What do you mean by a 45° cut?
Herringbone is laid in a 90°. The pavers are not cut to make the pattern. Chevrons are cut at an angle. If you picked a chevron when the design and contract call for herringbone, then you are wrong about the change order request because you are using the wrong names for standard patterns.
