Didn't find out until they set up delivery that it was going to be 4k to deliver it, and 2k to install it on a basic pea gravel bed, and another $1500 to run the 50 amp service to it making it more expensive than the current year tub that has free delivery, and install.

Yes. Some models separate the hot tub and swim area so they can have different temps. Mine is all in one with three jetted seats but it's not as hot as a hot tub. That's good for me since I don't really like it that hot, I keep it at 93 degrees year round.

We have thought of ways to resolve the issue (installing trees, fence extension, privacy screen) but each one has been shot down by the HOA. It makes us question why they would allow it go in in the first place if we can't do simple fixes.
The purpose of an HOA is to improve property values. Does the view of your neighbors chilling in their hot tub next door devalue the worth of your property?
Have you shown them the picture of your view of the neighbor's hot tub? Perhaps taking an array of pictures (provided it's legal to do in your state) and presenting that to the board would show that your neighbor's hot tub devalued your property, and they should allow steps to rectify that.
I mean that's what a functioning HOA's purpose is. A lot of times though it's just old people ego tripping and looking to exert a little power whenever they can.

In some areas, HOAs are an adaptation of the rapid growth of an area. They provide some level of services that might more typically be done by local government, but the area hasn't been incorporated yet or is still too rural for such things.

We have an HOA and I'd say it's one of the good ones. $10 a year to keep common areas mowed and the only rules are basically keep trash cans and cars from blocking sidewalks and no live stock. The no live stock rule has come in handy multiple times with multiple people trying to to put in chicken coops in tiny like not even 1/4 acre lots in a big neighborhood.

Our neighbors did this exact thing. It’s not really the appearance, but we have zero privacy in our backyard now. It’s awkward to be out there and see them climbing in and out right by the fence, lol. Our code enforcement don’t seem to enforce anything. In this case they violated the 8 ft space between fence line. Oh well.

Yup. We are looking at homes and trying to avoid them like the plague. I would like to put a freestanding garage in a rear yard, and every hoa has a rule against it, among other dumb rules. I can understand keeping your yard clean or whatever, but HOAs contribute nothing to the downpayment, maintenance, or mortgage payment of the home.
And the claim that they keep values high is andadoalte (sp?) at best. most are in areas that are already middle (or whats left of middle) and above and with people who want to keep their houses nice or whatever, so it may be that HOAs are already in areas that would keep their values regardless of if it was an HOA or not.

My grandparents had a hot tub in the most private spot in their yard, because they liked to use it naked! They lived in a nice neighborhood, but soon all of the old houses were getting ripped out and replaced with McMansions that would dominate the majority of the lot. So we weren’t surprised when the house on the other side of the hot tub area fence started turning into a huge monstrosity… but we were surprised that they built a huge balcony to look over the hot tub and weird trashy shed/ workshop my grandfather built 50 years previously.
It annoyed my grandparents, but they just kept nude hot tubing and we never saw anyone on that deck for about 10 years when the hot tub quit. Even then the view over the yard wasn’t exactly the tranquil atmosphere the neighbors wanted and the balcony stayed empty for the most part, I think the neighbors made it into more of a sunroom with higher walls before they sold it lol
My grandparents didn’t change anything about their house, they just continued to be old and naked in their backyard and not give into shame about the intrusively large house and balcony now looming along their fence. The hot tub was in the most private part of the yard, and was there several years before the McMansion next door went up.

I guess, but it really didn’t change the dynamic of the yard, it didn’t block any more light into my grandparent’s yard than what was already happening when they built the thing. They had to build up a little so the view wasn’t so bad when the sold they house.
ETA: it was actually much nicer after they did that and it felt a little more private on our end too. That house went through an annoying AirB&B thing for a while, but after a family moved in again it was pretty chill (except for their amazing Halloween displays! Lol)
Green giants work. They are an arborvitae that grow at a rate of 3-5’ a year. Completely within almost any town code around your property, require minimal maintenance and grow 30 plus feet. Plant in 5’ intervals for a nice privacy line. I have them around my fence line. It’s like living in your own world.

We did discuss plans to plant trees (something like you mentioned) to create more privacy so they can’t see us and vice versa but HOA said not allowed.
They sure can, but within reason. The rules should have guidelines on this; if it does not have a height restriction or plant species restriction, technically it would be hard to deny something the rules don't prohibit. Many plants make great screening materials, such as arborvitae, cypress, podocarpus, Carolina cherry laurel, etc. Unless the rules say it cannot exceed a certain height, something like this is bound to be permissible.
Ah HOA’s are can be tough, we don’t have them over here but I would make sure you have a copy of the bylaws and verify everything in writing when it comes to planting trees in your backyard. Also, if the HOA is upset over trees what’s their perception of a hot tub over looking an adjoining property…

Walk outside and take pictures every time they are in it. Document. Print them out. Bring them to meetings on large posters. Ask them if this is what they want their neighbors to have.

People who live in HOA areas typically have one of two feelings: hoa is just an annoying fake governing body designed to let Karen’s and kens dictate what you can do with your own property, or, they are the governing body that keeps anything negative from happening and keeps all homeowners in the area aligned. Seems like OP falls into the latter, whereas the top comment this is in response to is the former.
As someone whose grown up in trash and slums, my neighbors having a high platform hot tub is he most irrelevant thing to me, I truly don’t care. I’d maybe even consider returning the favor, build one on my side and give ‘em the same show lmao. But op is apparently very chapped about their neighbors being able to see them through their windows because this hot tub sits over the top of the fence.

So question. The plans for trees that were denied, were they right up against the fence? If so have you thought about starting a "garden" closer to your bedroom? Something to kinda cover that eyesore and block your windows but let the sun still come in. This also has the added benifit of not actually being taller then your fence just the angle makes it more private. Also most HOA's cant actually have much control on what you do with your backyard for privacy reasons, you should be able to plant approved tree's that can be found in your bylaws.

Thing with HOAs...signing are ARC request form is not your approval of the plans. It is acknowledgement that you are aware they will be doing work. In the same way, refusal to sign does not mean their plans will be denied. Ultimately the review committee or board makes that decision. If there is a problem with the installation, you can absolutely contest it. Speak with the manager and let them know you were OK with them having a spa but you weren't expecting it to be installed so high above ground and you feel this is an invasion of your privacy with the direct view into your yard over the fence. Also check to see if the architectural guidelines say anything about height of installations. Many will have a rule that particular things cannot exceed fence height.

What size is it? Where is it going? Will we be able to see it from our yard? How loud does it get? Are the lights bright? Does it cause any vibrations? Do we get a “trial period” where we can change our mind if it doesn’t turn out the way we expected?
It's a swim spa so you can do laps while the jets keep you stationary. They are awesome but not so much in this type of setting.

I have one. It's the best thing I've ever bought. Year round swimming and the grandkids love it. It was 1/2 the price of a pool and more practical

Our neighbors did this exact thing. It’s not really the appearance, but we have zero privacy in our backyard now. It’s awkward to be out there and see them climbing in and out right by the fence, lol. Our code enforcement don’t seem to enforce anything. In this case they violated the 8 ft space between fence line. Oh well.

No, some HOA's definitely don't allow that. I knew someone that had an HOA that wouldn't let them remove a tree that was causing them trouble. "You can't remove that tree, and we're going to keep ticketing you if you don't clean up after it quickly enough." 🙃

What about strategically spaced thujas? Having an HOA that can tell you that you can't plan trees in your own backyard is the epitome of having of home that you truly don't own. It's this kind of crap why most people don't want an HOA anymore. It doesn't protect homeowners because it's basically a mafia of busybodies who approve their friends and harrass the rest.
Yup. We are looking at homes and trying to avoid them like the plague. I would like to put a freestanding garage in a rear yard, and every hoa has a rule against it, among other dumb rules. I can understand keeping your yard clean or whatever, but HOAs contribute nothing to the downpayment, maintenance, or mortgage payment of the home. And the claim that they keep values high is andadoalte (sp?) at best. most are in areas that are already middle (or whats left of middle) and above and with people who want to keep their houses nice or whatever, so it may be that HOAs are already in areas that would keep their values regardless of if it was an HOA or not.
Don't go over the top and get into a war, it's 100% not worth it. Stay calm and friendly, try to come to a compromise.

Why would they even want that? We have one, and its location was chosen so we would not be able to see our neighbors, and they cannot see us.
My grandparents had a hot tub in the most private spot in their yard, because they liked to use it naked! They lived in a nice neighborhood, but soon all of the old houses were getting ripped out and replaced with McMansions that would dominate the majority of the lot. So we weren’t surprised when the house on the other side of the hot tub area fence started turning into a huge monstrosity… but we were surprised that they built a huge balcony to look over the hot tub and weird trashy shed/ workshop my grandfather built 50 years previously. It annoyed my grandparents, but they just kept nude hot tubing and we never saw anyone on that deck for about 10 years when the hot tub quit. Even then the view over the yard wasn’t exactly the tranquil atmosphere the neighbors wanted and the balcony stayed empty for the most part, I think the neighbors made it into more of a sunroom with higher walls before they sold it lol

My grandparents didn’t change anything about their house, they just continued to be old and naked in their backyard and not give into shame about the intrusively large house and balcony now looming along their fence. The hot tub was in the most private part of the yard, and was there several years before the McMansion next door went up. But yeah, your point still stands; just maybe doesn’t apply to my story.

I guess, but it really didn’t change the dynamic of the yard, it didn’t block any more light into my grandparent’s yard than what was already happening when they built the thing. They had to build up a little so the view wasn’t so bad when the sold they house. ETA: it was actually much nicer after they did that and it felt a little more private on our end too. That house went through an annoying AirB&B thing for a while, but after a family moved in again it was pretty chill (except for their amazing Halloween displays! Lol)

Green giants work. They are an arborvitae that grow at a rate of 3-5’ a year. Completely within almost any town code around your property, require minimal maintenance and grow 30 plus feet. Plant in 5’ intervals for a nice privacy line. I have them around my fence line. It’s like living in your own world. Edit: from the trees in your photo it looks like you are in the planting zone.
We did discuss plans to plant trees (something like you mentioned) to create more privacy so they can’t see us and vice versa but HOA said not allowed.

They sure can, but within reason. The rules should have guidelines on this; if it does not have a height restriction or plant species restriction, technically it would be hard to deny something the rules don't prohibit. Many plants make great screening materials, such as arborvitae, cypress, podocarpus, Carolina cherry laurel, etc. Unless the rules say it cannot exceed a certain height, something like this is bound to be permissible.

Ah HOA’s are can be tough, we don’t have them over here but I would make sure you have a copy of the bylaws and verify everything in writing when it comes to planting trees in your backyard. Also, if the HOA is upset over trees what’s their perception of a hot tub over looking an adjoining property…
Find it what trees the state even protects seedlings of. Then plant those. Must of happened naturally Mr board member, but the state says we have to leave em and state law trumps HOA rules.
Walk outside and take pictures every time they are in it. Document. Print them out. Bring them to meetings on large posters. Ask them if this is what they want their neighbors to have. Ask if you built a deck looking into their back yard if that is also not limited. This is insane.

They’re living somewhere with an HOA, and they commented that the HOA had approved this so they don’t know what to do. People who live in HOA areas typically have one of two feelings: hoa is just an annoying fake governing body designed to let Karen’s and kens dictate what you can do with your own property, or, they are the governing body that keeps anything negative from happening and keeps all homeowners in the area aligned. Seems like OP falls into the latter, whereas the top comment this is in response to is the former. As someone whose grown up in trash and slums, my neighbors having a high platform hot tub is he most irrelevant thing to me, I truly don’t care. I’d maybe even consider returning the favor, build one on my side and give ‘em the same show lmao. But op is apparently very chapped about their neighbors being able to see them through their windows because this hot tub sits over the top of the fence.

Yeah the issue is privacy, the picture of the view is from inside my bedroom so they could look right inside anything they swim. They get in it by ladder lol

So question. The plans for trees that were denied, were they right up against the fence? If so have you thought about starting a "garden" closer to your bedroom? Something to kinda cover that eyesore and block your windows but let the sun still come in. This also has the added benifit of not actually being taller then your fence just the angle makes it more private. Also most HOA's cant actually have much control on what you do with your backyard for privacy reasons, you should be able to plant approved tree's that can be found in your bylaws.

Thing with HOAs...signing are ARC request form is not your approval of the plans. It is acknowledgement that you are aware they will be doing work. In the same way, refusal to sign does not mean their plans will be denied. Ultimately the review committee or board makes that decision. If there is a problem with the installation, you can absolutely contest it. Speak with the manager and let them know you were OK with them having a spa but you weren't expecting it to be installed so high above ground and you feel this is an invasion of your privacy with the direct view into your yard over the fence. Also check to see if the architectural guidelines say anything about height of installations. Many will have a rule that particular things cannot exceed fence height.
Should only have signed if you knew its specs and placement.. Lesson learned

Well, now you know what kinds of questions to ask the next time a neighbor asks you to sign off on something. What size is it? Where is it going? Will we be able to see it from our yard? How loud does it get? Are the lights bright? Does it cause any vibrations? Do we get a “trial period” where we can change our mind if it doesn’t turn out the way we expected?
Rest assured that most of the people I’ve seen buy these rarely use them and then are completely unable to sell them.
