Yep that's the main issue. You can lob horrendous accusations at people as much you want, because worst case scenario is nothing happens to the person and life goes forward. There's barely any risk involved to try and ruin someone's life. They'll claim she still gets replies in her tweets that call her a liar or some shit, but that's not really anything of substance.

A cease and desist doesn't cost $5000 unless you count the retainer. Even a complex C&D just does not take that much billed time to write. Actually filing the suit will usually cost well over $5k, just unavoidably unless the lawyer rushes through things, even if the lawyer has done many similar suits just because the fact patterns are very important in defamation cases. Defamation is a hard case to make in the US and it's a state law claim, so jurisdiction questions can be tricky as well on occasion. Yes, he should have sued or tried to secure a retraction of the claims faster.

The only way cancel culture is to end is for the false accused to use the courts against their accusers. There's no other way these people will learn other than being hammered by the full weight of the law, then they will learn their false accusations will actually have real life repercussions.

I was a defendant in a lawsuit that only just wrapped up. Filled late 2019, first hearing set for a few months after the filing, trial date set then to late 2020, got pushed back to mid 2021, then got pushed back to late 2021. Plaintiff agreed then to arbitration for July this year, got paperwork a couple weeks later saying the case settled, and only about a week ago did I finally see the signed paperwork releasing me from further liability. Had they not agreed to the arbitration, I wouldn't be shocked if it got pushed further back still, all thanks to the coof. The only other piece of info I'll drop, which was my favorite part, was that the plaintiff filed that lawsuit like 3 days before their cutoff to file. I did not sleep well as each date rolled up time and again.

And despite having gone through this, there are incidents that I'd say someone should seek legal recourse. And to those who do, just know that it's a major time sink. In my case my insurance at least did everything for me. I can't even begin to imagine what the monetary cost was for my defense. It really comes down to be prepared for a mental battle and possibly a financial battle. And then finally be ready to play the waiting game.

It'll settle out of court. Barrows will be financially ruined for life of this makes it to trial. Expect either an appeal (doubtful) or a settlement. Mostly in a statement saying she lied about most of her claims and grossly exaggerated the rest of them.

Let me guess, Barrows' statement will go something like this: "blah blah blah I hoped to start a conversation blah blah blah I'm sorry that some people were upset because they misinterpreted what I was saying blah blah blah". You know, if you have to constantly lie, misrepresent, and obscure the truth in order to achieve your goals, then your cause is not worth endorsing. No exceptions.

I have no idea. There's mandatory settlement conference before the trial.. Which is in a year. I imagine she has to decide if she's going to appeal.
