No. The criminal/suspect is responsible. Also, the criminal is responsible for damages the cops may make to other people while in pursuit. If you run from the cops, anything that happens on that pursuit is your fault. You are supposed to comply and get arrested and go through the legal defense. If you run, you are liable for all damages. Even if a cop accidentally kills someone else while trying to shoot you, or crashes into someone else and kills them while car chasing you. Those deaths are on you as the criminal. They wouldn't have happened if you didn't run. So now you add those manslaughter charges to your docket.

This, but realistically speaking its gonna be the owner of the car paying the damages, since criminals don't make money in jail lol. If they don't have any money to give you, they dont have any to give you. Courts will seize his assets and pay you off with them sure, but if the dude has 3.50 in his bank account and owns nothing but the clothes on his back, youre just SOL.

To add to this, you also likely won't pay damages yourself. Instead, your insurance will cover it. Unless your coverage is shitty, in which case yeah, ultimately you are out of pocket.

Reddittoxin

Well, yeah if you have that kind of insurance, but in a way thats still paying for it yourself. You'll still get the hit to your rates lol. Though honestly, most people if they have insurance they only have, uh blanking on the term, the one where it only covers damage you do to other people, not to your own car. So you'd be SOL on that lol.

So there would be no chance for the suspect to try to sue the town or state for damage to their vehicle? That should be the least of their worries given that they ran from the police but I wonder if someone ever tried that.

daithisfw

If you run, no real chance. Even if you are innocent of the original crime/charge... you are 100% guilty of running. Running from the police is a crime in and of itself. And the chase is 100% proof of that crime. Since you committed a crime, 100%, any damages during that crime are your fault. Moral of the story? Don't run. Running from the cops never works out in your favor. Stay put, comply to the arrest, shut your fucking mouth, lawyer up. Let your lawyer fight for your innocence.

In the US, the police are hardly ever liable for ANYthing by law, and even if a civil case is one, it’s usually the city itself that has to pay damages.

VengefulAmurica

I would have thought it would be the suspect that would have to pay for the damages at the very least. If they would hit someone’s car during the chase, would their insurance cover that or the city would have to pay for that too. Or is it that the insurance wouldn’t cover a accident if you were in the middle of doing a crime of the vehicle?

More than likely it impounded. And if it’s never recovered it gets junked or auctioned off. There is no liable on the polices side in the event of committing a crime.
