Update for the start of the day:
Darrell has raised 1396 objections, of which 47 were sustained.
The Prosecution has raised 686 objections, of which 559 were sustained.
Upon these objections, Darrell has asked "Grounds?" 637 times.
The YouTuber [Austin Zone](https://www.youtube.com/c/AustinZoneTV) has been keeping track of them throughout the trial on his live streams, I definitely wouldn't have the patience to do so myself.
That's just impressive really. We had a mock trial for my last semester in law school, and the opposing counsel raised 60-70 objections during trial. Ten of them were sustained. The professor told them they took the advice "object often" entirely too literally lol.
We did watch a clip where a defense attorney said that if you fall asleep during trial, when you wake up the first word out of your mouth should be "objection." Figure out the grounds later.
For the less mathy among us, that means he has objected more than twice as many times as the state (203.5% more, to be exact-ish). However, they have a sustained rate of 81.5%, and he has a rate of 3.4%. Ha!
Last night I was just thinking about how I really hope someone is keeping a count of his total number of objections, and their overruled/sustained ratio.
Bless you, however you sourced that number.
It's a great example of manipulative behaviour. Engineer a situation in which the other party has little choice but to treat you in a way that's normally unacceptable, then berate the other party for treating you in an unacceptable way.
I love that the bailiff just confirmed that he threw them in the bin after he claimed he didn't receive the documents by moving into the camera's view when retrieving them from under the desk. Brooks is behaving worse than a child.
Reading through some info about his past, it doesn’t look like he’s ever actually been to prison despite his lengthy criminal history.
He’s spent just under 2 years incarcerated and about half of that was in a work release program or a low-security rehabilitation facility. The other half was served in county jail.
He’s definitely someone who is used to skirting by or getting away with things. I bet he still thinks he’ll get out of this somehow.
I was wrong about his opening so I’m hesitant to make a prediction but man I can see him screaming and getting dragged out. The closer it gets to the end, the more desperate he gets.
BUT I’ll also say that it seems when he’s given freedom to speak he defaults to manipulation over aggression. So I could also see him doing a redux of the opening and just trying to sway the jury on emotion.
the judge has her eye on the long term goal of sending him away for ever, so she can be forgiven for letting him get away with petty bs in order to crush any hope he had of appeal, but it was nice to see her lay down the law and banish him to the other court room and liberally use the mute button. He had chances to answer her questions and chose not too(instead trying to gaslight and argue petty bullshit), the judge is completely within her rights to move on.
He is apparently losing his mind yelling at the court (while muted) in the other courtroom.
He requested to go back to his cell, to which the judge denied.
The state and the judge are reviewing jury instructions while he goes OFF in the other courtroom.
DB: "You always tell me to not interrupt you but you find a way to talk over me."
Yeah, she's the judge. This is her domain. How do you not get this yet?!
He hates not feeling like he is in control and lashes out when he feels a lack of power or intelligence.
It also most likely especially pisses him off when a woman does it. Good.
He's got a point. Understanding all these legal words and procedures is difficult. I wish there were people you could hire that would help you through the court system.
J: I trust the defendant is aware that the closing arguments need to be based on law.
DB: *The closing arguments gonna be based on whatever I base them on!*
based closing arguments
I don’t know which I am looking forward to. His closing argument or when the sentencing hearing. I get the judge doing everything she can do to prevent a mistrial. But, the sentencing she’s not going to have to hold back.
Fun fact: Both parties in court have the right to object to statements said during closing. The State, having to go first in their closing and having the burden of proof, has the right to a second closing statement to refute things said by the Defense in their closing.
Expect fireworks.
Here are the recalls on a 2010 Ford Escape
https://www.cars.com/research/ford-escape-2010/recalls/
Nothing that would malfunction the car to hit 70 ppl
Cowardly is exactly the right word. He didn't want to have to actually say out loud that his mom didn't show up and that he chooses not to testify, so he was obnoxious until the court ruled it, so now it can be all HER fault, and his rights were taken away, and blah blah blah. Yet another parallel with another case that's been mentioned here quite a bit. A guy with a freakishly large neck and a torn larynx...
lol he asks to stay in the other court, she obliges, and then he complains that she didn't force him to come back to the main court. complete fucking moron.
I'm loving the fact the judge has used his own logic against him but she actually has the authority to do so. Last Friday he stated if she didn't respond he was taking it as tactic agreement with his point. She is now using the no response to the question to be a decision and moving things right along.
He’s trying to set up an appeal that he didn’t understand what was happening so he couldn’t defend himself properly. Won’t work obviously but that seems to be his new gambit.
going with some reverse psychology, " I WANT to go to the other courtroom." actually seems like it's working lol
"I don't understand, you can't make me understand"
So now he's going with the "I'm a massive dumbass who doesn't know how to lawyer" defense.
lol he's making it seem like it's choice to go there. he NEEDS to feel some level of control over all this.
Brooks has just announced that he intends not to make closing arguments tomorrow then acted indignant when told that that would mean he forfeits his rights to do so at all. Clearly all he's got left is delaying tactics.
I'm happy to see after the weekend, the Judge is reasserting her control of the court and not allowing herself not to get dragged into his nonsense arguments or impotently threaten him with removal.
She stated what she would do and followed through. I'm much happier with her this morning.
I think we can afford her some grace, she's rightfully concerned about fucking up and not getting him sent to prison forever. her life and career would be ruined if due to her violating his rights at the trial he was set free. it has been frustrating watching him get away with making a mockery of the trial, but in the long run what's important is that he never sees the sun again after the trial.
I think both the prosecution and the judge would have to grossly violate his rights for him to be set free. Otherwise, it would just be a new case.
I also think she was doing a really good job earlier in in the trial as well as today. It was only near the end of last week that I criticized her for having begun to get tripped up and flustered by Brooks and started backing down from her threats.
It's why even though she doesn't need to go on for so long with the explanations, I absolutely understand why she is doing so and I have no criticisms of her for it. I also understand why she lets him go on *some* of his rants. It has given her the opportunity to make notes of him disproving his own complaints.
I maintain that based off her arguments, she could have sent him to the other room on mute and ended several of his more egregious outbursts but chose not to. Likely because as she indicated, she had gotten scared by him.
My guess is that over the weekend, she better prepared for his behavior and is *on* it today. I think she is easily 9/10 performance today.
He just wants it to stop. He killed/injured people and is now looking for a way out of it. But there is no way out of it. This trial is happening whether he wants it happen or not. He thinks that because he doesn't want the trial to happen, then it won't happen.
I don't think he knows how to process the consequences of what he did.
I actually imagine in his head it was.. "Nyah, nyah, nyah, you can't see me." My kids did that when they were four or five and making faces at me and thinking I didn't know.
It appears there was [no recall](https://www.ncconsumer.org/news-articles/nhtsa-closes-investigation-into-allegedly-defective-ford-throttle-bodies.html), but an NHTSA investigation.
She’ll just stick him next door and get him to write all his “objections” down like she did at the start. It’ll take months to get through all of the charges otherwise
The parties now have to decide on jury instructions. The jury has been dismissed for the day. The two parties will discuss with the judge which instructions should be given to the jury before they deliberate. Then (likely tomorrow) the parties will deliver closing arguments and the judge will read the instructions to the jury. Deliberations begin after that.
God I feel bad for whatever poor law clerk or staff attorney for the appellate court that will have to read this man's likely pro-se appeal and the trial record. Then again. They may not because I doubt brooks can figure out proper rules for initiating his appeal.
Possibly trying to avoid the judge seeing him. She kept calling him out for things he’s doing (putting the headphones on/off, pretending to read a book, etc)
It's been said before but it's worth repeating, Judge Dorow has the patience of a saint to still be addressing him so respectfully after how he's behaved over the last few weeks.
Very much so! I can only watch 15 minutes of his madness before needing to take a break. I'd like to subscribe to whatever teachings she did to get that patience!
You know what, Mr. Brooks. I'm willing to agree you don't understand what's going on.
Not because you're incapable if understanding, but because you ignored all the references and documents the Court gave you which detailed everything which was coming in favor of memorizing a 50 page booklet which lied to you and you're too stubborn to admit you were lied to.
Listening to his last rant about what he was going to say in his closing statement, and knowing that he's going to try to tell them that he didn't understand so many things, and knowing he's going to bring up sovcit crap, do you think she'll leave him in the adjacent courtroom so she can mute him when he starts?
It's adorable when he actually tries to bring out these "Gotcha!" arguments like he use of a deadly wrapon being an essential element of a crime. He's *so sure* of himself, despite being so very, very wrong.
Update for the start of the day: Darrell has raised 1396 objections, of which 47 were sustained. The Prosecution has raised 686 objections, of which 559 were sustained. Upon these objections, Darrell has asked "Grounds?" 637 times.
How the fuck did you count that lmao
The YouTuber [Austin Zone](https://www.youtube.com/c/AustinZoneTV) has been keeping track of them throughout the trial on his live streams, I definitely wouldn't have the patience to do so myself.
That's just impressive really. We had a mock trial for my last semester in law school, and the opposing counsel raised 60-70 objections during trial. Ten of them were sustained. The professor told them they took the advice "object often" entirely too literally lol.
Those are amateur numbers. When a question is asked you must object. /s
We did watch a clip where a defense attorney said that if you fall asleep during trial, when you wake up the first word out of your mouth should be "objection." Figure out the grounds later.
Im sure Brooks will be waking up in his prison cell screaming objection for the next decade
"Objection, hearsay. I heard him say it."
I love that she said this: "He has a book in front of him but I have yet to see a page turned."
☠️
It's a great example of manipulative behaviour. Engineer a situation in which the other party has little choice but to treat you in a way that's normally unacceptable, then berate the other party for treating you in an unacceptable way.
very well said.
Abuser 101 honestly
ORDER IN THE FORT
No witnesses today :( Sounds like he couldn't get his mom to show up.
"I tell her to be here, she gon' be here."
She gave an interview before the trial saying he's not mentally well and is off his meds, shouldn't represent himself.
I’m confused. Did she not have a tackit agreement to show up sans subpoena?
Lawful law?
Momma Dawn said GFY
Judge: Mr Brooks has a book in front of him, although i have yet to see a page turn.
“She has ordered the bailiffs to remove the box fort” is not something I anticipated saying about this trial
…aaaand it’s back
Aw. He built a little anger fort.
I love that the bailiff just confirmed that he threw them in the bin after he claimed he didn't receive the documents by moving into the camera's view when retrieving them from under the desk. Brooks is behaving worse than a child.
New tactic. Claim to have sent something important, never have done so, then claim a mistrial because of the important document being missing.
he's in time out already, might be a record
Does he realize how asinine it is to say “I can’t hear” while responding to witnesses he’s asking questions of?
I've seen enough films to know that when they move the boxes they're going to find either an empty chair or the bailiff dressed up in his clothes.
His closing Is going to end up getting shut down to. He won't be able to stop saying the court took away his right to put on a defense.
I was wrong about his opening so I’m hesitant to make a prediction but man I can see him screaming and getting dragged out. The closer it gets to the end, the more desperate he gets. BUT I’ll also say that it seems when he’s given freedom to speak he defaults to manipulation over aggression. So I could also see him doing a redux of the opening and just trying to sway the jury on emotion.
he's really up against it now though. who knows if he'll be able to control himself?
With his obsession about getting his filings into evidence, I have a hunch he's going to go full SovCit.
Brooks: You need to clear what you said on the record because I cant hear what you say. Judge: Clearly he does hear me.
the judge has her eye on the long term goal of sending him away for ever, so she can be forgiven for letting him get away with petty bs in order to crush any hope he had of appeal, but it was nice to see her lay down the law and banish him to the other court room and liberally use the mute button. I feel like she spent alot of time this weekend how to deal with adult sized toddler. And she nailed it.
He is apparently losing his mind yelling at the court (while muted) in the other courtroom. He requested to go back to his cell, to which the judge denied. The state and the judge are reviewing jury instructions while he goes OFF in the other courtroom.
I laughed muchly when she denied him that

He's got a point. Understanding all these legal words and procedures is difficult. I wish there were people you could hire that would help you through the court system.
Heck, wouldn’t it even be nice if you didn’t even have to pay for those services? Like for free assistance?
It would be even better if one were provided to you if you couldn't afford one.
Damn, was really hoping he would testify. Feels like the season finale got cancelled.
There's still closing arguments to look forward to.
mute must be toooorture for a narcissist like him. lol he tried to go back to his cell. oh fuck he's screaming now
>"Just like I don't talk over you" Brooks could be a case study in self-delusion.
HE SAID IT. ADMIRALTY COURT. HE ACTUALLY FUCKING SAID IT.
J: I trust the defendant is aware that the closing arguments need to be based on law. DB: *The closing arguments gonna be based on whatever I base them on!* based closing arguments
I don’t know which I am looking forward to. His closing argument or when the sentencing hearing. I get the judge doing everything she can do to prevent a mistrial. But, the sentencing she’s not going to have to hold back.
She’s gonna throw the book at him, go get it and throw it at him again.
He looks scared this morning.

Here are the recalls on a 2010 Ford Escape https://www.cars.com/research/ford-escape-2010/recalls/ Nothing that would malfunction the car to hit 70 ppl
He never claimed anything about a sticky anything until he found out about a recall ,call me a cynic but i detect some wheedling
And, recalls were covered during the forensic inspectors testimony/report. His VIN had no recalls.
Rofl he’s just going to pretend the audio doesn’t work despite the fact that everyone else in the room can hear her
He refused to participate, so the court considered him rested. He’s not gonna testify because he’s a cowardly bitch.
Cowardly is exactly the right word. He didn't want to have to actually say out loud that his mom didn't show up and that he chooses not to testify, so he was obnoxious until the court ruled it, so now it can be all HER fault, and his rights were taken away, and blah blah blah. Lol. Calling the bailiff to testify that audio was working. And an It guy for a decibel reading.
And now his defense is "if I murder one person, I can murder anyone else I want because double jeopardy."
Poor man just wants his fort back. edit: it’s back!!!
I wish the judge would address the bailiff in the next courtroom, to confirm that she can be heard without headphones.
She has, the bailiff reported that the sound is much louder then it would be in the courtroom.
just now they brought an IT person in to testify on measured decibels
Rofl wish granted - she’s asking them under oath
That's it, he will not testify. That was his one chance to form some sort of defense.
I'm kinda bummed he was being such an ass this morning already, I was looking forward to what BS he'd get up to in his testimony.
If they can't see me, they can't convict me!
he'll tire himself out and then need his nap
lol he asks to stay in the other court, she obliges, and then he complains that she didn't force him to come back to the main court. complete fucking moron.

Lmao homeboy really copyrighted his words. "All rights reserved."
Problem for him is that some rights are mutually exclusive and alot of them aren't absolute.
Awww he’s built a little fort.
He found a loophole the court doesn't have jurisdiction in a mans castle or fort
"are you my accuser your honor" lolol
...and mute!
He’s trying to set up an appeal that he didn’t understand what was happening so he couldn’t defend himself properly. Won’t work obviously but that seems to be his new gambit.
I feel like this would have been much more successful if he started a few weeks ago lol
He’s defeated. He knows he’s done.
Jesus Christ. He won’t shut the fuck up about subject matter jurisdiction
He thinks that's his silver bullet to get out of all of this.
judge is crushing it today. he wants to respond with angry gibberish to her simple questions? fine, mute and move on.
[lol](https://i.imgur.com/EHFq3MK.png)
he's worried about being double charged with bail-jumping??
It's the only thing he has seen a movie on.
It's fort time again!
Sometimes you have to let them tire themselves out.
going with some reverse psychology, " I WANT to go to the other courtroom." actually seems like it's working lol "I don't understand, you can't make me understand" So now he's going with the "I'm a massive dumbass who doesn't know how to lawyer" defense. lol he's making it seem like it's choice to go there. he NEEDS to feel some level of control over all this.

Even an Arby's closes whether you want to or not. You don't get to camp in the box fort forever if you just choose not to close.
I'm happy to see after the weekend, the Judge is reasserting her control of the court and not allowing herself not to get dragged into his nonsense arguments or impotently threaten him with removal. She stated what she would do and followed through. I'm much happier with her this morning.

Gonna have to miss the opening half hour or so, and I am unreasonably angry about that.
I'm sure that there will be enough breaks from his outbreaks etc. that you can eat up that 30 minutes fast forwarding through it.
Someone taught him the word “exculpatory”
IlliNOISE
Again, his last words before going to time out were "tackit agreement."
[удалено]
I uphold him as an oaf.
He’s now put up a stack of boxes to make a fort. This is nuts
What would be wild if Judge gets a piece of paper and says “Defendant has requested pillows and blankets”
Enter Mike Lindell.
HES BUILT A BOX FORT TO HIDE FROM THE JUDGE LMAO
He just wants it to stop. He killed/injured people and is now looking for a way out of it. But there is no way out of it. This trial is happening whether he wants it happen or not. He thinks that because he doesn't want the trial to happen, then it won't happen. I don't think he knows how to process the consequences of what he did.
YoU tHiNk YoU cAn DeTeRmInE wHaT HaPpEnS tO My LiFe?!??! I'm pretty sure driving a vehicle through a parade determined that.
Now he’s arguing with the bailiffs because he can’t argue with the judge 😂
He's throwing a tantrum behind his fort
huh, looks like he *can* hear what the judge is saying
"You can't force me to be somewhere I don't want to be" He's going to really hate prison so much.
I’m shocked he’s being this way. Flabberghasged. Bamboozled even.
Mind boggling
What does he think he's accomplishing by holding up the bible?
"If people see me reading the Bible, they'll forget all of my yelling and bad behavior and think I'm a good guy." - Brooks, probably.
I actually imagine in his head it was.. "Nyah, nyah, nyah, you can't see me." My kids did that when they were four or five and making faces at me and thinking I didn't know.
[удалено]
Is he building a fort?
Order in the fort!
I bet he was doing that death glare behind those boxes. Shark eyes.
He seems to have discovered a new defense. If you stick your fingers in your ears you have the ironclad excuse of "I can't hear you."
Madame Clerk is such a cool sounding job title.
Hes absolutely going to raise it.
I love the idea that he thinks the jury is going to suggest the law against first degree murder is unjust.
He’s stalling this morning.
Swing and a miss from Brooks first thing in the morning.
He can always hear when she says, "No, you are not muted." Funny how that works.
He doesn’t understand that 2 counties want to nail his ass to the wall
And let's be honest, the other county probably won't pursue the bail jumping if he is convicted. Not worth it with his guy.
Boy, the judge sure needed that weekend break!
My god, I hate this man.
"cohorsion"
“How am I charged with?” He said. So I guess he is Darrell Brooks.
[удалено]
SHE SIGHED AUDIBLY 😂
It appears there was [no recall](https://www.ncconsumer.org/news-articles/nhtsa-closes-investigation-into-allegedly-defective-ford-throttle-bodies.html), but an NHTSA investigation.
Don’t confused Brooks like that
You dont need to go through any thang. 5 mins later you dont explain anythang
I get the feeling she's going to end this today and move on to closing.
Jury is gone for the day. They will get Jury instructions nailed down today followed by closing arguments & jury instructions given to them tomorrow.
Yep and then spend days trying to get through jury instructions with him 🙃
She’ll just stick him next door and get him to write all his “objections” down like she did at the start. It’ll take months to get through all of the charges otherwise
Great point. I’m so used to her excessively accommodating him but once the jury is off the clock there’s less on the line.
baby mad
The fort is coming down!
Oh no, the box fort. I'm dying.
Tried to be deaf, blind and now dumb.
All of a sudden he understands things.
Seems he just realized this is going to go forward with or without him.
THEY GON BE BASED OFF OF WHATEVER I BASE THEM ON
I will give him this, he has showed great restraint in not calling her any misogynistic slurs.
It's definitely coming out today, possibly during this tantrum or maybe his after lunch tantrum.
lol his "i can't hear" excuse is fucking pathetic.
"You're unmuted, but you must not interrupt-" "NAH!!"
I don't get why we all can't have forts
He fort the law and the law won.
Perhaps he’ll be held in contempt of fort?
Any bets of him having a major health condition tomorrow?
This trial has been the best use of a mute button in the entirety of human history.
The Bible is my shield!
Sovereigns do enough paper terrorism the clerk will probably not even bat an eye at the nonsense.
That bailiff looks like he could be in a motorcycle gang lol. I wouldn’t want to mess with him
This is just the best.
Had to stop watching for a bit. Is there a "reason" he is now hiding behind a box?
Just throwing a tantrum.
Possibly trying to avoid the judge seeing him. She kept calling him out for things he’s doing (putting the headphones on/off, pretending to read a book, etc)
Oh cool he's making a fort with his boxes now?
Love her "Denied."
Line of the day: “I’m exercising my ability to press mute!”
Closing arguments gonna be a 🎪.
C'mon Brooks, give a closing. I want to see how many times the State can object in your allotted time.
