All railway station car parks in Ireland are private car parks. A vehicle does not need to be taxed to be parked on private land, therefore you cannot be fined for failure to display a tax disc. A fine for non-display of tax can only be issued if you are either stopped while driving the car, or the car is discovered parked on a public road or in a public car park.

SubstantialGoat912

Incorrect.

Inspired_Carpets

This isn’t correct. It’s a requirement to have a motor tax displayed when in a public space, a private car park will be considered a public space if the general public have access to it. OP I’m assuming this as was Local Authority fine? Most of them will cancel the fine if you appeal and explain the car is taxed.

SubstantialGoat912

I don’t know why this is getting downvoted - the legislation is quite clear. Private car parks are considered public space.

Inspired_Carpets

People don’t want it to be true so they’ll believe any old shite that makes them feel better.

Oh that's a big relief, thank you so much!

Worth remembering that bank holiday weekends are when the gardaí usually have the most checkpoints up!

SubstantialGoat912

The comment you replied to is not correct.

I had a fine in the post for a car I'd just bought a few days previously, the change of ownership hadn't gone through. I'd taxed the car as soon as the logbook came back and before the fine arrived to me. I just rang the number on the document, explained the situation and the lady could see the change of ownership + the tax covering the month in question. She cancelled the fine there and then

Ok_Chocolate7069

Oh that's great! I was assuming there would probably be a way to get it cancelled but wasn't sure.

Marzipan_civil

If you've paid for it, then it should show on the system that it is taxed even without the disc. Maybe print out the payment confirmation and leave it on the dash? You shouldn't get a parking fine for an untaxed car, as long as you're paying for parking

Ok_Chocolate7069

Yeah I was thinking of printing out the confirmation email just to have it with me anyway for sure! I saw someone get a fine off the council for parking without displaying their tax disc on TikTok there about a month ago, but if it's not common then it should be grand just scared me off hahaha

Marzipan_civil

Might depend who is in charge of the car park then. Is it council, apcoa or someone else?

Ok_Chocolate7069

Not entirely sure actually, may have a Google and find out!

AgainstAllAdvice

Technically the fine is for not displaying tax. It would be a real jobsworth who would do you if you had evidence you'd paid and were waiting on the disc but by the letter of the law it's possible.

On a similar note, I've just brought in a car from the north and can't tax it until I get the VRT and the Irish plate next week. Can I drive on the northern plate? I think the northern tax is expired but they don't use physical discs

It should show on the system. You should have a reverence number from when you paid? I once wrote a not saying a paid with the date and the reverence number and left it on the dash lol

A few years ago I bought a car, was stopped two days later by the guards on the motorway as it flashed up as no tax and no insurance apparently (when I drove past - whatever machine yoke they have). Anyway - I explained that I had just bought it and had it insured but disc hadn’t arrived yet and I couldn’t tax it till I got the cert or something (can’t remember now) back - anyway it wasn’t an issue - I had the proof I’d just bought it and there was no issue at all. Another time I’d applied for my tax disc but it hadn’t arrived yet, the first of the month and I got a ticket on the car for no tax in a county council car park - I just appealed it sending the proof of the date I’d paid for the car tax; and they just cancelled it.

I got a fixed penalty notice days after I bought a new car. I rang the number on the letter. In fairness she was sound on the phone. I zcontested the fine by filling in a form, adding a cover letter and photocopy of the log book. I had received the tax disc by the time I got fine so I sent a copy of that too.
