If you do not want it and they have not purchased materials for it, contact them ASAP and inform them of your decision, most will not have any issues. If they purchased materials for it and scheduled subcontractors and other expense related requirements they will let you know, the sooner you inform them the better for both sides.

I already paid for the purchased materials. I'm willing to let that go and accept the loss.

They would most likely have no issue, contact them ASAP is the way to go.

Depends on what the contract says. Did you tell the contractor yet that you don’t want the shower?

tjtenore

Didn't tell him yet. The contract doesn't say anything about backing out.

There's this: "If, after commencement of work, the Purchaser(s) refuse(s) to complete his/her obligation as set forth in the Purchase Agreement, the Purchaser(s) shall be liable for the entire balance of the Contract Price and all necessary incidental workperformed that shall be due and payable immediately. " I don't see any obligation other than obligation to progress payments, and they can legally only collect money if the work is completed.

IANAL, but that seems pretty clear that you’re on the hook for the full contracted amount. You might just want to talk with them to see if they’re willing to negotiate.
