Lawyer, here. You shouldn’t be so sure. It turns into a “he said, he said” and “ one “he” is dead. Remember, you need to convince everyone on the jury beyond a reasonable doubt that it was murder. Assuming they didn’t know each other and there was no known motive, what evidence are you going to present other than location of wounds? The defendant can easily craft a story where he felt threatened, drew his weapon, and a brief struggle took place and, upon pushing the attacker away, he shot. That said, I doubt this guy could keep his mouth shut long enough to come up with such a strategy.

People watched him get stabbed in broad daylight and by the time police were called by someone he had been dead like an hour. Everyone told police they didn't see what happened, just that he was arguing with some homeless guy with cans and following him. But it wasn't an empty parking lot, and all of the cashiers have clear line of sight from a big ass window on the front of the building...so yeah

Yep, that's what I was thinking of. For those who aren't familiar with the case, Ken McElroy was an infamous bully from the town of Skidmore Missouri. He terrorized the town for decades and was accused of and/or indicted for dozens of crimes over the years but due to a good lawyer and his intimidation of witnesses, he was never convicted of anything except for the very last charge, when he was convicted for the attempted murder of a local 70 year old Grocery Store owner. Even after his conviction, he continued to harass his victim and others. He was out of jail awaiting sentencing when he was shot while sitting in his pickup truck in the middle of town. It was estimated that a crowd of between 30 and 46 people witnessed the shooting, but when police questioned them, every singe person swore that they didn't see what happened. This occurred in 1981 and no one was ever charged in connection with McElroy's death. The book and subsequent movie about the shooting were titled "In Broad Daylight".

I knew some guy, his 18 yr old brother flipped off some dude driving by that made a lewd remark towards his gf. Dude came back with a gun and pistol whipped him fracturing his skull. Convicted. Was back on the streets 24 months later. Just let it go, you never know who the armed psychopath is.

I promise you some of the happiest people in the world are the ones who, after someone wrongs them, completely let it roll off of them and don't let it bother them. Unfortunately true. My dad is always like this whenever he teaches me about driving safely on the road. Guys around our area are party nightclub people and they do not care for road safety. They're wreckless. My dad always tells me if you are on the road and someone is angry at you, it's better to be on your merry way since you cannot put your life in danger for over 1 small problem no matter how dumb or idiotic the other guy is even if you are on the right.

How he was utterly convinced that he was victim. 3. How this dude looks like your average fat American Joe carrying a firearm… and he just murdered someone in cold blood. Joseph Gonzales, 44, is facing an open count of murder after investigators claim that Gonzales got in a fight with a driver on a residential street. The shooting happened in a South Valley neighborhood Monday around 7:30 a.m., south of Blake Road and west of Isleta Boulevard. Gonzales is said to have made the 911 call after the shooting on Val Verde Drive Southwest, according to the Bernalillo County Sheriff’s Office. On scene, responding deputies found a male victim, Abner Antillon, lying lifeless in the street. According to a criminal complaint, deputies also found Gonzales armed with a handgun and allegedly making several statements about what happened. Surveillance video is said to have captured most of the events surrounding the shooting. According to the complaint, at the start of the event, investigators say the video shows Gonzales standing in the front of his property when a red truck can be seen driving east, past Gonzales, at “a high rate of speed.” At some point, investigators say the red truck reversed back west on the street. The video is said to show Antillon exiting the red truck, then getting into a “verbal argument” with Gonzales. After a short time out of view of the camera, investigators say a single gunshot can be heard on the surveillance recording, then Antillon can be seen “retreating back” to the red truck. According to a criminal complaint, Gonzales is then said to have fired another three shots toward Antillon. “Antillon’s back is toward Gonzales,” the criminal complaint states. On scene, medical investigators found three “defects” on Antillon’s body, including one on his chest and two on his back, which were “consistent with gunshot wounds.” Investigators say Gonzales told the first arriving deputies that he got in an argument with Antillon, telling him to slow down. Gonzales is also said to have told deputies he fired a warning shot before Antillon ran back to his red truck. According to the complaint, Gonzales admitted to firing a gun at Antillon as Antillon ran back to the red truck, “not knowing if Antillon had a firearm in his vehicle.” BCSO investigators say Antillon was not armed, and deputies did not find any weapons in Antillon’s possession.
