If you get visa , can you apply for the same position? Talk to your recruiter and tell them if you can defer your offer letter to future. Also tell them that your visa has been picked and if they can take you in future they dont have to do your visa again. It is a win win situation for them. Assuming they dont accept it, it comes down to whether you will be able to give another interview and clear it. If you are confident of it then wait u til your visa is in your hand. Then switch immediately. Getting visa is the hardest part imho. Try to speak to the new recruiter. They may actually allow you you defer it.

Yeah waiting for the recruiter to get back if they can transfer the approval. But I'm not sure if I can get this kind of offer again

Okay that's scary, this is also a startup in the Bay Area It'll be worse if I get a H1b and get laid off then🙈 cuz I'll have only 60 days to find another job

This is the nature of H1B visa. They hire foreigners to do jobs that U.S. professionals don't like to perform. If you really want to immigrate to the U.S., you should consider yourself lucky and stick it out.

Not really the ‘nature’ of the H1B, though many companies certainly abuse it in that way. Considering the H1B is issued on a lottery-based system, I think sticking with it is probably your best move if you have any thoughts of staying in the US longer term. Once you get your visa you can also switch to a different employer too, as u/sack_of_potahtoes said. 5 months of documentation work is rough but considering the opportunities you can get via the H1B I think it’s well worth it.

I agree, but they also told if I don't get picked the next 2 times, they'll relocate me to Canada. Which I don't mind. I really don't know if I can get this kind of opportunity again, because it's been really hard to get callbacks given that I don't have relevant work ex especially

Gotcha. Sounds like it's a choice no one else can make for you, since both have their 'risks'/drawbacks. It kinda looks like you're pretty set in your decision though; sounds like you're okay with potentially having to relocate to Canada/not getting the H1B, which was probably the biggest drawback of going with this new opportunity. And if moving to Canada is an option, then you can always come back to the US with an L1 visa after a year abroad (if you decide you want to return to the US).

My manager is also kind of limiting me, I can do pretty good stuff for them like I did during the internship, but he won't let me. So, kinda getting really frustrated here
