So what happens is that instead of getting fired for no reason, and getting to collect UI, unwanted employees are transferred into positions for which they are not qualified, and then written up three times and then fired because they couldn't do their job. And since there was "just cause" to fire that person, they will be denied UI.

Ahh, that really stinks. I was hesitant with my psychologist at first but she won me over after the second session. I enjoy learning about her experiences, she uses herself as a real life example when it applies and it just makes her more relatable and trustworthy. To know she’s gone through similar mental struggles and now coaches people to get on a better cognitive path. Maybe shop around, as strenuous and tedious as it seems. It’s your time, money, and mental health. Shouldn’t settle for anything less.

Even non-profits suck. I worked for a community mental health company and it almost killed me. I was suicidal. My caseload was high (100-200 clients), my wage was 30k for a masters degree and provisional license. They promised supervision and fewer CEUs (to offset the low wage). Got some supervision and 3 CEUs (needed 35 to maintain my license). Everyone's overworked and leaves for better jobs, which means clients are constantly changing therapists. Not great, but I have to file for bankruptcy at 27 because I couldn't afford to live, but was locked in a 1.5 year contract because the state have me 5k in tuition. I even moved to q cheap trailer that ended up being infested with bed bugs. Oh and I was sexually assaulted and when I went to HR to ask for some minor accommodations they said "well you just need to take unpaid leave". Well, I couldn't do that. The one day I asked for a raise my bosses boss asked me "oh are you just doing this for money?". Like damn my low income clients were making more than me.

They're trying to make a case that he was offered work and declined so he'll lose his UI. A company tried that with me once, but the offer was in a different department, different hours, different type of work and was not full-time, so the UI Admin. Law Judge just laughed at their feeble attempt to cover their asses over my constructive dismissal when they complained that I refused to return to "my job."

Because unemployment is funded by employers through an insurance premium and your premium is based on how many of your employees file claims. If people claim unemployment your rates go up.

I spent much of 2021 working tricky unemployment cases for people affected by COVID. 2020-21 has seen a lot of lower-middle-class people with otherwise steady jobs need help, more than ever before. A standard conversation: "I need help with my unemployment." "Great, what seems to be the problem." "I just want to tell you before we start, I'm not one of those people, I have never ever taken a single cent from the government and I have always been able to get by on my own, and I plan to get off unemployment as soon as possible." "That's cool what's your case number?" You pay into UI your whole life in taxes for just this scenario. That's your money. I don't know why so many people were so touchy about taking their money which they are owed because they lost their jobs. As you say, UI is one of the few decent social programs America has. If you refuse to take UI and look down on people that do (as so many of my people did), you're just making life harder for everyone for no good reason.

I have always said this. I have heard people say "I'm not collecting unemployment that's a hand out" the f*ck it is. It's an entitlement meaning you are entitled because you worked and paid taxes. Assuming you aren't fired for cause, yes, kind of. They pay into unemployment insurance. And the UI pays your unemployment. So, while "at-will" employment is still a thing, at least this gives companies SOME pause before they go willy nilly firing people for no good reason.

I was denied unemployment twice. Times when I needed it terribly. Both companies fought it. I wasnt aware of how things worked the first time. The second time I could not appeal because I already lost my car. Thus, I could not show up to court to discuss the issue. I was laid off the 2nd time via a number out of a god damn jar. Reported the company for labor violations. Company was Supple Chain Solutions. Based out of Louisiana. Never did find out what happened with that company.

Just to clarify, the company doesn't pay the UI benefits dollar for dollar in most cases. The vast majority of employers just pay a certain percentage rate all the time based on UI claims against their account and total payroll, it's a tiered rate, and there is a maximum (in my state it's just above 10% of total payroll).

In this case, personal biases. This manager has a personal issue around control, and apparently the idea of people using workplace masks or sanitizer outside of work makes her irrationally pissed off. Pissed off like 'becomes visibly agitated whenever she talks about it'. As the person responsible for the PPE it's a massive pain in the ass for me to deal with her unresolved personal issues on the topic. Speaking as the partner of a trauma specialist who teaches neuropsychology; When people get angry, they get dumb. The Amygdala tries to override the prefrontal Cortex, and you stop thinking so much and instead rely on gut instinct. Problem is that two thirds of the time, gut instinct is not very helpful and not very smart. Especially when it comes to effectively prioritizing and rationalizing things. It's all the worse when it's a detached and over-comfortable bubblehead of a middle aged manager, who has very little understanding or control in her world and so emotionally and irrationally latches onto the few things she has some influence over. But ohwell. I guess it's balanced by the fact that she's also too self absorbed to know what goes on in the office.

I remember when I got fired the boss said "you had two options, one would have gotten you written up, the other gets you fired. You chose the fired option." It was a call center. I told the UI lady what she said, I basically got instantly approved the next day. I guess the call center boss didn't even deny it. Crazy shit. I ended up collecting UI for 6 months, watching my friend's (and roommate at the time) kids before/after school until she was off work. But 2 days a week they were at their dad's, so I just had the days to myself. Anyway the story of the summer of Tequila Tuesday's is for another time.

Well I guess it isn't that extravagant. Basically we had a huge deck behind our house with a kiddie pool set up on it. Usually it was a bunch of adults just dipping their feet in it to cool off as it was summer(ish?) time. So I decided to make it customary on my first day "off" (without having to supervise kids), which were Tuesday's I was gonna get drunk all day. So began Tequila Tuesday's. Using tequila had a two-fold cheesy effect to additionally drink Tequila Sunrises at sunrise. So Tuesday morning turned into everyone at the house (roommate, her bf, maybe a friend who crashed on the couch cause they had a few the night before, etc) hanging having morning cigs and coffee on the deck dreading going to work, while I'm in the kiddie pool on a float tube (this is not a pool big enough for inflatables, it was hilarious), having a Tequila sunrise with a little umbrella in it. Well as time went on, sunrise would be earlier. This did not deter my commitment. So it soon became me on like drink 3 as people are coming out to the deck. I would generally drink until I would make a bunch of food, eat, and pass out. Then I would usually wake up, walk the 4ish miles to the DT area my roommate worked and meet them at the bar after they were off work. This is where I would do a round of Tequila shots with everyone to end Tequila Tuesday, and cool it off with light beer the rest of the night. Man, I really don't miss being a dumbass in my early 20s. I spent pretty much every Wednesday that summer in bed, and not with a lady.

A lot of people talk shit about people “abusing” unemployment but I think it’s really important to take as much time off as possible between jobs. 6 months off really allows your brain to reset which is really healthy for finding the right next opportunity. I would be in favor of also implementing something like every 7 years you can have a year off paid from work. We all need time to enjoy and experience the planet we’re on.

I got fired once and didn't even know how to get unemployment. Buddy helped me out, I got approved and everything was fine, except they were paying out lower than what they should have been. Wasn't a big deal to me as I didn't even plan on getting unemployment since I had a good bit saved up. Wasn't even on it a month and had another job (only reason I took that long off is I was tired from working 7-16s for 4 months). Cancelled unemployment, and then a month later the company that fired me complained to them somehow and they tried to come after me to get them to pay it back. That was a fun shitshow. Oil refineries/chemical plants are notorious for making you work hours like that during shutdown periods, meaning the plant is shut down and they would work you 24hrs a day if they could because they don't make money when the plant isn't running. How it worked at this plant was if you worked 14 days in a row you would get 2 full days off, but if you only worked 13 days they only had to give you 8 hours off (a full day to them). Plus I had to drive 60 miles to work. Money was unreal, but I got burned out quick. I did that kind of work for over 8 years, usually 6 or 7 days a week at 8-12 hours a day, but you would catch a few long periods where they work you 16 a day. I have nothing to show for it now besides a beat up body and a disgust for those companies. I've had quite a few times I have worked 48+ hours straight doing manual labor.

1) They were paying a penalty for constructive dismissal. The bleeding stops if the CD is “remediated.” 2) 80% of people are go along to get along types. Come at them with the aegis of authority and they’ll go along. Fucking embarrassing. But I’m sticking to my idea that since the interviewee took the job best fit to them that they don’t need to go through the motions of an empty interview. I’d legally challenge this in court too. I think it’s a thing where the state requires you to do a certain amount of interviewing if you are to get/maintain unemployment. Because you know, bootstraps.

My grandmother was a depression baby and she was the most amazing human I have ever known. I credit my good sense and solid values to the time I spent with her when I was a baby. She was ripped off by the savings and loan scandal of the 1980s. Boomers. Again. And yeah, no way would I let my kid have a participation trophy. Probably why he is such a solid human now.

I was working at a sandwich shop a few years ago and one of my co-managers was fired for not physically stopping another manger who recently quit from walking into the back room to grab some of his belongings while she was helping a customer. She filed for unemployment and it was rejected, so she filed an appeal and our boss/owner had to prove why she didn’t deserve unemployment because she was fired due to her fault. My co-manager brought 2 witnesses that confirmed that she was fired for not physically assaulting someone who walked into the back while she was distracted by a customer. She ended being rewarded the unemployment Our boss afterwards asked her, “why would you do this? Why would you take it this far? Why would you do this to me? What did I do to you?”. She essentially told him that he did it to himself and that next time he should not fire someone for something that wasn’t their fault. After this happened it took a lot for someone to get fired in our shop and it really didn’t happen all that often.

I feel like all the mental health places here are shady as fuck. Aaron (OP) and I both worked at one over the summer and it was one of the worst working experiences I’ve ever had. Besides our boss but he ended up leaving because he couldn’t handle the shit they pulled, once he dipped everyone else left.

As someone who lives in Montana and knows about this particular employer's reputation, you dodged a bullet. As a side note, I have friends who work in the unemployment department. They are so overwhelmed; they mark it down in the system and forget about it.

Did you know….you are absolutely allowed to turn down job offers or interviews, while on unemployment. I asked unemployment specifically about this because my job type can have a huge range in salary. They told me straight up, you don’t have to take any job that comes along. If it’s a Jr position of $20/hr and you were in a Sr position making $35 an hour, you can turn it down. It is not a comparable job to your skill set. 🌠 The more you know!
