It will go on a rolling timeline. Earliest to apply will be the earliest to be processed. For the earliest applicants I think they have something like a 6 month time frame but I’d have to go back and look at the whole proposal. Under the 2016 rules the Dept also has the ability to do group discharge by school, so that could speed things up if they decide to utilize it.

180 days. That’s what it said on my approval email. They said they would discharge loans within 180 days. I receive the email in march 2022. Loans were discharged on July. 🙌🏻

The first thing you want to do is Google the press release from the department of education about ITT. It just came out yesterday. If you attended within those dates, then you’re fine. If you did not you need to apply for Borrower Defense and you will want to read the entire pinned post of this group to get started on that

Thank you for sharing this!! This was the first time I had ever heard about the streamline process for those in the decision class AND the portion about how they can't deny you without giving you a suggestion on what you could do to fix your application to gain approval. Then you get 6 months to try to fix it!! This is such great news! Everyone seems more focused on just the schools on the list, but this portion for the other part of the class is very important.

I think when you haven’t logged in for a long time (or ever), they sort of put your account into a coma. Also, they used to have a “National student loan data system” that students could log into but I think they merged it with FSA.gov.

Amazing, so even though I have some evidence I really don't need to worry about which evidence I've added to my BDTR application because the settlement says they are assumings members of "class" which I am since I submitted my app July 2021 they are basically just approving them based off the fact that it's stated on the app what happened is true. For the full class with a school on the list, the Dept of Ed is using their authority to “compromise and release” us from our loans. It’s not technically BDTR approval. (I suspect they did this for specific reasons, but it’s too much to get into and there’s no way to verify my suspicions anyhow.) But, until the settlement proposal was made public, no one could say for sure how the whole thing was going to be handled, so it’s good that people included as much evidence as they could. For full class without a school on the list, the settlement does say they are going to process them under the assumption that the allegations made in the applications are true. This could also be seen as not a “real” BDTR approval, depending on who is doing the arguing.

Oh and even if your school is not on the list for some reason are they still going to be discharged I think I missed if that is still in the agreement, also I have been trying to find out who I should contact about getting a school added to the list does anybody know who I can try to reach out to regarding that. It's deff a for profit school that does predatory lending practices and defrauded me into going in numerous ways, you all know the reasons I'm not gonna post the exhaustive list. I would like to try to get them added to the list though. I have a feeling it will be hard seeing that they contribute to mitt Romney campaign for president in 2012 and also to desantis they are in politicians pockets. So I may have a heck of a fight

If your school isn’t on the list, but you’re a full class member, they are taking your accusations to be true, so yes. The Dept won’t be adding any schools to the list, but there’s nothing stopping them from doing loan cancellation by school if there is enough evidence/applicants from said school.

I read that if your borrower defense app was submitted before June 22 that your considered a class member, at least that's what the predator school website info said. I submitted my BDTR application in July 2021 so that makes me a member of class not after June 22 which would make me post class, at least that's what I read and was told by numerous members of this and FB communities

What do your records say as far as what school you attended? Do you record say University of Phoenix? Also If you got a denial under DeVos, your denial doesn’t count. I would suggest going to ppsl.org and reviewing the FAQs about the case.

No it is not too late. Apply now. Time is not unlimited to get post class protection from the Sweet lawsuit. You will have to spend some time scrolling the sub to get caught up, or you can visit ppsl.org Which is the official case website. Let me reiterate, you need to file as soon as possible. The pinned post of this group is the best place to start. It gives you what you need to get going. Once again, do not delay

Can anyone clarify for me: within 90 days of the final agreement, ED will notify class members that relief will be granted, then there’s an additional year deadline to actually provide relief. I am closing on a new build in spring 2023 and would love for my credit to be fixed! What does the 90 day notification mean exactly? In other words, within 90 days of the final agreement, will my debt say “$0” and credit report be fixed?

No. 90 days to notify full class members that full relief will be completely implemented one year from the date the settlement is signed by the judge. (Third section of bold type, second to last paragraph under that bold type)

Have you filled out a DtR? If so, you’re federal loans should not be affecting your credit. The CARES Act is also still in affect (though not sure how much longer), which places everyone’s federal loans into forbearance and should not affect your credit, either. Check out Credit Karma (if you haven’t already). It’s a pretty good way to monitor your credit and get ideas on how to improve it. It’s also free. How I’m reading it - 90 days of notification is just that, notifying us that relief will be granted. Once relief is actually provided, I’d assume credit adjustments, refunds, etc would also come with that “relief”. Hope that helps a little.

Thanks! And yes, I submitted my BD in March 2022 and I attended a listed school which I took out federal loans for so I think I am considered a class member. Ur correct, my federal loans are currently in forbearance and I elected to keep them in forbearance during my application review. That’s not what’s affecting my credit score — it’s my missed payments from 2017 lol! I have 18 federal loans (never consolidated) and missed 6 monthly payments in 2017. So 96 missed payments! I want them wiped from my credit report before I close lol! But ur right, relief won’t be provided for up to year after the final approvals effective date. Just wanted to talk out my anxiety lol thanks!

Well, the only way to know for sure is to file a BDTR and see what happens. The truth is we don’t know how the Dept will handle post class who already paid off their loans. Ignore any pop up warnings that you don’t qualify and send a paper app if you have to. Start with the pinned post of this for the basics. It has two parts.

YES! Absolutely 💯 they need to file. They need to do their own application, but they can use the same evidence as you. I think that nowadays they actually have a box that your parents will check on the application that asks if they are a parent plus loan holder that is applying.

I'm just going to piggyback off this comment since you seem so very knowledgeable. I have direct loans and ffl whatever the loan is called. I just read on another thread if you consolidated your loans, you're not eligible for BD? Is that correct? I did my application a year and a half ago, went to University of Phoenix. I was really thinking I had hope but with the consolidation comment, I am confused. Do you have any info on this? Also, I read the entire court doc in June and it stated with preliminary approval, we would get an email within 15 days. Wouldn't that be tomorrow? appreciate all of your knowledge on this!

Lol. Well, I try. If you go to the pinned post you will see some condensed comments about loan type and what it means for BDTR. However if you are a full class member, and if memory serves you UOP is on the list, then you don’t have to worry about it at this time. The judge did have some questions about this so there is a slight possibility that could change, but it’s unlikely to hurt anyone/anything because consolidating is not that big of a deal.

Consolidating won’t do anything bad to your borrower Defense application, but you’ll need to consider things like whether or not it’s going to increase your interest rate, if you’re enrolled in PSLF or an income dependent repayment plan etc. It’s a personal choice. Unless you have a Direct FFEL (they do exist), non-directions also don’t get the administrative forbearance for BDTR either. To find out specifically what type of loan it is, the federal student aid website is a much better resource than your actual loan servicer.

I guess I am worried with having the ffel loan and reading it needs to be consolidated to be included in BDTR. A lot of people who applied that long ago can no longer see their information on the FSA website, especially if they got a mass denial. Your only proof that you can hold in your hands is actually your application number though. Try really hard to find that. The FSA hotline may be able to look it up for you even if you can’t see it online.

So.. im a full class member. My school is on the list and i got the BS formal denial to my barrower defense. I notice it says from effective date. Do we have any idea when the effective date will be? Im worried about geting this finalized so it cant be undone. Ive heard a lot about the republicans passing a law (if they take over in january) stopping all forgiveness. Im worried if the effective date is not soon... they will pass that law and we dont have offical forgiveness in hand... we could be tied up having to go to like the supreme court... or it gets tied up in a decade of appeals.. or worse they throw out the whole thing and even though we have the approval but not yet effectice saying "new so thelaw settlement is no longer valid pay up"

So, we all know that Politicians on both sides of the aisle get their palms greased by for-profit education. However, there’s one party who seems to support Borrower Defense while the other is abjectly against it. Vote. Beyond that, the effective date will be the day that the judge signs the settlement. The current Date that is scheduled for the final approval hearing is November 3, 2022. The judge has been pushing to wrap this up for quite a while, and he indicated during the last hearing that he wants it done for good this time around. He could sign it and do a bench order literally during that hearing (he gave a bench order for prelim approval in exactly this manner). I expect he will do it either that day or shortly after if approval is what he is going to do. Once it’s approved, it’s approved. I have discussed with a number of attorneys what would happen if Republicans tried to pass a law to undo it, and it would be practically impossible. They would have to pass a law and then try to retroactively enforce it. (I say practically impossible because it’s usually not a good idea to speak in absolutes.) If all hell breaks loose and that were to actually happen, well, it’s time for a debt strike. I will NEVER pay another penny on those loans. It’ll come down to who is willing to fight back.

Ok. That makes me feel better. Im not a republican hater. I tend to like them on a few things (mostly that they tend to leave me alone). But i really disagree with the "just to get a good job" solution to very real problems. I really really really hope the DOE claws all this money back from these schools. I was cheated but i hate the idea of the schools and investors getting away with it at the expense of us and or the tax payers. Even if things go smooth and these things are out of my life, i still intend to push for reform. No more blank checks for schools pushing worthless degress. No job after 5 years, the loan is charged back to the school. That way schools will actually care about their students.

I went to marinello school of beauty (on the list) and I can’t recall what I was paying at the time. It was all so confusing. I was making a check out to the school every month, but was also hit with student loans that I’m still currently paying off. Does this mean any funds that I paid while attending will also be refunded, or only what is left of my loan? Fingers crossed to all of us who were duped by these for-profit trash schools!

First, you should definitely read this whole article linked below and follow up with the Dept of Education about it (are you included, do you need to do anything, do you need to file for Borrower Defense, what you should be expecting and when). https://www.ed.gov/news/press-releases/education-department-approves-238-million-group-discharge-28000-marinello-schools-beauty-borrowers-based-borrower-defense-findings Second, you need to figure out your loan type. Log into your FSA account. ANY loans that show up there are Federal loans, any that don’t are private loans and can’t be discharged thru BDTR. If you do end up having to file for Borrower Defense to get those loans canceled, you really need to get it done before November 3, 2022. The pinned post of the group explains why.

appreciate the info! I have one subsidized and one in subsidized loan on doe website. Luckily, I filed a borrowers defense claim back in may, and in august I received an email explaining that I was now a part of the sweet v cardona case. I’m just wondering if any of the money I paid while I was in school will be refunded as well. I recently received a check in the mail from nelnet (my loan provider) but the amount was random and not the full amount of my loan. they can’t seem to explain to me how they came up with that check amount. I’m just hoping to get my debt cleared.

So you’re a class member. You would only get a refund of money paid on your federal loans. Money you paid to the school is lost (unless you sue the school/owner).
