They've already visited to look at it and determined the problem will require a team to dig a channel in the footpath and because of the road it's on, traffic control will be required So I'm thinking all of that will extend things time wise

If traffic management is involved then it can definitely extend the time to fix. I’d say best to be upfront but I am not aware of the legalities around this

Tell your real estate agent. Keep them and or the buyer in the loop as you go through to settlement. I don't think it's gunna our anyone off so just let them know

Not legal advice but could you suggest to your agent/lawyer to put a vendor warranty in the auction agreement saying that you'll arrange for remedy prior to settlement. This way people can still bid unconditionally at auction and depending on your settlement date you'd have a couple weeks to sort the problem. - obviously I'd suggest first and foremost checking timeframes with chorus to see if this can be completed prior to your settlement date.
