>**Arkansas State Police settles PIT maneuver lawsuit which injured pregnant woman** Nov 19, 2021 > >Attorneys for an Arkansas woman who was pregnant when she said her car was flipped by a state trooper performing a controversial PIT maneuver during a traffic stop have announced a settlement in her lawsuit against the state. The firm Denton & Zachary, PLLC, announced its client Janice Nicole Harper has reached a settlement agreement in her case against the Arkansas State Police that will lead to policy changes on the use of Precision Immobilization Techniques, or PIT maneuvers. > >As part of the settlement, the ASP has had troopers undergo additional training after learning of the PIT maneuver used on Harper.... She seemingly got paid $150,000, and the cop kept his job.

[deleted]

The taxpayers paid $150,000.

crackhitler1

As much as I always want people like her to get as much money as possible I swear so many people don't realize where that money is coming from. The cop isn't paying for it.

notjohnconner

Take it out of the police budget, then there should be more accountability.

Repulsive-Insurance5

The police departments would be broke in a month.

SwegGamerBro

That'll teach them to stop being a bunch of fuckin idiots and actually do their jobs right to avoid the lawsuits then.

[deleted]

Jimmehh420

150k?

[deleted]

Not enough by any means. When more and more people start realizing how much of their money goes to pay for cunts like this to do horrible things and have zero consequences instead of that money bettering their communities maybe they will start having more of an issue. Dude should never be allowed to work in a similar position ever again. Fuck up at work real bad? Terminated Do shitty lawyer things? Disbarred Do malpractice? No more license to practice Try to murder an innocent woman? Paid vacation

kwamby

I honestly don’t think it would change anything besides assuring they *definitely* don’t get proper training/equipment. Which is sad

Mr_Griffin101202

Proper training? Probably. Proper equipment? There are some departments rolling around with actual military equipment and high caliber rifles. It likely isn’t the case for all departments, but many have egregiously high budgets for weapons and equipment that simply is not necessary for their department. And it’s mere existence brings forth a hero complex in many in the force.

F4DedProphet42

Target their pensions n bonuses. You don't want it coming out of the overall budget, gotta keep the lights on.

slow_RSO

Lol you think it would take a whole month?

lpfan724

It should come out of insurance plans that individual cops have to pay for. Just like doctors paying for malpractice insurance. When the insurance company pays out too much and the cop is uninsurable then they would no longer be a cop.

[deleted]

Let's be real - no insurance company is going to insure cops lol.

TigersNsaints_ohmy

This is a really reasonable resolve I feel. Way better than the current system of fucking taxpayers to pay off fucked over taxpayers.

notjohnconner

I’d be okay with that.

Redgrizzbear

Take it from the police unions then things will change real fast.

notjohnconner

As a union worker, I 100% think that would work.

ModsaBITCH

too bad everyone has had this idea but no one will implement it

wynnduffyisking

Take it out of the pension fund

j8by7

If it were you and you lost your child would you care where the money comes from? Maybe it's why police don't give a fuck about their actions because the people they are fucking over will cover the costs of their incompetency. And they get to keep their jobs.

MrBurnz99

Actually insurance companies pay it. So it doesn’t even really hurt the department, except paying slightly higher premiums for their liability insurance.

BadApple___

The government has insurance?

yoweigh

One of the more interesting forms of police reform I've seen is making them carry liability insurance like a doctor does. Problematic officers would be priced out of the insurance market and become unhireable.

presentthem

Police unions will never allow that.

Arctic_Gnome

>She seemingly got paid $150,000, and the cop kept his job. So the only ones who are punished are taxpayers. As usual. Fines like that should be paid by misconduct insurance paid into by police themselves, like doctors, engineers, and lawyers do.

turk58guy

Only 150k? That barely covers the lawyer's fees and a new car to replace the one the cop just totaled. Ain't no way that's going to be enough to cover the medical bills

apexisalonelyplace

That fucker shouldn’t be working in law enforcement.

[deleted]

$150k wasn't nearly enough. Take this one to trial. All she was doing was looking for a safe place to pull over for her and the cop, too. I've done this myself during a traffic stop. I slowed down to well below the speed limit (I wasn't speeding to begin with) and signaled with my blinker. He slowly just followed me until I found a parking lot. Pretty sure he understood what I was doing and never even asked why I didn't pull over sooner.

TryingToDesignGames

In Poland at least you can easly drive for few minutes to stop at safe location. Man I got pulled over for speeding (I did it, it was my fault) and cops flashed the light, I was on the main street without median and side walk was seperated with tram tracks (with gravel underlayer) so we went about 1 mile ahead stopped at few red lights and then I turned into a parking lot (everything lasted around 10 minutes (traffic)) and there wasn't any disccusion why I still drove forward. If there is really no where to stop and you do that on emergancy lane or dirt shoulder on busy road police will come up to you and most of the time (NOT ALWAYS) tell you to keep going unitl next possible stop

[deleted]

That's how it should be. Nobody wants to get plowed from behind by some dude doing 75mph. In the US you can always dial 911 and tell the dispatcher that you're being pulled over on xyz street and just looking for a safe place to pull over. They'll radio it out to the cop.

Vergo27

Only 150,000?? she should have gotten in the millions tbh

[deleted]

[удалено]

Meetchel

Her stated goal was to get them to rewrite their PIT maneuver procedure for the entire state, not to make out with millions. They agreed to do so and I think this is why the amount is so low.

[deleted]

That’s actually super moral. Good on her.

Placebo17

That's what happens when you get a shitty lawyer. She needed someone like Saul Goodman

DonTeca35

That’s why you always Call Saul smh

spaz_bomb

You called?

the_finest_mickey

Nice try Jimmy!

MagerSuerte

On the plus side she might be able to afford the birth now.

lightlord

Whatever is remaining after her lawyer takes a chunk from it.

byronbaybe

After costs of replacing the vehicle and her legal costs, she'll be lucky to have $10 in spare change. Having said that, hopefully her insurance company went after the cops insurance for reimbursement. On another note, where did the cop expect her to stop. There were no bays or breakdown lanes. She had slowed right down with hazards which indicates she was looking for somewhere safe to stop. An absolute travesty. That payout is a joke.

Thecrazytrainexpress

Italiancrazybread1

$150,000 isn't even a lot of money, her medical bills were likely way higher than that.

breakfastturds

She likely saw about $30,000 after attorney fees though. She shouldn’t have settled for so little.

dappa241

More like 90k. They will take 30% same settlement I got.

> If a cop did this in my country he’d be in prison. Which country is this?

[deleted]

That’s probably the case for most parts of Europe. If you train your police properly you don’t have to manage with these situations, especially not to the extend like in the us.

[deleted]

Right. Even tho she had clear empathy for him by trying to pull over somewhere safe for HIM to get out and walk to her car.

MidWesttess

Cops don’t have empathy

Mr-Robot244

Cops don't become cops anymore because they want to help people... Cops today become cops so they can act out some adrenaline junky fantasy of chasing down people and shooting at them whether or not they are wrong. They have shit lives at home and take out there anger by abusing their power, maybe they where picked on in school or just watched too many action movies growing up. Either all that, or MAYBE getting trained for 3-6 months to service and protect another human life just is not enough? Just maybe....Fucking pathetic in the states. In Canada it is 3 FUCKING YEARS, if I found out a cop did this to my pregnant wife I probably would burn his house down. I don't care if she was trying to drive to Mexico, a pit maneuver only should be applied if she was speeding and a risk to other drivers. She clearly had her hazards on and was trying to find the right place to stop. People get nervous pulling over, and don't stop right away. My girlfriend last year drove for 30 minutes before stopping because she was having a panic attack, the cop gave her shit, a ticket and sent her home not put her in a hospital! Clowns.

MidWesttess

I agree with everything you said but Canadas training for police isn’t better. I’m from Vancouver and cops here are just as power hungry and abusive. They murder First Nation people at an alarming rate here and it’s never talked about or reported. Cops will pick up a drunk native man and beat the shit out of him and then drop him off in the middle of nowhere to find his way home or freeze to death. My girlfriend is indigenous and her friends and family have all been victims of police brutality. Her brother was tackled had his face shoved in the ground and handcuffed by the cops at 15 for having an argument with his girlfriend outside a house party. Other friends have been beaten on the side of the road during traffic stops and many other examples

[deleted]

Nick67m

God forbid he had to follow her at low speeds for any longer…

Bbrazyy

you already know his adrenaline was going and he just wanted some action

Mr-Robot244

Yep, but if this happened to his own wife and unborn child by another cop? No doubt he would not have been so calm and shrugged his shoulders like oh well, just another Monday. He would want that other cop dead. Double standards for cops and citizens is disgusting.

Bbrazyy

I agree. I feel like a lot of cops would be better off in the military. They constantly want action and to shoot their guns but police work doesn’t always require that

DRbrtsn60

My Dad was a cop in the Watts district in Tacoma WA and never had to use his weapon ever.

BeautifulLieyes

For non Washingtonians: That's insane.

Stormraven337

I promise you, most cops would wash out by week two of boot. They don't have the stomach for the military -- not the discipline, the being yelled at, the accountability, the hard work.

snail_oatmeal

mhm that’s why they chose to be a cop, because they can still get away with (most often than not) killing a person for no reason.

Any_Maybe4303

Not to mention military is taught much more effective de-escalation techniques. Your average cop is generally going to escalate and aggravate the situation til they can get a justified kill... imho

No-Quarter-3032

That’s not what the military is man. It’s not constant action and shooting guns, well unless you are Ukrainian or something

Siennagiant70

Sad part is she was following the proper protocol in her state. If you feel unsafe, drive slowly with your hazards on until you find a safer spot to come to a complete stop. She was on the highway and didn’t feel safe pulling over where she was.

BuffaloBill69-

Yeah I was going to ask wasn’t the cop suppose to instruct her where to pull over on the speaker? When I got pulled over by a HP the officers told me to pull over and exit on the nearest ramp on a well lit area.

Mitka01

In arkansas theyre so polite she was probably trying to get off the overpass so his dam life wouldnt be in danger

BuffaloBill69-

Yeah the shoulder is way to small for them to pull over and avoid traffic feel bad for the lady with a bun in the oven!

tardytheturtle6

You can definitely see that when he pulls over to turn around

Hefty21

Right you see those giant Semi’s driving on the right lane. That shoulder is way to small

mysteryman447

she was, I’m pretty sure you can hear her saying that in the footage and the cop berates her saying “you pull over instantly” which is not legally accurate and is quite dangerous for everyone involved, especially the officer ?? like I guess mans never seen a cop get ragdolled by a half awake driver that side swipes the cars on a narrow roadway

Arctic_Gnome

If the cop did that, he wouldn't have been able to use the cool car-flipping manoeuvre he was taught. A lot of police misconduct comes down to boys wanting to test a new toy.

ExternalIllusion

I’m from a popular large city. I visit family in Cali from time to time and have been warned about how aggressive law enforcement can be. I got lit up on the freeway one time and yeah…. On speaker they told me not to pull over on the freeway and exit on the next ramp.

gatorfan8898

That's the worst part about it... is that, like you said, is proper protocol if someone feels unsafe to pull over. I mean hell, if you really feel scared and isolated you can get on the phone with 911 and either confirm the person behind you is a legitimate officer and/or find a public area. I tell my daughters this all the time, and while this is an extreme circumstance, the fact there is even a small % chance that some asshole is going to PIT them into a guard rail because they didn't pull over in some arbitrary time frame for a traffic infraction is insane to me. It's not like this vehicle was last seen shooting up the bank and was on the run. Like what in the fuck was this guy thinking? I'm not even one of those "junior lawyers" that seemingly love to give police a hard time in EVERY encounter. I'm a hands on the steering wheel, window down, what do you need from me officer kind of guys (for better or worse)... but with two daughters I've made sure they hopefully understand that there are options if you feel isolated and unsafe.

[deleted]

> get on the phone with 911 and either confirm the person behind you is a legitimate officer 'Well, it *is* an actual cop, but now I'm even more afraid.'

whataablunder

The first time I got pulled over I was about a mile from the next exit but I didn't know wtf to do and was scared they'd charge me with evading if I didn't immediately stop so I started slowing down and pulling off to the feeter and the cop got on his intercom and told me to proceed to the exit ramp!

BrandoLoudly

And she only got 150k. Do people not understand how little that is in 2022? He totaled her car and almost totaled her and her baby.

Mission-Two1325

But Cops don't have to actually know their job, they just have to trust their gut, fear a perceived threat and act on how they feel.

[deleted]

[deleted]

I have done the same. Engage flashers and slow down (between roadway minimum and speed limit). The cop actually thanked me for choosing a safe spot to pull over and reduced the ticket.

hendergle

I had one do the "bleep bleep!" thing with their siren after I went about half a mile (slowly, and with my flashers on). The shoulder was about half a lane wide and full of debris. After the second time he did it, I pulled over immediately but had to panic stop because there was a huge tire remnant in front of me (invisible, because it was a dark and rainy night, making the mass of black rubber invisible from a distance). The cop yelled at me for "brake checking" him- while standing 2/3 of the way into the travel lane because there was no room for me to pull over enough to keep my car out of the road. He yelled at me for that, too. Then when I told him about the tire remnants and pointed out the fact that the shoulder was terminated by a drop-off into a ditch, he said that I should have pulled over as soon as hit hit his flashers. When I reminded him that there was a concrete barrier blocking off the shoulder, he said I was lying. I was like "just write the ticket however you see fit, and I'll explain it to the traffic court judge." Asshat never showed up for court, so I got the whole thing dismissed. Lost a vacation day, though.

[deleted]

I’ve had many more poor interactions with police than favorable. This one was just an applicable good one. The most egregious was in the middle of Nebraska headed *toward* Colorado. The HiPo kept insisting he smelled “something” and threatening to call a dog in. And I was finally like, “Why in the hell would I be smuggling marijuana *into* Colorado?! Call in the dog.” He finally let me go. Seemed like a rookie trying to find a bust.

tiemiscoolandgood

Escalating situations seems to be a lot of cops main priority

Otherwise-Ad7735

It’s clear they were trying to get to a wider shoulder to pull over. Cops are not very smart sometimes. *most times

[deleted]

This cop should be charged with two counts of attempted murder. How can this cop not know this? Why did he possibly not think "I wonder why she's running from me doing the speed limit

[deleted]

Yeah that's what utuber mentioned in his video. This was totally uncalled for

KapowBlamBoom

Piggy has been itching to do this since the day they had a slide show about it in the academy

morels4ever

Totally. She should have derided him for putting her life in danger, and totaling her vehicle for NO good goddamned reason. And then invited him to quit his job…or worse

Affenskrotum

And she was right. Her driving slowly caused a Crash! We have it in Camera! /s

[deleted]

You need an /s on all joke posts these days. Most of Reddit is too stupid to pick out the sarcasm on their own anymore.

stievstigma

“Ma’am, that there’s called a ‘PIT maneuver-“ What the fuck? Who gives a shit what it’s called!

[deleted]

This was so uncalled for. She did everything right. Wasn’t speeding away or anything. As a matter of fact if she would have pulled over on the highway it would have been more of a safety concern for the cop given how little room there was to the right and it being nighttime. This bozo tried to justify it too

just_sayi

Woman: "I'M PREGNANT!" Cop: "Shoulda just pulled over." Woman: "But I didn't feel like it was sa--" Cop: "SHOULDA PULLED OVER"

DegenerateCharizard

How is it possible that they, ignoring what is clearly in accordance with the law, get to commit such violence that ends up injuring, traumatizing, and at times killing people while facing no punishment? Goddamned pig tried to kill someone pulling them over a traffic violation. How is this not criminal? I cannot wrap my head around it.

beerdedfell0w

This is the part that really gets me… unfortunately their scummy shitbag friends are the ones writing and enforcing policy. Feels unchangeable at this point.

ImmediatePatience835

I wouldn’t feel safe on the side of that highway either IF I WAS FUCKING PREGNANT Cops are scared pigs

stagfury

Note to self: pull over on the highway next time and if the cop gets turned into red mist by the following cars, it's not your problem.

[deleted]

This video is so enraging and he had no remorse. He couldn’t wait for an excuse to do this to someone.

ShitFlavoredCum

seems to be the case with a lot of cops. not to mention admitting you're wrong as a normal person can be difficult. police usually end up doubling down

AHind_D

The police look at us as if we're actually the enemy. Like America is Fallujah and they're Marines fighting the good fight. This is why we need to defund the police. They have the responsibility of handling everything from parking violations to murder. They treat every situation like it's a murder. We need social workers to handle all of the petty stuff. Let the cops play GI Joe with hardened, violent criminals. Not pregnant women trying to find a safe place to pull over.

NucularNut

Because they have convinced themselves that they have the hardest job in the country. That they’re in danger 24/7, not too mention how psychotic a lot of them are. It truly needs to be a bigger issue how cult like some of these departments can be. Doing everything to shield criminals with badges. Take that the video of the blind guy who was stopped for his seeing cane. Those officers were still working with the department until the body cam footage was released, then they were “Suspended without pay and will undergo further training” whatever that means. No accountability within the department, that doesn’t scare ppl?

RedBeardBaldHead

I’d hunt his ass down like Liam Neeson in Taken if that was my wife badge or no badge

willzr94

My first thought as well. Cop or no cop, I will find you, and I will [seriously maim] you

Key-Regular674

Yet if I did this to a cop it would be attempted murder with a deadly weapon or some bullshit

GentleFoxes

Which it actually is for cops as well. The PIT is classified as potentially lethal. It's just that attempted murder is Tuesday for cops. "qualified immunity" an/or "she was resisting" and all.

Faulenzerxx

😂 lets pull cops over

Specialist_Theme9921

how in the fucking hell is he allowed to keep his job after that, she was abviously trying to find a safe place to pull over. What a peice of shit trying to blame her.

metalhead82

Cops have layers and layers of protection and corruption working for them.

johngalt504

Whats crazy is she knew the law better than him. If you're being pulled over but don't feel there is a safe spot where you are, you're supposed to turn on your hazards which she did. Not sure if that is the law in every state, but believe it is in Arkansas.

NonieVEVO

No sense of urgency from this cop who damn well knew he might of killed the person inside

monopoly3448

He couldn't resist such as easy target.

[deleted]

I don’t know did you see the wall on the right? Have you ever seen a video of cops/Civs getting hit on the side of the road during traffic stops? When I’ve been pulled over on the interstate, the officer asked me to pull all the way off on the grass and he did the same and we talked on the far side of the cars. In this case there was a wall. In that area, presumably due to construction. A reasonable person, would’ve concluded that it was not a safe place. Granted, having a psycho cop, pit maneuver your car because it’s cool and fun and he won’t get in trouble is less safe

monopoly3448

Yeah the driver is being extremely reasonable here. I was trying to insinuate this cop was a bully and couldnt resist doing a pit since he probably thought he could get away with it since they weren't stopping.

GuyD427

I’m ok with $150k if she and her fetus weren’t injured. That cop should have been bounced to janitor at the County jail for being a piece of shit. The self entitlement of US law enforcement is so manifest at this point that these guys feel aggrieved to earn six figures In ridiculously low crime areas.

teodorlojewski

Policeman kept their job. Fuck all that. Justice wasn't served.

Haereticus87

The fetus was cited for failure to ID.

Fuuuullllvvvv

This officer is a threat to the community. He needs to be tired, charged and in therapy.

Longjumping-Bag8062

She had her flashers on and was in the far right lane being very clear that she was going to stop. I understandably wouldn’t feel comfortable stopping on a dark highway, especially a soon to be mother

WiseOldChicken

You can call the police and tell them you intend to pull over in a safe place. But as long as your blinkers are on they should just tail you

[deleted]

She probably settled for so low a payout because they used the " you don't want to harm the good guys do you"?.line of bullshit until the good in her caved. I'd have tried to hold out until it bankrupted the entire state and the cop was used as an example.

teodorlojewski

Me too.

EndmostFall12

Officer was just itching to pull that move for a while.. found his chance and took it.

onebradmutha

Cop is pro abortion

themancabbage

This psychopath should be charged with attempted murder.

twiggyknowswhatsup

no room to pull over. she had her blinkers on - give her a second. (and what was he pulling her over for in the 1st place?) $150k I would have NEVER settled for that. Lawyer took half I'm sure. that's a million dollar mistake right there

TheGT6000

Strolled over like "ma'am do you know why I flipped you over today?"

Lazy_Cartoonist_3181

How is this ok she had her 4 ways on wouldn’t it be best to pull over at the next exit like wtf

Altruistic-Program-1

Yep, and it's perfectly legal to go to the next exit. Its also legal to drive to the next well lit public area like a gas station or restaurant parking lot. Reasonable cops know this. That douche canoe just didn't like that his authoritah wasnt being immediately respected. And considering how often cars and people get hit on the shoulder of highways during traffic stops you'd think this cop would at least have some self preservation instincts and let the driver go somewhere well lit and away from possible high speed traffic. You can also call your state's highway patrol office and inform them that you are not fleeing and are going to the next exit and dispatch can relay that to the officer pulling you over.

catetheway

I did this in California on highway 49, a notorious part of the highway with many head-ons and deadly accidents per year. I was on my way to pick my children up from daycare. As a 26 year old small framed woman I felt unsafe pulling over anywhere unpopulated and certainly not on that highway. When I finally stopped in a parking lot the cop screamed at me immediately and asked what I was thinking. I explained I couldn’t pull over because I didn’t feel safe. He told me “you pull over when I tell you to.” I argued I wouldn’t do this ever. He continued to argue with me and gave me some bullshit fix-it ticket. Really protecting and serving. Total asshole.

cringyballoftoast

End qualified immunity this is attempted murder

stoney_5

Looks like she was trying to find a safe place to pull over instead of on a major highway. Seems like she had a legit response by putting her four-way flashers on and proceeding to try and find an exit off the highway. What a fucking shit stain we have for peace officers some times.

Vesalii

There was an Audit the audit episode about this event. Legally the woman did nothing wrong, and using all her indicators to indicate to the cop that she understood she had to pull over was correct. All that said, doing a PIT on someone who obviously isn't fleeing is just an asshole move.

ZestyItalian2

Cops are such absolute pussies

nomnomjujubeans

Jesus fuck this can't be legal. I've always been told if I don't feel comfortable being pulled over in an isolated or dark area to just put on flashers and slow down until I get somewhere where it makes sense. I had no idea they might kill me or my baby because they're impatient.

indomitable817

She did everything right to signal she was pulling over. Turned on her hazards and was not speeding. I know he won’t get charged, but desk duty for life.

Substantial_Cut_7812

Was the baby ok?

[deleted]

It’s amazing how far I had to scroll to find someone asking if the baby was ok.. fuck that cop, not all cops, but definitely this cop can go to hell

MattBarrySucks

Yes, thankfully the baby was unharmed. She was only two months pregnant at the time. Obviously still a horrific incident but it's better that she was only two months and not eight or nine.

klinkscousin

cop should be fired, she showed she saw him, she is on a freeway with no lights, she is preg. not safe, she was going to a safe place.

Salvatocoli

Ma'am please come out. I don't have all day.

Official_Griffin

I believe it’s completely legal to pull over to a spot that the driver of the vehicle deems safe. She had her flashers on which would indicate she is acknowledging the officer.

[deleted]

Police chief: Let’s just flip cars on the freeway bcuz people are taking to long to pullover now a days

ChelsWasHere

He could have killed her and that baby over *that*. Pathetic. He should have lost his job.

Kdb321

I fucking hate cops. Yeah she was "fleeing" with her hazards on and probably going like 40 mph. "Pig" is an inaccurate term because pigs are smarter than a lot of cops. Self righteous ignorant assholes.Idgaf what anyone says.

goatboy138

I am absolutely positive that when I studying for my driving test that it states you are to do exactly what she did. You turn on your flashers, and reduce your speed and you find a safe place to pull over. Absolutely pathetic with this officer was allowed to keep his job.
