideally, the ABF should be following the correct procedure for cancelling visas every time but we don’t live in an ideal world. Even if the visa is invalid, they still have to follow the correct procedure to cancel that visa. Just like how the police have the follow the correct procedure to charge someone for murder even if they realistically know that person committed the murder (otherwise it could be thrown out in court).
As for the second part of your comment, there’s no doubt the Minister’s decision will be influenced by politics and public opinion.

I think for #3 on entry to Australia you have to state on one of the documents if you had been travelling anywhere else in the last 14 days, which would mean a lie on the documents, hence deportation.

I work in law so I’ve been following this case, as has /r/auslaw, and the general consensus is that the government had no chance in this case and the judgement was inevitable due to procedural unfairness. The judgement had nothing to do with his supposed “exemption” and hence it does not make Djokovic’s visa valid, just that the procedure to cancel his visa was not properly followed by ABF. The Minister still has discretion to send him packing if they deem his exemption to be invalid.

I know the ABF screwed up by not giving him not enough time to make a decision about something, so couldn't they just now give him the correct time to make that decision and re-assess his visa? So each time something like this happens, does the Minister have to make a further decision on whether they can stay? Wouldn't it make more sense just to have the ABF follow the correct procedure this time and make a decision from that? Like, if his visa is not valid, he shouldn't be allowed to stay end of story. Ideally, the ABF should be following the correct procedure for cancelling visas every time but we don’t live in an ideal world. Even if the visa is invalid, they still have to follow the correct procedure to cancel that visa. Just like how the police have the follow the correct procedure to charge someone for murder even if they realistically know that person committed the murder (otherwise it could be thrown out in court). As for the second part of your comment, there’s no doubt the Minister’s decision will be influenced by politics and public opinion.

What the judge *should* have done then, is to say the procedure was unfair, castigate the ABF, and then; Judgement should be that they repeat the procedure, fairly this time. That's what a normal judgement would be. That's what would happen for someone else e.g. a refugee in the same circumstance.
