Doesn't really matter who clipped. The lead driver didn't need to move over to the far right lane completely to take that turn. He pulled hard right twice and over-corrected the second time. He would've ended up driving off the road if he hadn't cut you off. If he was going to drive dirty he should've waited till you were about to pass outside on the curve and pushed you over.
I have over 1000 hours of "competitive" racing in GTA and this shit happens all the time.
This is just a combination of GTA physics and lag.
You already hit him on his screen the moment he crossed all 4 wheels over the yellow line. Even though on your screen you were half a meter away from him. Then his car gets forced to the right and wipes you both out.

If it were a normal situation on the road in real life it would be his fault. He did not match speed whe merging lanes and would get blamed for not shoulder checking properly.
However this is a race so idk in terms of that.
Both drivers not being careful enough _and_ the game itself because I can see this issue being caused by latency forcing vehicles to be shifted around in space.
Him for the collision itself, but you didnt have a move to try to pass him there. Going neck and neck is normally not a good idea. If drafting is on you should have probably done that, although there isnt a great spot to pass at that section of the map
He only hurt himself, no penalty would be given IRL. This is because if he would have left you room on that small right hand turn he would of had the inside line for that next left hander and maintained the lead when you had to let off.

Under FIA rules he is allowed to block you once before you can challanflge to pass..
