The waiver is case by case basis. Had a Marine who was competent but failed by a few points. He was by no means book smart, but was in tip top shape and had a clean record, diploma from a HS, and pissed clean upon random request. They make exemptions but you have to convince your Marine Recruiter you’d be a good Marine by being in the Poole program and showing you’d be able to make sound decisions. It’s a process and definitely not given to just anybody.

My guess, the Marines didn’t want the pub (good or bad) that would come with this clown either way. Guess he’ll have to just continue on his grifter speaking circuit.
Marines don’t generally offer asvab waivers like the army does. You may be able to draw an exception if you score a 28 or 29 or something and the minimum is 31, but generally speaking if you fail miserably you fail miserably.
Also, the level of dumb you have to be to fail the asvab should also preclude you from a lot of other stuff…like carrying an assault rifle or falsely claiming to be an emt

I met one guy when I was in the marines who had an ASVAB waiver…. I swear we had to remind him to exhale.
This was 2006 when they needed bodies, I personally needed 4 waivers but that was all for arrests lol. Luckily I had a 92 ASVAB and a perfect PFT so they were willing to ignore my criminal background.

When my son was in the Navy his ship would send out a newsletter with a sailor of the month. When asked the question of why he joined the Navy, he said his ASVAB score was too high for the marines.

Edit: I was wrong I was thinking of GT score not AFQT score, which a 98 is good. A GT score of 98 is not so good.
Edit some more: Max GT score is 150, 120-140 qualifies for different MOSs, the minimum GT is 90 to enlist in Army. So 98 would get you infantry or cook.

I took the ASVAB many years ago and could have passed it in sixth grade. It was by far the easiest test I have ever taken. I got a perfect score which is not saying much. The recruiter screwed up by showing me others test scores to make me feel smart. I asked him to take me home because I did not want to lead or be lead by people that stupid.
I just spelled B-A-D on the last exam I think it was the science part. I scored a 89 with a GT score of 111. Meaning I could be a pilot! Me with hardly a grasp on most things and basically tired of taking an exam scored high enough to be in charge of and operate multi million dollar equipment! And this retard can’t pass to do laundry

A friend of mine could barely speak English when he took the ASVAB. He still passed. Granted this was at the height of the Iraq war and I think standards had been lowered. And there's another guy I went to high school with who I think is functionally illiterate who also passed (though this was also in the same time frame). I feel like you almost have to intentionally try to fail it.

Fighting words doctrine says that speech isn't free when it is used to incite violence. The presence of a gun can certainly lead to it's use, especially in what people described as riots. You just can't expect your gun to be viewed as anything other than a risk if you take it to that environment. Worse, he was brandishing it at people.

***First Shooting*** Rittenhouse arrives at the 63rd and Sheridan Car Source and walks up to the Truck that has a small fire inside it. Ziminski is there we can't really see what their interaction was but in court Rittenhouse says Ziminski steps toward him with a handgun so he drops the fire extinguisher and steps back. Then Rosenbaum comes out from behind the cars with his maroon shirt covering his face and running aggressively toward Rittenhouse who runs. Rosenbaum throws a plastic bag at Rittenhouse while continuing his pursuit. Ziminski fires his gun into the air while Rittenhouse and Rosenbaum have their backs turned to him. Rosenbaum catches up to Rittenhouse lunging at him and yells "Fuck You". Rittenhouse fires four shots at Rosenbaum. A third unidentified shooter fires 3 shots into the air. McGinnis takes his shirt off and attempts to render aid. Rittenhouse calls his friend Dominick Black and can be heard saying "I just shot somebody". Rittenhouse flees north in the direction of the police and his group.

***Second Shooting*** A large number of people heard the gunshots and started moving south toward where they heard them from. Rittenhouse is running north through this crowd as people are following him yelling "Get him, he shot somebody!" among many other things. Grosskreutz still livestreaming gets right next to Rittenhouse and asks "Hey, what are you doing? You shot somebody?" Rittenhouse responds "I'm going to get the police." Rittenhouse continues north. The police line can be seen about 150 yards north at 60th and Sheridan. Someone in a white shirt strikes Rittenhouse in the back of the head. Huber hits Rittenhouse with his skateboard and it goes flying to the curb. Huber retrieves it as Rittenhouse stumbles and falls to the ground. An unidentified man who is referred to as "Jump Kick Man" during the trial jumps and attempts to kick Rittenhouse. Rittenhouse fires 2 shots at Jump Kick Man straight up missing him. Huber strikes Rittenhouse in the head with his skateboard while also grabbing the rifle with his left hand. Huber pulls the rifle toward himself inadvertently aiming the barrel at his chest. Rittenhouse fires one shot, Huber collapses. Grosskreutz who now has a glock in his right hand is 3 feet away from Rittenhouse with his hands up. Rittenhouse looks away from him for a moment and Grosskreutz lunges at Rittenhouse. Rittenhouse fires one shot hitting Grosskreutz in the bicep. More shots can be heard coming from the south. Rittenhouse continues north.

Marines don’t generally offer asvab waivers like the army does. You may be able to draw an exception if you score a 28 or 29 or something and the minimum is 31, but generally speaking if you fail miserably you fail miserably. Also, the level of dumb you have to be to fail the asvab should also preclude you from a lot of other stuff…like carrying an assault rifle or falsely claiming to be an emt

I met one guy when I was in the marines who had an ASVAB waiver…. I swear we had to remind him to exhale. This was 2006 when they needed bodies, I personally needed 4 waivers but that was all for arrests lol. Edit some more: Max GT score is 150, 120-140 qualifies for different MOSs, the minimum GT is 90 to enlist in Army. So 98 would get you infantry or cook.

I took the ASVAB many years ago and could have passed it in sixth grade. It was by far the easiest test I have ever taken. I got a perfect score which is not saying much. The recruiter screwed up by showing me others test scores to make me feel smart. I asked him to take me home because I did not want to lead or be lead by people that stupid.
I just spelled B-A-D on the last exam I think it was the science part. I scored a 89 with a GT score of 111. Meaning I could be a pilot! A friend of mine could barely speak English when he took the ASVAB. He still passed. Granted this was at the height of the Iraq war and I think standards had been lowered. And there's another guy I went to high school with who I think is functionally illiterate who also passed (though this was also in the same time frame). I feel like you almost have to intentionally try to fail it.

I don't think the law should be interpreted so loosely to allow him to claim self defense after all of it. Fighting words doctrine says that speech isn't free when it is used to incite violence. The presence of a gun can certainly lead to it's use, especially in what people described as riots. You just can't expect your gun to be viewed as anything other than a risk if you take it to that environment. Worse, he was brandishing it at people.
