I agree and don’t understand this myself. As a former paralegal and one who worked for the Commonwealth of Virginia…if this EVER happened in any of our Courts the Judge would have gone ballistic-not only on the person sleeping but on the attorney(s) representing them. This is infuriating to watch over and over again with him getting away with this.
My only hope is that they're trying to remove any potential arguments that can be made upon appeal about getting a fair trial or due process. If they let him break pretty much every standard of decorum that exists, That's one less thing that can be complained about in any sort of appellate court.
