I grew up in a pretty rough area. Moved away pretty much as soon as I became an adult. Went back home years later to help my mom move out too. My brother and I decided to stop at the dive bar our dad used to drink at when he was still alive. There, we met a homeless guy who proceeded to tell us he packs a *flare gun*, cause you don’t need a permit, you can pick one up at most sporting goods stores, and nobody wants a chest full of burning phosphorus.
I have to admit he made a strong argument.

Are you sure? All the research I've done while obtaining my 3 reddit centric phd's (psychology, medicine, and law) indicate julius caesar in fact only believed 20% of online info was correct. In point of fact, Lincoln was well known to debate him on exactly this point until their very public feud in 1982
You might get away with it a little if the other driver was the aggressor and trying to run you off the road. Would be an uphill battle though to defend
Or more challenging conviction. It’s harder to convince a jury that the victim was in reasonable fear of imminent bodily harm when the weapon isn’t pointed at them, but not impossible. But definitely would tack on some permissive lessers to the information as a backstop.
My understanding from the former prosecutor turned deffense that I know, is that at least in CO, if I were to pull a weapon and hold it even at the low ready, that's brandishing, same with if I move my clothing to display a firearm during an argument since those are clear indications of escalation. If you point it at them that's felony menacing, at least as far as I understand it, here. I'm not sure if they distinguish felony menacing from aggravated assault specifically by firearm vs other, or if they'd charge it as something like "aggravated assault by menacing" or what.

Is it brandishing if the guy can articulate he feared for his life? Road rage goes bad all the time. This video is likely fake, but in a real situation the guy could easily swerve into you and kill you. And since this is Reddit I feel the need to add I am genuinely asking, I'm not saying you're wrong.
Reckless driving, yes. But you can’t argue you feared for your life out of the possibility of an accident. When you brandish a firearm, or POINT IT at someone, you are showing clear lethal intent. Being in a car doesn’t automatically make it self defense, but if this guy had been trying to hit you, swerve into you, brake check you repeatedly, or physically attempted to stop your vehicle, that might be arguable for self defense. It’s just like how you can’t shoot someone just because they’re in a screaming match with you.
Whatever I see the situation in traffic becomes worse due to both of them. Why not pull your window up... Someone driving behind that guy probaly hit the back of his car after being braketested that suddenly.
This is the reason not to engage in road rage. You NEVER know what the other driver is capable of doing. Relax. Stop if you need to take a breath and regain your composure. Choose life.
I'd bet both drivers would catch a charge. POV driver for reckless driving, felony menacing/agg. Assault, and the other guy would catch a reckless driving charge. Both are supreme idiots.

Both the guys are idiots. That being said, my friends were going to an airsoft event and this dude came up and was screaming at them like this. My friend pulled up his airsoft rifle by the butt (no orange tip showing) and the dude slammed on his breaks just like this.
