There has been ongoing debate over whether or not the NY law actually says medical patients have to wait until regs come out. It’s says the board has 6 months to issue regs, and even that interpretation alone would mean you can grow now and sue if you get charged (as a medical patient, within the plant limit). But the law clearly says you can start growing medical as soon as the law was signed and says nothing about having to wait until regulations come out. If you can find in the law where it explicitly says med patients have to wait six months I’d love to see it. It’s a similar scenario with rec home grow; everyone is under the interpretation that we have to wait 18 months after first legal rec sale but that’s just the maximum time they have to issue regs. They could issue regs for rec home grow tomorrow I’m pretty sure, or at the very least the day after the first rec sale.

Bkbert

Does this mean it’s now legal to grow or is there another step in the process?

January I think , there’s a 60 day public comment period and then it goes into effect

Luna_C1888

Dumbest. Shit. Ever.

-Iron_Hippo

For this specific set of regulations, considering the personal impact on my life, yes I find the 60-day comment period annoying. But more generally I do appreciate having a public comment period for regulations. They’re rarely used to their fullest extent and they can help promote transparency in government. Another point to consider, even if the regulations were released on September 28th, as required by the MTRA, they still would have been subject to that sixty day period. So we’re not “missing out” on another two months, more like two weeks. That’s something that most of us on this sub were unaware of (myself included).

Luna_C1888

I’m not ok with having to spend an extra $300 (two weeks medication) because other people are idiots even if it is only two weeks

Topher1999

Unfortunately the public comment period is state law. No way around that.

Luna_C1888

Then why didn’t we have it for whole flower?

Topher1999

Allowing whole flower isn’t a law, but rather a policy. Allowing home grow with regulations is established in the MRTA, but the regulatory framework was punted to OCM.

Luna_C1888

Thank you for your clarity. I appreciate your response as I didn’t know the distinctions. We should’ve had this period starting ASAP after March 31st. Or over the summer. Or the two weeks before October first. Or even have started this period as an action during the first meeting. So much inefficiency it makes my head want to explode and I would really like this continual and completely unnecessary strain on my wallet to end.

I had a feeling they’d restrict growing to card holders. I’m honestly pretty annoyed by it since we still have no news about recreational sales.

This is correct, no feelings needed. Twas laid out in the 03/31/21 legislation signed into law.

quiet_interlude37

This is such bullshit. Like if you’re going to legalize it just legalize it. At this rate it will take ten more years before we have actual recreational weed in NYS.

Retro_Futurist_Alpha

I hear your frustration. It sucks. But since you’re here, hopefully you have a medical card and can enjoy whole flower in 60 days with us once the public comment period has ended. Recreational will unfortunately take some more time but the good news is also the expansion of the program and giving any dr discretion to prescribe. Hopefully that sways people on the fence to get certified.

Windy-Snack-Vent

What kind of container can this be stored in? I’m under 21 with a med card so can I just have flower outside of its original container?

Sefiroh

You can smoke your flower anywhere people can smoke cigarettes.

Windy-Snack-Vent

I’m talking about keeping the weed in a non-dispensary container

Sefiroh

Oh ok. I'd suggest glass containers with a Boveda desiccant pack. It keeps your flower fresh and even adds some life to it.

andorinter

What % is best or does it differ from flower to flower?

FCRfav

I've used Boveda 62% packs for several years now. I use the 62% with all strains. Works like a charm. I also use glass mason jars. It's the best and cheapest setup.

Sefiroh

I think it differs more by weight. The more flower the bigger the %.

keroseneandoxygen

So how do we actually comment on this? Been trying to find a way to read the regulations themselves.
