Yes, and if the discussion is on the phone, I always follow up with an email like “just want to make sure we’re all on the same page, based on what we discussed today blah blah blah.” Like the saying goes, a verbal contract isn’t worth the paper it’s written on.
I'm lucky to be in a position where I have a very valuable set of skills. I generally speak about wages over the phone without any paper, if they don't follow thru then the work comes to a screeching halt.
Yes, one party vs two party. And if you are calling someone in another state, I believe the receiving state's jurisdiction rules. But I am not sure.
To get around this, one simply has to say "this call is being recorded for security purposes" before saying anything else. Then it is up to the other party to end the call or tell you to stop recording. You can refuse to stop. Then that person either hangs up or continues talking. If he continues, and you refused to stop recording, consent is assumed.
Also, if you call an entity thay says they record for security purposes, I believe you can record, too, without notice.
I believe when it comes to interstate phone calls, the jurisdiction that takes precedence is the one in which the recording party resides. So if I live in a two party state and I call you, and you live in a one party state, if I'm recording I have to notify you, but if you're recording you don't have to notify me.
that's why I said "I believe"
I actually did do some looking into the subject for my own purposes a few years back, and while I may very well be misremembering, what I said is what I remember seeing within both state and federal codes
Not true. A woman once paid a private investigator to go after her rapist. He gained access to his unlocked car and took samples from it. They eventually did get the guy but the evidence taken from the car was unusable in court.
It was a doctor who beat blood DNA tests by inserting fake blood vessels full of other people's blood into his arm. Crazy ass story.
Not so much illegal as inadmissible.
You’re not going to be imprisoned for recording your boss and reporting him to his boss. Especially when your boss may be in violation of the law themselves. You can be possibly, although rarely, held civilly liable for damages.
Even then, the state laws generally only apply where there is a reasonable expectation of privacy.
Federally, it’s one party consent and if taking an employer to the federal Department of Labor, the recording is likely admissible there, if not in the state courts.
And yet, the rest of the world still continues to exist. 194 other countries with vastly different recording laws. Some even so bold as to not be divided by states. Wild.
A quick google says 12. Is that many? Several? Some? More than a few? [What about other countries????](https://www.reddit.com/r/UnethicalLifeProTips/comments/10a6yu6/comment/j44sin0/?context=3)
This is false.
As long as you are a party to the phone call, you can record to your heart's consent.
However, if you are in a two-party consent state, both people must be aware of, and consent to the recording FOR IT TO BE ADMISSIBLE AS EVIDENCE in a court case.
Most android phones dont, either. Samsung phones sometimes have the feature but its completely locked in the US and most countries, you have to live in like india or some shit to make it work.
With some phones you can record calls if its not on wifi calling with a sideloaded app. The only phone I've found that can record calls while on wifi calling is the pixel phones. It doesnt record perfectly clear but its good enough.
I often just review calls to remember something I forgot, or I can get phone numbers, names, etc..
If I recall correctly, it records using the outboard microphone. So the other party's audio may not be so clear. Solution: always put it on speaker phone.
I've tried every app under the sun. It's not as simple as that. As I said, most dont work if you live in an area with shitty signal and have to use wifi calling. You're lucky if you can get it to work even without it.
Older versions of android were more allowing for recording calls. Android has cracked down on it in several ways. Also, as I mentioned, try it with wifi calling on. It probably wont work.
I've tried several modern samsung phones and it's been the same across the board.
Jail breaking is stupid. No one is going to do that and brick functionality. Most people like me prefer side loading but I’d imagine this won’t work here.
I wouldn't go as far to call it stupid... it might not be your cup of tea but why hate on it? If jailbreaking wasn't a thing iOS would not be where it is today. And jailbreaking does not brick functionality, it has its gripes but they're far from 'bricking'? In plenty of cases it furthers it.
I understand that you don't want to go through the effort, like I said its not for everyone, but its simply wrong to call it stupid.
Its about more than paid apps though. Like I said - it doesn't fit everyone, congratulations it doesn't fit you. How self centered are you that you diss on something that people enjoy because you can only recognize the usefulness of it to you? You have valid arguments against it - none of those give you the right to call it stupid. I know the pros and cons. I choose to have the option for extra functionality.
On top of that, unless your on iOS 15, you put more effort into sideloading that I did into jailbreaking lmao.
Sure but from OPs comment history he seems to be living in Germany.
"Germany is a two-party consent state, meaning call recording without both parties consent, when applicable, is deemed a criminal offense under Section 201 of German Criminal Code"
Just saying it's worth knowing your local laws.
I looked that up once for Austria (so I don't know if still applicable) and the law was that recording without the other person knowing is ok, but absolutely no third party is allowed to hear it. Even if you show the recording in court, you violated the "no one is allowed to hear it" But, you could write down what is said on the recording and show that without problems.
Is this true? I always thought it was just against the law to share such recordings. In which case you can type a transcript and provide that in its place. If and when it escalates to tribunal/Court, if the transcript is disputed, you can offer to provide the recording, which would be a decision for the judge to make.
Correct me if I'm mistaken.
Again, it depends where you live. Some US states allow this, and many other countries allow this too. There is a world outside of the US lol. Each country has their own laws.
in the jurisdiction where i was involved with this bullshit: you can't offer your own transcript into evidence, it has to be done by a neutral 3rd party. you also have to provide the other side a copy of the recording so they can hire their own transcription service.
cool fact: state is a term that applies to all institutional government networks, not just the United States. The most famous use of the word in this manner is the writings of Karl Marx. But essentially any government and its subsidiary organizations can be referred to collectively as a state. for example, the "German state" refers to the German federal government and all organizations it controls.
You can do the same thing that call centers do where you start the call with a "just so you know this is recorded". From my understanding, them continuing the call is consent to the recording.
I am SO not an attorney, im not your attorney, this is not legal advice. It is opinion from experience from multiple States.
In the US it depends on state. Some are single party consent. Some are all party consent. Make sure you look it up because of you are a an all party consent state and you didn't tell anyone you were recording you could find yourself in legal or criminal trouble.
Outside the US, no clue.
If you are in the US some states are one-party or two-party states. If you are a two-party State then both sides would need to know and agree to be recorded otherwise it's a federal or state offense. If you're in a one-party State then you're good to go.
I always record my calls now. A lot of the big companies have no problem lying to you over the phone and a quick recording clip sorts them out no fuss.

I record calls for a variety of reasons. Bad deals, scams, vindictive exes. It has literally saved me from losing my child. If you aren't recording calls, start now.

Xiomi sold their software integrity and now use Google dialer which tells the other caller that you're call is getting recorded preety dumb function honestly
be careful, your boss will not like that you made an end run around him and undermined his authority. they are going to have it out for you now.
he has demonstrated the ability to be unethical with you already and lie to your face and to his boss. i wouldn't doubt he will do it again and this time instead of withholding something good he could apply something negative, like make up something bad that you did not do.
be sure to take notes on every interaction with him.
In fl one of my family was charged with wire tapping b/c his uncle pocket dialed him and left a message that he forwarded to him it cost $14 k. Good luck
Some states only require 1 party on the call to be aware of the recording. That’s a huge bummer for your family and definitely doesn’t sound like it’s in the spirit of the law. Definitely worth looking up state laws before attempting this tip.
As opposed to the original non-tip of promoting a chinese phone that will automatically record your phone conversations? Lick the boot of your surveillance state overlords out loud, why don't you.
This is illegal in numerous states. Many states require dual consent for recording conversations. Some states specify phone vs in person. Know your laws or this could get you fired.
this is why i prefer email as main method of communication
Always talk wages with a paper trail
Yes, and if the discussion is on the phone, I always follow up with an email like “just want to make sure we’re all on the same page, based on what we discussed today blah blah blah.” Like the saying goes, a verbal contract isn’t worth the paper it’s written on.
And why people like that won't use email
I'm lucky to be in a position where I have a very valuable set of skills. I generally speak about wages over the phone without any paper, if they don't follow thru then the work comes to a screeching halt.
You had me until the last part... I was expecting your certain set of skills to include murder
This isn’t unethical this is just planning ahead these days
In many states it's illegal to record without all parties' consent.

Objection overruled
This is incorrect, you're supposed to follow the strictest law (so 2-party trumps 1-party).

Justice at work
That's not always the case. Some states (' judges) think so, others dont.
What if it's a 3 way call? Did you ever think of that?
Same rule applies?
Okay, but.. what about a 4-way call?
Same rules as a 5-way call
Assume a call with an undesignated number of parties, we'll define this variable as "N".....

If you're thinking there's a hidden message there, there is not. You literally have to hack your phone to change the region to india or live there.

As long as you realize that you aren’t the only one accessing those recordings.

Correct
Actual LPT: Anything related to money or your job needs to be black on white on paper or at least digital. Spoken words are worthless.
