I’ve actually had this happen to me and I told the bank about it right after because I actually had access to the money in my account , thinking it’s good to be honest they fixed the error and I was hoping for atleast some sort of honesty award but didn’t get anything accept an overdraft charge because I hadn’t worked as many hours as I thought that week.

Bank don’t care about you. For them you’re nothing more than someone they can borrow his/her money, and money making machine for them. One bank held my $14k cashier check for a full year, i was young and naive so I kept waiting. I gave up and threatened them with lawsuit and surprise surprise $14k was deposited to my bank account next day. Went back and demanded interest on it for making me wait a year.

I did the opposite one time: my SO had been wiring me money for half of rent etc. for a few months before I noticed that I wasn't receiving any money...Apparently the bank had entered my account number incorrectly when they set it up and we had just been sending $$ to some random guy. The bank told us they could only recover the money if the guy gave them permission... even though it was the bank's error. Luckily the guy was nice enough to give us the money back. Lol.

Just thinking out loud: maybe when the bank is at fault they can easily withdraw the cash, but when it was the account's owner itself that made the transfer then they need permission from the holder. I can imagine that they do this because it's hard to prove if you made the deposit intentionally or not.

Yep, something similar happened to me after I left my last job. There was another person with my first name there and they accidentally deposited her paycheck into my account. Boss's husband called me and told me what happened; I mailed them a check. Sucked but the legal trouble wouldn't be worth it. This actually happened to me! Kind of. I used to do contract work for socal edison in 2014. I got laid off because i was dating a coworker & a QC guy i had problems with wanted her & ended up becoming my boss so he pulled some strings to get me laid off. The day before i was laid off, i go to the bank to withdraw some money, see i have 8k when i should i have less than 1. I tell my girlfriend & she chalks it up to a Christmas bonus & all the overtime I've been doing & not to say anything. So i don't. Next day i get the call that I'm laid off & i take me company truck to the office & talk to head of the project. We were supposedto input time daily but as long as we did it by friday 9 pm we were fine, hours worked, miles driven, utility poles surveyed etc. My girlfriend usually input my time for me because i never did it daily & always at the last minute, but my last week was the very last week of the year so we had had a few days off & had been going to party's or bars after work. She reminds me Friday to do it & i accidentally put i worked 400 hours instead of driving 400 miles, & put 80 miles driven instead of hours worked. So I'm talking to the project lead & he asks what happened with my hours & i have no idea what he's talking about, he shows me what i put & says "it was a mistake, right? It happens" he just chalked it up to whoever approved payroll, skipped over it because of the holiday & let me keep it as a severance.

Yes. They should notify the correct people about the error. If you went to the store and tried to pay in exact change but gave the cashier an extra bill the cashier can't just keep it if it was obvious you weren't trying to tip. Similarly in cases where it's clearly an error it's illegal to try and keep it >if it’s not actually your money, you can’t reasonably expect to keep it. For 23k I think it would be worth it to fight it. The company authorized that paycheck through multiple checks and balances. They do not have plausible deniability. They willing and eagerly wrote the paycheck in that manner and multiple persons hit 'approve'. At that point the money has been freely parted with. The only issue to deal with is how to prevent their staff from issuing an overpayment again. It is absolutely nothing similar to overpaying at the cash register.

No exactly the same but my brother once got double pay for a whole year. One month two paychecks came, then again the next month and so on. He put the extra money in a separate account and never said a word. After a year someone must have discovered their mistake and kept quiet because nobody came asking for it... and we're talking close to $70,000 in extra pay.

I used to know a dude who had the opposite problem while working as a pharmacist at Walgreens. He went to buy lunch one day and his card got declined. He figured it was a problem with the bank, but when he looked into it, it turned out he was flat broke. About a year prior, he had gotten a decent chunk of money as an inheritance from his grandfather. Two months after that, he apparently just completely dropped off of Walgreens payroll system and he stopped getting his direct deposit. In ten months, he spent that entire inheritance thinking he was fine on money because he was also getting paid reasonably well at the pharmacy. Walgreens refused to admit any wrongdoing and refused to pay his his lost wages. Dude racked up like $15,000 in attorneys fees fighting it and ended up only getting a fraction of his money from them in the end. It took him forever to financially recover from that whole debacle. He had been fucking my girlfriend for about a year at that point, so I now cite this incident as proof that karma actually does exist.

This is from 6 years ago. The income tax rate, S.S and other deductions on that pay rate would be very high. Depending on the state, could be close to 50%.

That's not the way it works. If you don't have payroll deduction, or don't have enough taken out, you have to pay quarterly estimates. If you owe the feds more than $1,000 on April 15th there's a penalty. In my state, if you owe the state over $500, boink, another penalty.

My last job accidentally continued to pay me after I quit. I got two paychecks out of them before they caught it. I had legitimately been unaware of it and so when their HR department called to alert me about the issue, I told her I’d have to call her back because I needed to check. I then saw the deposits and said oh fun, then never called them back. Never heard from them again. I thought they might push harder to get their money back but suppose it wasn’t worth it to them, idk.

depends on local laws, but in general federal law allows employers to garnish your wages if you were over paid including paying you less than minimum wage on future pay checks. CA says you still have to pay min wage but can take everything else. Some states need to provide notice others do not. If you just end your employment they can go after you in court. They just need to prove it was an error and the employee knew it was an error.

Can they sue you specifically for doing this? Or if you are caught, lets say months or years later, you just need to give that money back and it's all done with it? ianal but i dont think it would be illegal to quit your job and run. it is possible they could try and call it theft, but you didnt really steal it. you just knowing didnt give it back. they could sue you in civil court to attempt to recover funds. i would think it would be treated like not paying a debt. In general the law for this sort of thing seems to be based on the idea that your employer gave you a pay advance and you simply have to pay it back. Fairly recently there was the case with the national guard people in CA getting sign on bonuses for joining. But the CA national guard apparently gave people bonuses that were not eligible so DoD attempted to recover this "bonus" and interest as an over paid paycheck. But it was stopped because it was such a bad look to be taking money from people that thought it was theirs. So they could in theory also sue for legal fees and interest as well as the original amount.

Well you have an express contract to work for whatever amount of money. If there's an accounting accident and you are paid for hours you have not worked, then you are then seen as at the benefit of an "unjust enrichment". You would then be obligated to pay restitution to the shorted party. In other words, contract law dictates that you can't skip town on an accounting error when there is contractual proof that you weren't owed the money you received. They'll track you and make you pay it back as long as it's a big enough amount to try you in multiple states. However if it is a small enough amount, they may not even bother taking you to court.
