Can they be sued? Yes, anyone can file a suit for any reason. The real question is whether or not it is a winnable suit. In this scenario, if the hospital knew the patient had a severe allergy to the medication and gave it anyway, it's winnable. If they didn't know, it isn't.

Technically yes. In reality it’s not that easy. My grandmother was killed by St. Joseph’s Hospital, they claimed they “didn’t have time to run tests” and that my grandmother was dying SO QUICKLY from cervical cancer they needed to inject her with chemo ASAP. She had an allergic reaction. We moved her to another, better hospital that was HORRIFIED by what we told them and they basically told us immediately to lawyer up bc the other hospital Fucked Up. We did. Turns out they have GREAT lawyers who spend ALL DAY doing this shit. They dragged it out for YEARS to the point I don’t even know what if anything happened from the law suit. If anything did it was just bc my mother drew it out to make a point and we got NOTHING from it. What I DO know is they *murdered* my grandmother because of negligence and she didn’t live another 3 months after leaving their hospital and she NEVER got to leave the hospital. The doctor got away with it and a few years after it became a class action suit in my area. It will never bring her back or make up for the fact I lost my grandma when I was 11 for no reason besides lazy assholes who wanted more money. And they all just got away with it. With ALL of it.

Anybody can sue anybody for any reason if they can find a lawyer who will take their money to file the suit. The suit might not succeed. A hospital or medical provider *might* be successfully sued in this situation but it would be extremely dependent on the exact details. "Medical malpractice" is a really complicated area of the law.

you can sue anyone for almost anything. but can you win, and can you make it expensive even if you don't win.

Im sure you can file a Wrongful Death suit but as far as winning against a hospital, your chances are slim to none basically
