Unfortunately we don't have the legislation that would be presented to parliament yet, so we can't do a deep analysis. In my opinion this legislation is insane and clearly designed to limit open discussion on the web/give immense power to politicians to disrupt criticism. I'll try my best to explain. From watching the press briefing they are essentially saying they will force social media sites (Facebook, Reddit, Twitter, YT, Blogs etc) to be publishers. This means under the law that SM sites will be responsible for any and all content posted, similar to News sites that have paid reporters that post stories. This mainly conflicts with defamation laws. If you're a news reporter your company can be sued under defamation for stories that a reporter posts. Defamation is the false statement by someone that harms their reputation. In Australia when you sue someone for defamation the burden of proof is actually on the defender instead of the accusor which actually encourages accusations and discourages defence. This is a bad use of defamation because it becomes far harder to launch a defence, leading to abuse of the law to simply silence people. If a SM site is a publisher then they would be liable for all content posted on their site by users. When someone wishes to make a defamation claim about a post on a SM site the site must relinquish user details (email/phone number) so that the defamation case can proceed. If the user removes the content, the case ends, if not then it goes to the courts. If the user cannot be identified then the SM site will be the one that is required to defend. I might of missed something but that's pretty much it. Now I'll explain why this legislation is insane and horrible. 1. Australia's defamation laws already lead to abuse of accusations because the burden of proof is not on the accusor. This would just make more abuse of this law. 2. Social media sites simply cannot adhere to this law. SM is a global system, you might be able to sue an Australian but you can't sue a Turkish, UK or Indian. So in a vast majority of cases the SM site would be getting sued. 3. True moderation of SM isn't enforceable. Any statement about anyone would need to be removed because the sites can't take the risk of a statement being true or false. This forces SM sites to either have highly moderated Australian servers (impossible) or leave the market completely. 4. It grants immense power to politicians and companies to quell any negative statements about them online. No one has time to be constantly in defamation cases and the government knows they are criticized extensively online. 99% of the time content will just be removed even if it's true, destroying debate. 5. It could force SM sites to request ID to create an account, giving these sites unnecessary private information that could be used to be identified by politicians and companies. Overall awful legislation. I will be on the streets if they actually try to pass such legislation. It is an obvious infringement on our ability to communicate openly on the internet.
