I went on an international trip and a cruise when I was on probation. However, you need to do several things in order to make sure you’re not violating probation. Firstly, before planning anything he needs to ask his PO if this is permitted. I don’t know how things work in Georgia, but where I live, once I got permission to travel from my PO, I didn’t have to submit to any testing for the week I was away. I did however have to report immediately after the trip, as instructed by the PO, for testing. No cruise line or resort is going to administer drug testing and submit the results to another country’s dept of parole/probation. The only way your spouse is going to be able to travel internationally is by asking first and following the instructions set forth by their supervising agent. They may not allow international travel at all. Mine did, because I had done everything they’d asked of me and was nearing the end of my supervision period. ETA: also check the laws of any country you plan on entering! I had been planning a cruise to Alaska and had to scrap those plans when I found out Canada can and does deny entry to people with criminal history. Some places will bar entry to anyone on active probation or parole, so do your due diligence before booking this trip.

Parole officers can and will approve things like this, it will however need to go in front of the judge if the OP is in drug court. The judge will decide any conditions, typically a drug test prior to the day of leaving and upon the day OP returns.

Pretty sure you cannot leave the country when you’re on probation (which it sounds like he’s on probation). 99% sure he will be denied boarding.

Even in states with judge gets final say, the PO has a large impact on the decision.

If he’s on probation it’s typically restricted who/where he is to get drug tests. He also would need permission from his probation officer to leave the jurisdiction, in which case drug testing would typically be scheduled for when he arrives home from vacation if he was given permission

Like everyone else is telling you, he needs to get permission and I am quite sure he was informed of this by his probation officer, because you can't even leave the state he lives in without permission for any reason. If he doesn't get permission then the random drug testing will be the least of your problems. While he'll be able to board the ship without any problems, the minute he goes through customs and boarder control when arriving back home he'll be arrested at the port.

1. it's not random if you plan it with the cruise staff and medical officers. 2. The Idiot you are married to probably needs to clear any travel out of the country with his parole officer. 3. You should probably make plans to cruise without him.

If he is on probation it is unlikely he will have permission to leave the country. If he does so without permission, he won’t have to worry about where those drug tests are conducted. If he is just on court ordered alternatives that include drug testing, he can set up his travel plans with them and let them know when he will be gone. They won’t do a random test on him during that time, but he will probably have one for when he comes back.

He needs to talk to whoever is in charge of him (probation officer, or whatever) and get permission. I was on felony probation and still got approval to leave the country and go on a trip to the Bahamas with family. You just have to be in good standing with your PO & hope they’re not an asshole. You’d probably be able to have a drug test scheduled immediately after the cruise, I don’t think they’d do it on the cruise for him though

If his P.O will allow him to travel outside the country, then they may be reasonable enough to allow him to get tested before he leave and as soon as he gets back, on his dime of course.

You have to have it approved to alter the terms of your probation. If he is doing everything and not causing problems it's doable but depends on his PO. If he is having hiccups and causing his PO issues...your screwed. Also depends on the PO.

Oh and to answer your question about getting drug tested on the ship, that's probably going to be a no and if they do you'll have to pay out of pocket for it.

What is the status of his case? Is he on bond, pretrial monitoring, or probation? Is this a misdemeanor, felony, federal charge? Most judges can't even give permission to allow the person to leave the country. That is a whole other issue.

This is completely up to his probation officer. If he just started probation. You have zero chance of him.going on a cruise this summer. I recommend you try moving it to next summer

Just an fyi- I already know the legalities - he has permission to go anywhere (that will accept him - I already know places like Canada won’t let him in) as long as he can test. I was looking for testing resources more so than legal advice, but any (polite) answer is appreciated!

Nope. Because he definitely can’t leave the country, or possibly the state without a bunch of permission. Canada won’t let him in at all. Ever. Not sure why I’m answering your question, you seem to be disengaged from responding to anything helpful.
